I too will take the over on Melania:
The text is arguably innocuous, as it appears the sender was concerned about luggage space on the plane, and not the content of the boxes eating up the valuable luggage space.

Meaning the DOJ firmly believes the retention was unauthorized, and isn't going to dignify the magic declassification theory or the belief the president has the authority to determine what is presidential versus personal.

I am aware of a military case where the government charged both (d) and (e) and decided to let the jury figure it out (IIRC, the defense theory was authorized possession, then he took it home by accident). The jury was never instructed on the difference between (d) and (e) or that the accused was charged in the alternative. The appellate court threw out the specification alleging (d), affirmed the specification alleging (e), and reassessed the sentence. No change.
It’s obvious from the indictment that the government’s theory is that he removed them from the White House after he was no longer President, so (e) is right, I think.
I love how the government goes out of its way in the indictment to debunk the magic declassification theory by using Trump’s own I-can’t-declassify-this-because-I’m-no-longer-President schtick against him, while the staffers are yucking it up.

Prediction: Nauta soon will plead guilty to count 38 (the section 1001 charge for lying to the Feebs about the boxes) and the government is going to recommend no prison time. All other counts to be dismissed.
Because, IMO, Nauta flipped.
