Re: State of Wisconsin vs. Kyle Howard Rittenhouse

A lot is going to ride on the ability of the prosecutors to screen out defense-friendly jurors at voir dire. That is for sure.

Re: 2020 Election Lawsuits

Powell's complaint repeatedly states that the Trump Campaign is the aggrieved party, which is really odd since the Trump Campaign isn't a party to the suit and has expressly disowned her as its legal counsel.

Re: General SCOTUS Stuff

I have to say, I’m with the conservatives on this one as far as the underlying issue goes (although since the restriction is no longer in effect, I think the Court shouldn’t have granted the injunction). I don’t even believe in God, but I do believe in the free exercise of religion. It’s a fundamen...

Re: 2020 Election Lawsuits

I'm on page 4, and already I think this complaint is screaming for Rule 11 sanctions from the court. Seriously. It's long past time that courts started making examples of attorneys who file aggressively frivolous nonsense suits like this one.

Re: State of Wisconsin vs. Kyle Howard Rittenhouse

So Rittenhouse did many things wrong. Of course he should not have been there at all, carrying a weapon it was probably illegal for him to carry. And one reason we don't want this done is precisely because he does not have training. I am sure he had no plan for what he would do if actually attacked...

Whoever did the lighting in that place aught to be shot. Of course it might be a place what wasn't set up for video in the first place, but if they had some kind of lamp in the front it would improve things at least. Of course, I'm assuming they had someone to do the lighting. The fail parade is on...

Re: 2020 Election Lawsuits

Further to the footnotes point: Look, I'll defend the judicious use of footnotes. As some may have noticed here, I am sometimes prone to tangents and digressions in my writing. Footnotes can be useful to include information that might give the reader a more fulsome understanding of the material, but...

Has anyone found a download source that collects the briefs filed today? The Democracy Docket only includes their on (DNC's) papers, not those from the other parties or amici. Also if you think the first person who attacked him was some kind of sainted BLM protestor, of even an Antifa activist, you also don't know what happened. The first attacker Rosenbaum was an ex-con who served 14 years in AZ prison for sexually assualting 4 boys between 9 and 11 including anal rape ...

Re: State of Wisconsin vs. Kyle Howard Rittenhouse

Thanks. I was thinking about relevance in the context of what the earlier poster said about child molestation, for example. Let’s say the dude’s MO is to molest children he’s babysitting, then he accosts Rittenhouse in the street. To me, even if Rittenhouse knew about those prior acts, they are so ...

IANAL, but isn’t ultimately reaching SCOTUS Rudy’s only aim? He repeatedly states that every denial gets him closer to that goal. Re: 2020 Election Lawsuits

Judge Brann cited bad faith, dilatory motive, and futility as reasons to deny a leave to file a SAC. I note that the appellate brief only touches on the undue delay aspect.

This brief is a hot mess inside a dumpster fire in the middle of a train wreck.

Re: 2020 Election Lawsuits

I can't be bothered to check MD-PA's local rules, but the number and length of the footnotes in that pleading would get it tossed in some jurisdictions. A lot of district judges have gotten sick of lawyers getting ridiculous with things like putting two footnotes in the title of your damn pleading. ...

Wasn't Allen West a Congressman from Florida? And now he's chairman of the Republican Party of Texas. So there is a parallel to Alan Keyes in the whole "carpetbagger" aspect of it. They literally couldn't find an actual Texan up to the job of licking Donald Trump's boots, propping up Greg ...

So, am I Captain Obvious here? The ONLY reason for these ridiculous suits is that somewhere among them is (they think) the magic yellow brick road to SCOTUS. You're correct that they think that. They are very much mistaken. Were SCOTUS to grant any of these insane lawsuits (seriously, read the opin...

Re: State of Wisconsin vs. Kyle Howard Rittenhouse

What a mess. Kyle Rittenhouse is 17. He's being used as a prop for every agenda across the spectrum. I don't like it. He may be a homicidal gun-toting nutcase, or he may be an average 17yo confused adolescent that suffered bullying issues. It's tragic. The kid has become a piñata. :nope: :( I'll sa...
