Interesting read. And woot! Dennis Mongomery and Pornstache are included. Facebook has Klayman's number: It cites some of many his fails -- including the Klayman/Loomer failboat that unsuccessfully argued that Teh Tech (including Facebook) was conspiring to censor conservatives. Here's the footnote...

Nice to see Chuckles getting in the act with his fresh new information! Re: Reality Check Radio

I agree that I don't think Fox News most favorite Democrat Tusli Gabbord has much of a chance for either position on the ticket. Harris is going to go relatively deep (if not all the way) in the primaries; she'll be subjected to a some ballot challenges by the usual losers. Whether Gabbard survives...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

Not me. Most of our cases are losers. But in our system appeal is automatic, so you do what you can without crossing the line into frivolousness. The criminal defense bar being the obvious exception, yes. And judges know many a criminal appeal is a lemons-into-lemonade situation, especially when or...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I went to a CLE once featuring a panel discussion with the judges from the Court where I regularly practice. The question about the utility of oral argument was posed, and one of the judges said something like, “maybe you’ll convince us and maybe you won’t. But if you treat the argument as a speed ...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I've always thought that most appellate court argument is just theater. The judges usually have read the papers, have bench briefs from their clerks and know where they want to go. In my view it's rare to turn around an appellate judge who has made up her mind, and most have before oral argument. T...

IF Democrats also get the Senate. I'm pretty sure Bouie states that as part of what would be required. Exactly: court packing restructuring will require a sweeping election in 2020, and couldn't be implemented until 2021 at the earliest. So, as an immediate solution, it is a non-starter. As an elec...

Which, IIRC, is 90 days (with no fitness-tail). And Klayman inevitably will appeal the decision to SCOTUS. So it may be a while still.
