Happy Birthday fierceredpanda!

Thank you all for the kind messages. Mrs. FRP and I just finished dinner at home. Menu was a reverse-seared tomahawk steak topped with rosemary compound butter, roasted Brussels sprouts and potatoes, and a bottle of excellent Bordeaux. Now we’re hanging on the couch with the cats watching some shows...

Next: SCOTUS! Wouldn't it go to an en banc hearing in the 11th, then SCOTUS? No en banc cuz it’s a procedural issue. So I’ve been told. Correct. I’m on mobile so I can’t link, but Steve Vladek tweeted the section from the 11th Circuit’s local rules. Stays pending appeal (or denials of the...

Next: SCOTUS! Trump’s lawyers will file a petition, certainly. I do not believe there are four votes to take it up. The issues regarding government possession of classified materials are settled law, and no one other than a whackadoo district judge has any desire to overturn that particul...

In my :duel: circles, we have a saying: You fight what you practice, you practice what you drill . John's excellent post illustrates the various failure modes when you fail to follow that doctrine. Drills are bloodless battles, so that battles become bloody drills.... Flavius Josephus Once the kill...

Trump’s team isn’t going to get anywhere with the executive privilege argument in front of Dearie, and they likely know this. Dearie isn’t a complete partisan hack like Cannon, and so he is well aware that the privilege lies not with the former POTUS, but the current one. Not to mention the utterly ...

My feelings on Patel can be summed up thusly:

1) His eyes freak me out. They just do. Does he have Graves’ disease or something?
2) At this point I am more eager to see him indicted than Trump. Probably because then my profession will be rid of him.

It’s a series 2003 bill. Possibly the last time $2 bills were printed?

I’m sure the thinking by the grifters behind it is that no one who buys one is going to want to do anything other than frame it.

Putin apparently gave a speech in Vladivostok today where he said Russia has “lost nothing” in Ukraine. I imagine the families of the roughly 25,000 dead Russian soldiers would feel somewhat differently, but one gathers Vladimir Vladimirovich measures his gains and losses in rather a different curre...

I'm actually more inclined to believe the docs have to do with Iran's nuclear program. I have a few reasons for this: 1) Dates. The unredacted portions of some of the classified material in the photo the government filed with the SDFL showed White House letterhead and dates in the 2017 and 2018 rang...

How can the U.S. government NOT be issuing search warrants for every single residence of Trump's right now? You know damned well that is we don't remove any government documents as soon as possible, our enemies will have swooped in and stolen them! I can answer this. Because there's a fairly large ...

Yes, imperfect self-defense is a defense in that it reduces the severity of the crime from first-degree intentional homicide to second-degree. The instruction you linked to is the correct jury instruction. The statutory authority for that is found in the first-degree intentional homicide statute at ...

One of the questions in voir dire in the military (and I assume elsewhere, but can’t say for sure because I’ve never practiced law outside the military) is: “If you had to vote right now, would you vote to convict?” Any answer other than “No” would get you tossed from the jury. That question gets a...

I blame fundamentalist christianity in part: when preachers praise pure faith over reason, they lead their flocks down the dark path towards a bog of stupidity. Faith is sometimes defined as belief without evidence, but it can be worse than that. It is choosing to believe things that are not true, ...

The SBA sent a letter to its members about Mullins' resignation. Among other things, it reminded them that Mullins is entitled to a presumption of innocence. I nearly busted out laughing when I read that. As if Mullins has ever once considered that other people are entitled to such a presumption.
