Election 2022: Democrats Are Going To Win Again

Since the #AZAudit topic is veering off track, will say it again here... Will take the other side of the bet that Democrats are going to lose 2022. We think these bogus audits will end up being nothing, like we've seen before, the GOP screws up and doesn't win back either house in 2022, the disgrac...

Trump v. Clinton (S.D. Fla., 2:22cv-14102)

If we assume that this request is granted, who ponies up the amount? Does the plaintiff, or does the lawyer who drafted the complaint, even though the lawyer knows it is a pile of poop or promoted it? The judge can sanction the attorney, the client, or both. And how are the funds transferred from t...

General Law and Lawsuits

I think Federal Law allows recording by one party and this was a federal case. The case was in federal court, but it was governed by state law, specifically California law. (Why state law is sometimes applied in federal courts is complicated, so I won't get into it unless someone asks.) California ...

Twitter v. Elon R. Musk

I joined about 6 months ago, to follow Mike Dunford's and Akiva Cohen's legal commentary.
I subsequently started interacting with some doggies and with some jazz and Grateful Dead fans.
For now I'm staying. If the experience becomes unpleasant, I'll find somewhere else to go.

Twitter v. Elon R. Musk

If you have checked the Fogbow Calendar lately, you know that Friday is the deadline given by the judge to complete the deal, and if he doesn't, then trial begins on Monday (I think, not 100% on that). So he's under some pressure to get it done. I think what the judge said was that, if the deal doe...

Re: Dogs!

I'm still sad about losing Ted, but have finally stopped crying. Ted was a rejected and abused dog when I found him. We had great years together. I vowed to not have another dog because they break our hearts. But like when I met Ted, I couldn't turn away from Koa. Not a picture of him, but he looks...

Re: Dogs!

Teddy passed away at home this morning. He just drifted away. No scary visit to the vet. The vet is arranging for a person to pick him up since he is too heavy for me to carry him to car. I tried, and sprained my knee. From all your stories about him, Ted was clearly a Very Good Boy. I'm glad he we...

Re: US v Peter Navarro

Navarro's argument is apparently that they told him his rights without explicitly reading them from a card, which Navarro considers as possibly a violation of the fourth amendment. IANAL, but I'm pretty sure the requirement is to advise the party of their rights, not to explicitly read them ...

Re: Constitution Association, Inc v Kamala Devi Harris, SD California & Appeal, Ninth Circuit

It's a bit more complicated than that. Federal Rule of Civil Procedure 4(e)(1) lets you, as one permitted method of service, follow "state law for serving a summons in an action brought in courts of ... the state where the district court is located or where service is made." California st...

Re: Constitution Association, Inc v Kamala Devi Harris, SD California & Appeal, Ninth Circuit

And his ridiculous argument ignores the rules on service, IIRC. If you are suing somebody personally, then it has to be personal service, not mailed. You get to mail it if you are serving a government official. Lawyers are free to correct me but I thought that was what is stated in the FRCP. It's a...
