Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

Not really a fan of either. JAG was one of those shows where they were so wrong on the law that it is painful to watch. When I was on active duty, during our obligatory ethics training there would always be snippets from the show. It was a veritable treasure trove of examples of unethical conduct c...

A second chance Twelve years ago, 47 dogs were rescued from Michael Vick’s dogfighting operation and allowed to live. They've enriched the lives of countless humans and altered the course of animal welfare. https://www.washingtonpost.com/graphics/2019/sports/michael-vick-dogfighting-dogs/?wpisrc=nl...

Mrs. V. Is in Manhattan meeting her sister for a Broadway show. She also took her good flute in for some adjustments. Just $450.00 worth. :? Trouble is there aren't many highly skilled flute artisans these days. They can charge high fees. :( I wasted my life going to college and being an engineer. ...

Not me. Most of our cases are losers. But in our system appeal is automatic, so you do what you can without crossing the line into frivolousness. I have to ask if you were a fan of JAG? I have been recording and watching reruns since WGN started airing the series in the afternoons. I had forgotten ...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I went to a CLE once featuring a panel discussion with the judges from the Court where I regularly practice. The question about the utility of oral argument was posed, and one of the judges said something like, “maybe you’ll convince us and maybe you won’t. But if you treat the argument as a speed ...

The Informant by Kurt Eichenwald. Non-fiction. About an FBI sting involving price-fixing at Archer Daniels Midland in the early 1990s. The story is just bizarre. Dude goes to the FBI to report price fixing, agrees to become a cooperating witness all wired up. And while he’s doing that, he embezzles...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I can tell how an appellate panel is going to decide no later than the first question. When it comes to SCOTUS most of us can tell when the Court grants cert. The art of appellate advocacy is overblown. The only place where argument is of any utility these days is closing argument to the jury. I do...

Re: UPDATE: Advice requested on brief language -- IAALs and IANALs welcome

I've always thought that most appellate court argument is just theater. The judges usually have read the papers, have bench briefs from their clerks and know where they want to go. In my view it's rare to turn around an appellate judge who has made up her mind, and most have before oral argument. T...

Congrats! Appellate argument is nerve-wracking even when you have the law and facts on your side. Because you just never know. As an advocate, all you can do is tell the Court what you think - you can’t make them agree with you. So it is such a relief when they do because there is always that little...

Re: TS/Hurricane Dorian -- Puerto Rico, Bahamas, Florida, Carolinas (Not Alabama, Donald.)

Wrong. Simply wrong. Trump warned of severe impact for Alabama. And he did so when the official forecast service predicted no possibility of damage. I mean anyone can read the tweet, he didn't single out Alabama for a "severe impact". He said the storm would hit harder than anticipated, which was a...

The Coast Guard’s presser is odd too, also... refers to them as “passengers” in the headline.
