Wilenchik was part of the Arizona branch of the failsuits regarding the 2020 election. Wilenchik also represented the Cyber Ninjas.

Arizona Officials Warned Fake Electors Plan Could ‘Appear Treasonous’
Politicians involved in Donald Trump’s effort to put forth electors to falsely claim he had won Arizona said doing so without first filing a legal challenge could look like a crime.

Two Arizona Republicans recruited by allies of former President Donald J. Trump to join an effort to keep him in office after he lost the 2020 election grew so concerned about the plan that they told lawyers working on it that they feared their actions could be seen as treason, according to emails reviewed by The New York Times.

Kelli Ward, the chairwoman of the Arizona Republican Party, and Kelly Townsend, a state senator, were both said to have expressed concerns to Mr. Trump’s lawyers in December 2020 about participating in a plan to sign on to a slate of electors claiming that Mr. Trump had won Arizona, even though Joseph R. Biden Jr. had won the state.

Kenneth Chesebro, a lawyer working for Mr. Trump’s campaign, wrote in a Dec. 11, 2020, email to other members of the legal team that Ms. Ward and Ms. Townsend had raised concerns about casting votes as part of an alternate slate of electors because there was no pending legal challenge that could flip the results of Arizona’s election.

“Ward and Townsend are concerned it could appear treasonous for the AZ electors to vote on Monday if there is no pending court proceeding that might, eventually, lead to the electors being ratified as the legitimate ones,” Mr. Chesebro wrote to the group, which included Rudolph W. Giuliani, Mr. Trump’s personal lawyer.

Mr. Chesebro wrote the word “treasonous” in bold.

The use of the word underscored how well aware at least some of Mr. Trump’s allies were that they were undertaking truly extraordinary steps to keep him in office, so much so that they risked being seen as betraying their country.

Arizona Republican Party Chair Kelli Ward asserts fake electors only meant as fail-safe

The chair of Arizona’s Republican Party, according to a court filing, became part of an alternate slate of presidential electors, sending documents falsely asserting herself and others as such to Congress, only as a fail-safe should the certified results be overturned.

Attorneys for Kelli Ward, the head of the state Republican Party since 2019, said in the filing that the 11 Republicans, including Ward and her husband, Michael, gathered in December 2020 to cast votes for then-President Donald Trump and Vice President Mike Pence “in the event that the legal challenges to the Arizona results succeeded.”

DETROIT (AP) — The Michigan attorney general said Friday there's "clear evidence" to pursue charges against pro-Donald Trump Republicans who claimed they were the state's presidential electors in 2020, despite Democrat Joe Biden's 154,000-vote victory.

Dana Nessel referred the matter to federal prosecutors last year, but no public action has been taken. A year later, she said it's time for state authorities to step in.

“Let's be fair about what this was: It was an effort to overturn a lawful election,” Nessel, a Democrat, said. “That type of activity can’t go without any consequences. ... There are laws that specifically speak to their actions. I plan to reopen the investigation.”

In December 2020, Michigan’s electors cast 16 votes for Biden, following his 2.8 percentage point win in the state over Trump. But a separate group tried to enter the state Capitol with Trump’s Electoral College candidates.

The federal government notified the state that it had received unofficial signed certificates from GOP electors. The group included Meshawn Maddock, co-chair of the Michigan Republican Party.

Invalid certificates also were mailed to the U.S. Senate, the Michigan secretary of state and a federal court in western Michigan.

“There is clear evidence to support charges against those 16 false electors,” Nessel told reporters, noting the work of the House committee investigating the 2021 post-election riot at the U.S. Capitol.

A number of Michigan GOP electors were named in a lawsuit after they falsely declared in official documents that former President Trump won the 2020 presidential election.

In the lawsuit filed Wednesday in the Kent County Circuit Court, three Democratic presidential electors accused the 16 Republicans of submitting fraudulent election certificates in a scheme “to steal the election and install the losing candidate as President.” Michigan’s Democratic electorate had already filed their official documentation certifying President Biden’s win.

