Yabut doesn't matter. It's sorta like the 2015 coin citing to Vattel and Minor v Happersett and birthers citing laws which are no longer good law, and dissenting opinions, etc. It's all good.

Vattel's Droit des Gens is often cited for the argument that, at the time of Independence, citizenship was decided by heredity not by birthplace. But Vattel was describing the generalities of legal opinion IN EUROPE, which meant that nearly every country had a very long history in fairly well established borders and possibly with centuries of that history occurring during the feudal period when most of the population was immobilized by serfdom. But the United States, created shortly after the publication of Vattel's book, was in a very different situation: An entirely new country, with borders that were rapidly expanding and no feudal or ancient history. The new United States was eager to acquire more citizens, and was further faced with the prospect of acquiring residents and immigrants whose parents had never been in North America, etc., so its purposes and motives for recognizing citizens was different from that of long-established European monarchies.

My point being that, although Vattel's book was enormously influential, it did not describe American citizenship law nor was it likely to be adopted on that topic by the new American govt even if that govt was willing to go along with Vattel on other legal topics.

Stop the Mint! They need to have Donald J. Trump prominently featured on the 2016 Birther Coin, it will sell YUGE! 1) Because it's him 2) Even if he loses he's a losing Birther and 3) If he wins, up, up, up! Bet they can charge more since Birthers know Trump is going to win. :P
