How long will the court allow Ryan Bundy to act as his own attorney before revoking such privilege due to his acting out sovereign citizen fantasies in court?

I'm guessing it'll be like :sterngard: and I were discussing yesterday -- he won't be able to resist "instructing" the jury in what he imagines the law to be.

My guess is opening statements. I think he will seriously push it tomorrow but I think the Judge Brown will continue to do everything she can to make sure she is absolutely justified in taking it away from him.

Now, if he's still allowed inside the actual courtroom after Friday we will have to have another vote for how long before he's shackled to his chair in a straight-jacket and gagged - or will he go straight to the watching-it-on-closed-circuit-in-the-courthouse-cell stage.

Unfortunately, they seem to have stopped tying up and gagging defendants after closed circuit TV became available.

I'm torn between Stern and Volkonski. If CRyan makes it through tomorrow then I'd say first day is probably a good bet, although don't they still have to get through jury selection? I think the motions hearing may well be too much for him when all his last ditch efforts finally get shot down and shut down for real.

I voted for opening statements. As I understand it, voir dire is pretty heavily constrained (and there's every reason to believe the judge will keep it that way) but once he gets to speak for himself, he's going to pull the ripcord.

I'm thinking he'll barely make it through his pre-trial hearing tomorrow (Tuesday) to address last Friday's influx of late motions, and he'll be given "one MORE chance", but won't be able to make it through jury selection/voir dire.

Whatever happens, it's bound to be interesting!

I expect an outburst or two during jury selection, especially if they ask jurors their views on gun control or any other sensitive subject, which could be just about anything for that whiny baby.

Aren't we selling Cryan short? I just know he will be the best-dressed defendant come Wednesday. Snappy three-piece suit with striped silk tie and matching pocket square. Tassel loafers on his feet. He will have his zipped leather briefcase that holds all his defense strategy. He will dazzle the jury with his sartorial splendor and his poise at the lectern..

I voted voir dire. Even though Judge Brown will be the one asking questions, I don't think he'll be able to keep his mouth shut. That may only get him tossed but...

Honestly - I'll be surprised if he makes it through tomorrow without pitching a fit after his SovCit on steroids motions are denied.

Not that this may make a diff or dissuade you, but it's my understanding those questions were agreed to by both defense and prosecution. Yes, the judge will be asking the questions, but the questions are not ones of her making as I understand it. That said, it may not make ANY diff for Ryan. After all, he has his own set of laws to go by. Whatever they are.

Day 2 of testimony or later.

Judge Brown wants the ultimate decision to be appeal-proof, is a matter of the defendant's constitutional rights, and we're in the 9th Circuit. Too, also, the effect of any inappropriate questioning or argument during the first couple of days will be mitigated by the length of the trial, so it's not necessarily going to be as urgent an issue to deal with as it would be in a (for example) three-day trial.