The lawsuit alleges that the GOP electorates created a fake election “certificate signed by the defendants and styled ‘Certificate of the Votes of the 2020 Electors from Michigan, which they offered as an official public record.”

The plaintiffs — Blake Mazurek, Robin Smith and Timothy Smith — also noted in the suit that the GOP electors claimed they had “convened and organized in the State Capitol on December 14, 2020 to cast Michigan’s 16 electoral votes for Donald Trump, when in fact none of this was true.” They allege that, in reality, a group of the electors had walked to the Capitol after a Michigan Republican Party meeting and were denied entry.

Per the lawsuit, the plaintiffs (actual electors) are suing the fake electors for: Declaratory judgment; invasion of privacy (false light); conversation; and conspiracy. Ask is the declaratory judgment; at least $25k, to be tripled; attorneys fees; exemplary damages; costs.


I didn't read it closely, but I'm not seeing much here.

Opinion: Arizona Attorney General Kris Mayes is going to do what predecessor Mark Brnovich refused to do: investigate those who tried to steal an election.

The arrogance of the fake electors in Arizona who tried to pawn themselves off as legitimate in order to give Joe Biden’s electoral college votes to Donald Trump is best seen in an email to a Trump adviser from Arizona attorney Jack Wilenchik.

Former Arizona Republican Party Chair Kelli Ward and her merry band of operatives were trying to overturn the will of Arizona voters when Wilenchik wrote to Trump adviser Boris Epshteyn, “We (Arizona Republicans) would just be sending in ‘fake’ electoral votes to Pence so that ‘someone’ in Congress can make an objection when they start counting votes, and start arguing that the ‘fake’ votes should be counted.”

Later, Wilenchik sent a follow-up email saying, “‘alternative’ votes is probably a better term than ‘fake’ votes,” followed by a smiley face emoji.

The charged individuals are Kathy Berden, a Republican National Committeewoman from Michigan; William (Hank) Choate; Amy Facchinello; Clifford Frost; Stanley Grot; John Haggard; Mary-Ann Henry; Timothy King; Michele Lundgren, Meshawn Maddock, the former co-chair of the Michigan Republican Party; James Renner; Mayra Rodriguez; Rose Rook; Marian Sheridan; Ken Thompson; and Kent Vanderwood.

All 16 individuals were charged with multiple felonies “for their role in the alleged false electors scheme following the 2020 U.S. presidential election,” Nessel’s office announced. The counts include one count of conspiracy to commit forgery, two counts of forgery, one count of conspiracy to commit uttering and publishing and one count of uttering and publishing – all of which carry a maximum of 14 years in prison – as well as one count of conspiracy to commit election law forgery and two counts of election law forgery, which carry a maximum of five years in prison.

The group of 16 fake electors from Michigan includes current and former state GOP officials, the Republican National Committee member, a sitting mayor, a school board member and Trump supporters who were the plaintiffs in a frivolous lawsuit that tried to overturn the 2020 results.

The 16 fake GOP electors from Michigan met in Lansing on December 14, 2020, and signed certificates falsely proclaiming that Trump won the state and they were the rightful electors. They were rebuffed by police when they tried to enter the statehouse to deliver the papers, according to videos of the interaction, which took place while the real group of Democratic electors were meeting inside the building. President Joe Biden defeated Trump by a little more than 154,000 votes in the 2020 election.
Obviously these defendants conspired with each other, but I'm curious if the charging document also refers to unindicted co-conspirators, i.e., the geniuses behind this scheme, such as Eastman.
“These defendants may have believed the now long-debunked myths of vote tampering or ballot dumps,” Nessel said. “They may have felt compelled to follow the call to action from a president they held fealty to. They may have even genuinely believed that this was their patriotic duty.”

She continued, “But none of those reasons or feelings provide legal justification to violate the law and upend our Constitution and our nation’s traditions of representative government, self-determination, and a government by the people.”
Among the defendants' anticipated defenses likely will be no specific intent, due either to their "mistaken" beliefs or reliance on some counsel's advice.

And/or the First Amendment: "We wuz just cosplaying our grievances!"
