Appeals Court Won't Reconsider Inmate's Gender Surgery Case

BOISE, Idaho — The 9th U.S. Circuit Court of Appeals has become the first circuit in the nation to order a state to pay for an inmate's gender confirmation surgery, ruling Monday that a three-judge panel decision will stand.

Idaho Gov. Brad Little says he will ask the U.S. Supreme Court to hear the case.

A three-judge panel of the appellate court first ruled in August that the state must give 32-year-old inmate Adree Edmo gender confirmation surgery, agreeing with a federal judge in Idaho that denying the surgery amounted to cruel and unusual punishment, a violation of the Eighth Amendment of the U.S. Constitution.

The state then asked the full appeals court to reconsider the case — but the court voted against the move this week.

However, several judges expressed their concern Monday with the underlying ruling directing the state to pay for gender reassignment surgery for Edmo. Several others dissented completely with the ruling not to reconsider the case.

So Kim Davis filed a cert. petition; Davis continues to represented by Mathew Staver ("the dumbest person not named Larry Klayman") of Liberty Counsel.

And Roy Moore's Foundation for Moral Law filed a supporting amicus brief.

Interestingly, the case went to the 2/28 conference, but instead of dying there, it was kicked back for a response. :think:

Response presently is due 4/13.

Idaho governor signs two bills aimed at limiting transgender individuals

Idaho passed two anti-transgender bills, with Gov. Brad Little. (R) approving legislation to prohibit sex changes on birth certificates and bans on transgender girls and women from competing in women's sports leagues, according to CBS.

The deadline to veto the measures was Tuesday, which is also International Transgender Day of Visibility.

The American Civil Liberties Union (ACLU) of Idaho released a statement saying that the legislation discriminates against transgender people while invading the privacy of Idaho students.

"It distracts from the urgent need for the State of Idaho to focus its attention on the global pandemic, COVID-19," the ACLU added.

The new birth certificate policy ignores a 2018 federal court ruling that deemed the banning of birth certificate sex changes violates the Equal Protection Clause in the U.S. Constitution.

Nope, this is not it.

Sex and gender are not exclusively binary concepts. Transgender & non-binary people are who they say they are.

This abandonment of the LGBTQ community by someone who lent magic to the lives of *so many* queer youth is disappointing and incredibly sad.

Trump has no concept of time, and thus history.

But his enablers do. And they set up these timelines knowing that DJT will bumble though disavowing any significance.

But, DJT is getting ever closer to really stepping in it when goes off-script..

Rewind back to four years ago and think about how inconceivable any of this would be.

I guess what we thought was progress was just a facade..

The U.S. Supreme Court ruled Monday that existing federal law forbids job discrimination on the basis of sexual orientation, a major victory for advocates of gay rights — and a surprising one from an increasingly conservative court.

The decision said Title VII of the Civil Rights Act of 1964, which makes it illegal for employers to discriminate because of a person's sex, among other factors, also covers sexual orientation. It upheld rulings from lower courts that said sexual orientation discrimination was a form of sex discrimination.

Across the nation, 21 states have their own laws prohibiting job discrimination based on sexual orientation or gender identity. Seven more provide that protection only to public employees. Those laws remain in force, but Monday's ruling means federal law now provides similar protection for LGBT employees in the rest of the country.

Gay rights groups considered the case a highly significant one, even more important than the fight to get the right to marry, because nearly every LGBT adult has or needs a job.

How on earth did they get that through? At least two of the old fossils have to be having coronaries as we speak. This along with Der Trumpenführer's latest EO stripping protections should make for an interesting news week. Him trying to undo by EO what the USSC did with a ruling. Explosion for the WH coming.
