Judge Scolds Trump Legal Team and Lets James’s Lawsuit Proceed A New York judge declined to dismiss the state attorney general’s suit against the former president and called his lawyers’ filing frivolous.

A New York judge declined on Friday to throw out the state attorney general’s civil fraud case against former President Donald J. Trump, increasing the likelihood that he will face a trial this fall.
In a sharply worded order, the judge, Justice Arthur F. Engoron of State Supreme Court in Manhattan, denied Mr. Trump’s motion to dismiss the case, granting the attorney general, Letitia James, another victory in the matter. In September, Ms. James filed a lawsuit accusing Mr. Trump, three of his adult children and their family business of overvaluing his assets by billions of dollars.
In his written order, Justice Engoron said that some of the arguments repeatedly made by Mr. Trump’s lawyers were “frivolous,” and had been “borderline frivolous even the first time defendants made them.”
The judge also rejected a separate attempt by Mr. Trump’s daughter Ivanka, who is named as a defendant in Ms. James’s lawsuit, to dismiss the accusations against her.
“Once again,” Ms. James said in a statement, “Donald Trump’s attempts to evade the law have been rejected.” The decision, she added, “makes clear that Donald Trump is not above the law and must answer for his actions in court.”

Trump in Even More Legal Hot Water After Lying to Judge
Jose Pagliery
Tue, January 31, 2023 at 5:15 PM GMT+1
Former President Donald Trump appears to have lied in sworn court records, opening him up to severe sanctions by a New York judge who has already lost his patience and threatened to punish him before.
Trump claimed he wasn’t the president of the Trump Organization during his four years at the White House, despite previously testifying that he was an “inactive president.” And he claimed that he didn’t have a financial stake in a partnership with the real estate company Vornado, even though he previously testified that he did.
On Tuesday, the New York Attorney General’s Office asked Justice Arthur F. Engoron to intervene quickly to ensure that the former president still faces a trial later this year that could bankrupt his company.

Ivanka Trump Separates Herself From Brothers in High-Stakes Legal Case
BY KATHERINE FUNG
ON 3/7/23 AT 5:04 PM EST
Ivanka Trump is seeking to separate herself from her two brothers, Donald Trump Jr. and Eric Trump, in the high-stakes New York state fraud case against the Trump Organization.
In a letter filed Monday, Reid Figel, the attorney representing Ivanka in the lawsuit filed by New York Attorney General Letitia James, asked Judge Arthur Engoron to recognize that Donald Trump's eldest daughter left the family company in 2017 and that the allegations made against her are different from the ones made against her brothers, father and their real estate empire.
Figel wrote that because there is not "a single allegation that Ms. Trump directly or indirectly created, prepared, reviewed, or certified any of her father's financial statements," Ivanka's factual and legal defenses are unique.

New York Attorney General Letitia James will depose former President Donald Trump in a civil fraud investigation the week of April 10, MSNBC reported.

No link, but saw chatter on CNN that tfg maybe won't be taking the 5th today. They speculated that because it's civil and not criminal and him taking the 5th can be used against him in civil court.

I'd be shocked if he doesn't. He's facing criminal charges of fraud and this is civil fraud and there is likely some overlap, so any questions in the civil case which might expose him to criminal charges, he'd be a fool if he doesn't take the Fifth.

If tfg doesn’t take the 5th, any bets on how long it will take him to perjure himself? A nanosecond?

He knows that he is unpopular in New York. I am sure that by now he has listened to his advisors and counselors who have asked him to repeat: Civil juries can make adverse inferences when a deponent or witness takes the fifth in a civil matter. Civil juries can make adverse inferences when a deponent or witness takes the fifth in a civil matter.
He must hope that the evidence against him is so complex and arcane that the average juror will not comprehend how he cooked things up depending upon which way the wind was blowing. And with his penchant for double-speak, confusion will win out and he and his company will prevail on most of the counts.

Legal THs on MeidasTouch say that he didn't take the 5th to avoid the adverse inference.
They also credit Alvin Bragg with biding his time on the big Fuckhead financial case he has thus far passed on till _after_ he testified in the James case. They say Bragg may, after getting the record of what Fuckhead says, charge him with the big financial case, with the benefit of whatever crap he says in the James case.
This is worth a look:

One of the claims by the NY AG is that Trump inflated the valuations of his properties and otherwise provided inaccurate statements. Trumps latest post confirms the financials were inaccurate and he desires to inflate them more.

Well well well, if the invisible inherent value (otherwise also know as vapourware) of the T enterprise is so much more, why not make an IPO and go to the stock exchange. The speculators will give you the fig leaf you are looking for to cover the failings of the bookkeepers.
