El Paso Times: With the cease and desist lifted, privately funded border wall will be completed soon:
A non-profit group touted the progress on a privately funded border wall Thursday, two days after the Sunland Park mayor said the barrier was being built illegally.

The We Build The Wall group held a press conference Thursday to officially unveil the “first ever privately built border wall on US-Mexico border."

On Tuesday, Sunland Park Mayor Javier Perea claimed that the wall was built illegally after the property owners did obtain the necessary permits to erect the fencing.

Sunland Park city officials sent the property owners and the group a cease and desist letter to halt the construction. Construction stopped Tuesday, but quickly began again Thursday after the group got the go-ahead from the city.

“We actually applied for permits last week and we were told we were set and ready to go,” We Build the Wall general counsel Kris Kobach said. “We asked the city inspector on Friday if we could begin to work and told by the city inspector that we could begin the work. But then on Tuesday, the city looked at one of the applications and thought they needed more information for that application., We were happy to provide and we did provide additional information, a more detailed a site plan, etc.”

He added, “A statement from someone (on Tuesday from city officials) when the stop work order was issued that they thought the project was not in compliance with the city's ordinances, that statement was incorrect. The city now agrees with us that there is no violation of any ordinance.”

Perea, however, maintains that American Eagle Brick Company, who owns the property where the wall is being constructed, was out of compliance by not having building permits at the time of construction.

“If they had done their due diligence ahead of time it would have given the staff enough time to address the concerns in an appropriate manner,” Perea said. “We will continue to ensure that they are meeting all city ordinances for the time being.”

He added the company may still be fined for initial non-compliance.

The stop work order was lifted by Sunland Park city officials at 4 p.m. Wednesday, Kobach said. He added after the work order was lifted, the group didn't have any of the machinery on site, so construction resumed Thursday morning.

The wall is more than 20 feet tall and goes up a 300-foot incline over mountainous terrain. It also extends seven feet into the ground.

Consumer complaints have prompted the state of Florida to open an investigation into the nonprofit group that raised more than $20 million to build a private border wall along the U.S.-Mexico border.

The investigation into the Florida-based group, We Build The Wall, was launched in mid-May, a spokesperson for the Department of Agriculture said in a statement Thursday.

“The Florida Department of Agriculture and Consumer Services can confirm that in response to consumer complaints referred by the Office of Florida Attorney General Ashley Moody, the Department opened an investigation into this charity on May 17,” the spokesperson said. “As this matter is now an active investigation, the Department cannot comment further. No additional information is available at this time.”

Haven't dug in to this mess lately, but it sounds like a 'murican company let them build this on their land. So there were no eminent domain issues. Would that be considered the "true" border? Doesn't Mexico have to agree? I also wonder what's on either side... if it's just a wall in the middle, don't tell them but people will go around it. This is also part of those militia people too, have seen border patrol has been buzzing around (why?) and the militia are in the Wall charity's videos.

The company that did the construction is the company where the CEO is on Fox News twice a week saying how fast and cheap he could build a wall all the way from El Paso to England in 2 weeks if Trump would just give him a gazongazillion dollar contract. I'm sure he did it as a commercial more than actually wanting to build a real wall. Although, I'm betting he did get in on a few million dollars of that sweet GoFundMe grift anyhow. Same-same Kris Kobach, who is probably billing them big money for his general counsel job.

There was like a 30 second news clip about the tariffs this morning on the train in London. It showed a clip of a wall that extended into the ocean with people wading around it. People on the train were laughing and saying, "build the wall"

I know, eh? This "wall" is the the ANSWER!

And I forget what I was listening to but the explanation of how the average American concerned about immigration can be easily sold on tangible/physical solutions (a WALL), but not on more nuanced ideas to curb the problem. Quick-fix, hit it with a hammer. It doesn't work that way in real life.

When I have discussions on the immigration issue with people, I ask, why do these people come here? It's not to steal our jobs. It's not to rape our women. It's not to murder. It's not to bring in drugs.

How stressed and desperate does a family have to feel to leave the country of their home -- leave family and friends and everything they know -- and in many cases, will never see again? A father leaving a wife and daughter behind to go first, never sure if they will ever be together again. I've seen that where I live, and it tears my heart out at times.

