I found a copy of the complaint -- Devin Nunes Campaign Committee v. Seeley, et al. It is embedded here: https://www.visaliatimesdelta.com/story ... 900907001/

It's a SLAPP and it sues defendants based on their protected (privileged) First Amendment activities. It is subject to being stricken under C.C.P. sec. 425.16.

It alleges that defendants (using "dark money" and unlawful Super PACs) harassed Nunes and his allies and his wife's employer (and caused his campaign committee to lose money) by (1) making bogus ethics complaints against Nunes (protected activity), (2) by seeking and publishing emails by Nunes wife obtained under the California Public Records Act (also protected activity) and (3) by filing a petition for writ of mandate in the Superior Court directing the secretary of state to remove Nunes' description of himself as a farmer (also protected activity).

It's as if the clowns who represent Nunes have absolutely no idea of the existence of the anti-SLAPP law. Nor do they know how to plead a malicious prosecution claim, or know that "civil conspiracy" is not a free-standing tort.

This case should be a slam dunk for any competent lawyer who can read (something apparently the PI bozos Nunes has hired have not done). Tulare County may be a cow county, but its judges have experience with SLAPPs. See, e.g., Grenier v. Taylor (2015) 234 Cal.App.4th 471, 480 (a libel suit in which special motion to strike was denied because plaintiff demonstrated a likelihood he would prevail).

There is a Virginia lawyer involved – Steven S. Biss. Remember, there is also the Twitter case filed in Virginia. I suspect this incredibly stoopid complaint (a slam dunk loser and a SLAPP under California law) is his handiwork and the Fresno PI lawyers were simply local counsel who went along with it. (His name is on this complaint, too.) Why bother to research First Amendment law or how California protects free speech when you're PI lawyers and you have some genius from Virginia drafting all the pleadings for you?

I enjoy it when some arrogant out-of-state lawyer thinks he can get away with the same shit allowed in his own state, specifically one with weak or no anti-SLAPP laws.

Devin Nunes serves McClatchy with lawsuit four months after announcing complaint
The first hearing for Nunes’ lawsuit against Twitter is scheduled for Friday. Twitter has asked the court to dismiss the case on the grounds that Virginia is not the proper venue for the case.
