There is an old saying among criminal lawyers that a prosecutor never wants a jury to return a verdict on Christmas Eve.

Re: Ghislaine Maxwell trial
Yes, but witnesses don't want to sit around for days waiting to testify. My experience as a trial lawyer was that, if you can't get a witness to court with only 2 or 3 hours' notice, you won't get them at all.

Re: Donald J. Trump v. Letitia James
Question from an overseas IANAL: does that actually have any effect? Can just anyone (other than white privilege) ask a court to halt judicial investigations? My WAG is it is possible , but only under the rarest of circumstances.* Like if an obviously racist police officer was using the power of th...

I was going to say, kinda sorta like John Gotti going to court to stop the NYC DA from investigating him because they had it in for him, but Capone works too, also, but filly beat me to it. Po widdle Donny, the mean old AG is digging in to all his financial scams and crimes. Boo effing hoo!!!! On a...

I just finished The Hollow Places, a very good (and very creepy) horror novel by T. Kingfisher. I'm now starting A Confederacy of Dunces, which I've always meant to read and never got around to.

Welp, its Brazilian BBQ with fixings today. Which means Picanha and stuff. Turkey is awful. I don't eat dark meat because the the grease fat -- and the white meat is so dry it needs slathered in gravy to be edible. Have fun kids. My wife and I were once in Brazil on Thanksgiving (she was there on b...

Happy Thanksgiving, everyone! Our tradition for the past few years has been to pick up Thanksgiving dinner from the local Indian restaurant (!), which prepares a tandoori turkey with basmati rice stuffing and cranberry chutney. (We add a couple of optional side dishes-- curried cauliflower and chick...

I saw Dune today, and I pretty much agree with everything Foggy said.
I hope it does well enough that Part II gets made.

If he tossed it because the evidence was legally insufficient (that is, the government failed to present evidence on an element of the offense), then the State cannot appeal. If he dismissed the charges because he concluded that the Wisconsin statute does not prohibit a 17-year-old non-hunter from ...

If the dismissal was after the trial started, then double jeopardy would bar an appeal.andersweinstein wrote: ↑Sat Nov 20, 2021 6:40 pm Curious: is the judge's dismissal of the gun charge the same as an acquittal wrt double jeopardy? Or is it something the prosecution could in theory appeal?

Re: Kyle Rittenhouse, previous owner of a Smith & Wesson M&P15
So, if a conviction is overturned, I guess the defendant walks and can't be tried again? If the conviction is reversed on grounds that the evidence was insufficient, the defendant walks. If it's reversed on any other ground (incorrect jury instructions, error in admitting evidence, etc.), the case ...

Re: Kyle Rittenhouse, previous owner of a Smith & Wesson M&P15
I am really disappointed in the prosecutor's rebuttal case. They could have brought in two witnesses to testify that the defendant lied to the jury. Why didn't they do this? He lied about being a nursing student at University of Arizona and he lied about the police department issuing him a bullet p...

“sawed-off German Shepherds." A pick up parked in front of me one day. There was a beautiful, friendly German Shepherd in the back, eyes gleaming; coat, too. Dad got out and opened the tailgate, slid a ramp out and leaned it at a shallow angle, and led the goggie down to the sidewalk. Perfect ...

Does anyone remember the explanation, such as it is, for the belief that the Kennedys are in control of TFG's return? I was asked why these people think RCs and Democrats like the Kennedys would become the deus ex machina of returning TFG as president. When JFK Jr. died, Hillary Clinton was running...

We're still 100% confident that Democrats will keep the House and Senate in the 2022 Midterms.
I pray you're right, but I have to say that I'm not confident.
