Much has been written in the last 24 hours about where charges against former President Donald Trump would be brought with respect to his handling of government documents and obstructing the investigation into that conduct. The Constitution requires each criminal charge be brought in the location where the criminal conduct at issue occurred, but often that is in multiple jurisdictions, leaving the government free to choose from a variety of locations after considering a variety of factors.

But what if.

What if Special Counsel Jack Smith charges Trump in Washington DC, wins a criminal conviction from a jury finding the former president guilty of all charges, but also finding that the conduct occurred outside of DC and thus should never have heard the case? Can Smith try again in Florida?

Maybe not.

Several years ago an Army Major was convicted of (among other, less serious offenses) retention and dissemination. He got 10 years.

If TFG is indicted soon, can we expect a trial before the election?

IIRC, the trial on the New York charges having to do with his accounting of the hush money paid to Stormy Daniels is scheduled for August of 2024, smack in the middle of the campaign season. The Federal charges are arguably more serious and complicated and it could take longer for the DOJ to prepare their case and for TFG's lawyers to prepare their defense.

Also, too, what can we expect from the MAGAts in Congress (or should we call them Magadonians)? Aside from their heads exploding, what will they try to do, impeach everyone in sight?

So both David Harbach (who tried cases against former U.S. Senator John Edwards and former Virginia Governor Robert F. McDonnell) and Jay Bratt (chief of DOJ’s Counterintelligence and Export Control Section and long time national security prosecutor) are in Miami…

Tim Hogan has some very interesting thoughts! :pray:
1. I think I have another possible explanation for why there's another Trump grand jury in South Florida. After I skimmed through the #TaylorBudowich Jan 6th Committee transcript where his role in the Save America Pac was addressed I thought perhaps he lived
2. in Florida but I don't think he does. I think they are building a case about the PACs as a grift along with other fund raising activities that were the reason #45 started to plan the attack on Congress. But the reason they are in Florida, if this pans out, will blow
3. what's left of Trump's mind. Trump used MAL to commit crimes. I think they may be planning to seize it. From the new DOJ manual:
4. Venue for an 'in rem' civil forfeiture is clearly in that district. And in a civil forfeiture they can seize it before he's convicted if the property was used to commit crimes. Just like a drug smuggler's plane or boat.
5. And now I'm going to watch for a grand jury in New Jersey. Isn't that where he waived a purloined classified document bagging to all present about it?
