Wasn't supposed to tell you Volkonski, but we worked it out for Judge Carter to have the hearing on your Birthday! Happy Birthday!

Wish we could hear Roy's reaction when Larry explains what this means: "There would need to be full discovery on substantial truth. There would need to be full discovery on actual malice."
In what universe do you think Klayman knows what that means?

Didn't someone tell Klaymen he couldn't keep calling his client "Chief Justice"?

I mean, not only is he not, but he was forcibly removed from the office, wasn't he?

When this case was in D.C., before it was transferred, that judge chided Klayman, but didn't order Klayman or anything.

Moore was removed from office for the first time over his rock. He later was suspended (over his same-sex marriage orders), and then resigned; his suspension was tantamount to removal.

Except she does not know how GIL treats discovery. I have 37 reasons why she would be wrong on the attempt to induce dismissal.
And repeated intentional refusal to comply with discovery requirements leads to terminating sanctions.
Would that be like Rule 37?

I picked this tidbit in the Elizabeth McNamara resumé:
Cruise v. Bauer Publishing, et al.
Lead counsel representing all defendants in libel action brought by Tom Cruise arising out of reporting in In Touch and Life
& Style that he had "abandoned" his daughter. Amicably resolved following discovery. (C.D. Cal. 2013)
Amicably resolved after discovery? For whom?
Is that a gentle way to say that they had him dead to rights?

Tony Ortega, the leading journalist covering Scientology, wrote extensively about this suit when it was filed and resolved. His site is www.tonyortega.org. It was a pretty bogus suit, probably filed because Bauer is a foreign-owned company and thus might have been more willing to pay out because libel laws in Europe tend to favor plaintiffs more (certainly true in England, though I don't know exactly what the situation is in Germany). This is confirmation what a lot of people on Ortega's site thought at the time: that Cruise didn't have much of a case and that it woldn't survive discovery.

Thanks John. I am on the site now, reading about Cruise's deposition.

Bottom Line, Roy Moore will not want to be deposed by Ms McNamara (if he has any brain at all).

Cliff Notes on the Cruise thing? I’m too tired.

So we'll be seeing that deposition any time then?
