Police can’t rummage through your curbside garbage without warrant, Oregon Supreme Court says

A summary of this story is a drug conviction from 2014 was overturned.

But, the decision raises an interesting legal conundrum: If you retain privacy all the way to the dump, do you also retain ownship, and therefore liability for improper disposal?

I recently paid a licensed company $5,841 to remove the asbestos tainted vermiculite insulation from my attic. They sealed off the room with the attic access and all insulation was taken out through a window in that room. Each individual suited up and used a mask when they went up into the attic.

Interestingly enough, I should be getting back $4,125 from a trust fund set up by the government when the insulation manufacturer filed for bankruptcy protection. Assets from W.R. Grace were used to fund the trust in the bankruptcy agreement.

Greenwood Schmeenwood. From the Oregonian article:
The majority opinion noted that even the U.S. Supreme Court has said Americans don’t have a reasonable expectation of privacy “in trash left for collection in an area accessible to the public.” But the U.S. Supreme Court also said individual states are free to impose “more stringent constraints on police” based on their own constitutions.

Thursday’s ruling applies to curbside refuse collected from private homes. It doesn’t appear to apply to trash thrown in public garbage cans in public places. It’s unclear how the ruling might affect residents of condominiums or apartments, where trash is thrown in communal bins.

One Oregon Supreme Court justice -- Senior Justice Pro Tem Rives Kistler -- dissented. It looked like a simple domestic murder. Then police learned about the alien reptile cult.
The call lit up the 911 dispatch center in the early morning hours of July 15, 2017.
“My boyfriend had a gun,” Barbara Rogers told the operator from a home in Coolbaugh Township, Pa., about 110 miles north of Philadelphia, WNEP would later report. “He told me to hold it here and press the trigger. Oh my God, he’s dead!”

When police arrived at the tan double-wide trailer, inside they found 32-year-old Steven Mineo dead from a close-range .45 bullet wound in his forehead. Rogers was arrested and charged with her boyfriend’s murder.

But behind what first appeared to be a simple domestic killing, investigators soon found a bizarre backstory involving an extraterrestrial cult that had swallowed up both Rogers and Mineo.

According to the Pocono Record, as Rogers’s first-degree murder trial began in March, she claimed in court the couple had gotten into a disagreement with the leader of the cult, who preaches a heady stew of alien conspiracy theories, apocalyptic biblical interpretation, and warnings about “reptilian” extraterrestrials living secretly as humans. Rogers claimed a distraught Mineo had placed the gun in her hands and pulled the trigger. She said she did not know the gun was loaded.

Men Wanted For Vandalizing Nature Preserve, Giving Beer To Goat

A group of people are wanted for petty larceny, criminal mischief and forcing an animal to drink beer at the Sweetbriar Nature Preserve in Smithtown.

According to Smithtown Department of Public Safety Deputy Chief Kevin McPadden, back in February a trail camera at the preserve was stolen.

However, last week a volunteer discovered the camera, which was thrown into a lake, and retrieved the footage.

The video showed that on Feb. 21 four or five men ripped the camera from the tree and threw it in the lake after trespassing on the property. At one point they walked up to the camera, providing a clear image of their faces.