Shouldn't we focus our resources on that -- how to improve the lives of these people in their home countries?
To which Trump replied, Fuck the law. I don't give a fuck about the law. I want my fucking money.

Border Patrol agents apprehend largest group ever encountered in El Paso

EL PASO, Texas (CBS4) — Officials with the U.S. Customs and Border Protection said Border Patrol agents apprehended the largest group of migrants ever in El Paso on Wednesday.

CBP officials said 1,036 migrants crossed the border west of the Bridges of the Americas around 4 a.m.

CBP said all the migrants were from Honduras, Guatemala and El Salvador.

The group included 934 family members, 63 unaccompanied minors, and 39 single adults. They were taken into custody for processing and initial medical screenings. They will remain in U.S. Border Patrol custody until they are processed.

Agents apprehended a group of 430 people on Memorial Day.

In the month of May alone, Border Patrol apprehended 45 large groups totaling more than 7,900 migrants.

Border Patrol has apprehended 180 groups in the southwest border.

The Hill: Judge rejects House Democrats' attempt to block Trump use of military funds for border wall:
A federal judge has ruled against congressional Democrats who sought to temporarily stop the president from using military funds for a border wall.

Judge Trevor McFadden, a Trump appointee, handed the president a needed victory after the White House suffered several losses in legal battles with Democrats in recent days.

McFadden ruled that House Democrats cannot go to court to block Trump from using military funds to build the border wall "because the Constitution grants the House no standing to litigate these claims."

"To be clear, the Court does not imply that Congress may never sue the Executive to protect its powers," McFadden wrote.

But he said that because the House failed to show it has standing in court and given the lack of binding precedent showing it can sue and rulings made in related cases, "the Court cannot assume jurisdiction to proceed to the merits."

However, a federal judge in California last week ruled to block the administration from using some of the military funds tapped under the national emergency declaration.

House Democrats had argued that they could sue the president because they had exhausted every other option. And they claimed that Trump's attempt to divert military funds was unconstitutional because only Congress could appropriate funding.

The administration had argued that there was no circumstance in which Congress or the House could sue the executive branch.

House Democrats had also argued in a California court last month in support of states and a coalition of immigration group who also sought to stop Trump from using the military funds for the border wall.

Judge Haywood Gilliam, an Obama appointee, has ruled to partially stop the administration from tapping the Pentagon funding. The administration has said it will appeal his order.

Faced with Trump’s threat to impose steadily rising tariffs on goods imported from Mexico beginning Monday, Mexican officials have pledged to deploy up to 6,000 national guard troops to the area of the country’s border with Guatemala, a show of force they say will immediately reduce the number of Central Americans heading north toward the U.S. border.

The plan, a sweeping overhaul of asylum rules across the region, would require Central American migrants to seek refuge in the first country they enter after leaving their homeland, the two officials said. For Guatemalans, that would be Mexico. For migrants from Honduras and El Salvador, that would be Guatemala, whose government held talks last week with acting Homeland Security secretary Kevin McAleenan.

As if that is going to work out well.....

Ask the Europeans where that rule is in in place and where economic migrants arriving in Italy, Greece, Hungary etc, regularly exfiltrate to attempt to reach their preferred economic locations of Germany, Sweden and the United Kingdom.

Trump plans to declare new national emergency to impose tariffs
President Trump is planning to declare a new national emergency in order to implement sweeping tariffs on Mexico over the flow of Central American migrants to the U.S., according to a draft document of the declaration reviewed by The Hill.

According to the document, the new emergency is necessary due to “the failure of the Government of Mexico to take effective action to reduce the mass migration of aliens illegally crossing into the United States through Mexico.”

The new emergency declaration would follow a February emergency declaration, which Trump used to justify sending National Guard troops to support Customs and Border Protection (CBP) officials at the southern border.

The draft document signals that the White House believes that imposing the tariffs under the February emergency declaration might not pass legal muster. But it remains unclear if a final decision has been made to invoke another emergency. The White House did not answer questions about the document.
