Re: General Law and Lawsuits
A really tragic case. On the one hand, rape is a horrendous crime, and it would have been wonderful if Brooks had been convicted and spent life in prison. And if Lewis had stabbed and killed Brooks in self-defense... well played. On the other hand, we've pretty much universally decided as a society ...

In lighter news: I often peek at dismissed pro se lawsuits against the CIA. The CIA attracts some really interesting kooks. And so we have Ronald Satish Emrit v. CIA . Mr. Emrit's neatly-typed complaint makes the following request: The plaintiff is seeking declaratory relief according to Rule 57 of ...

And two more things: The fact that the PSTF is mortally wounded doesn't do too much damage to the rest of the Affordable Care Act, because those other agencies that don't have unfixable legal flaws can approve many of the same things. It's just slower. Both Congress and the President really should h...

Re: General Law and Lawsuits
Thanks for the analysis! In my mind, the base problem here is that our health insurance in the US is tied up with our employers. It shouldn’t be. Agreed. I should have also mentioned where the Appointments Clause came into this and invalidated a different decision to require coverage of 'PrEP drugs...

The judge ruled that claims backed by zero evidence must be honored if religious people believe them to be true. This is a Big Problem. I hate the outcome. But it's not something that this judge pulled out of a hat. In fact, under current federal law and Supreme Court precedent, I'd say that the ju...

US v. Larry Johnson
In which the Tenth Circuit painstakingly answers the hot question on everyone's minds: Do you legally "possess" a gun by sitting on it?

In view of all the circumstances here, a reasonable person would not believe that he or she was free to leave a house while an officer repeatedly fired at the front door. -- Mark and Sherrie Campbell v. Let me add a little more explanation to the earlier discussion. Spoiler: GEICO still isn't firmly on the hook here. Disclaimer: I am not a lawyer; this is not legal advice. Re: General Law and Lawsuits
Some good old-fashioned tax-denying silliness from the Fifth Circuit. As is so often the case, it involves a defendant who developed radical new views about the nature of income taxation, immediately after receiving a large sum of money subject to income taxation. US v. Thomas Selgas and John Green ...

It's been an extremely nasty strike, and that's an extremely one-sided article. The government says this is reimbursement for security guards, security cameras, repairs, and production lost because of the strike, plus buses for carrying scabs across picket lines. The payment is because of a settleme...

A case that manages to be both darkly funny and really interesting: US v. Anthony Oisoni Ozomaro. District Court docket (RECAP) Appellate court docket (PACER) Mr. Ozomaro was charged with meth-related crimes. He was in rather bad mental shape and had to undergo a psychological evaluation, but he was...

Another biased judicial rejection of GIL's fundamental rights! In the Klayman v. Porter et al case in the Southern District of Florida, Judge Singhal has dismissed the case due to claim splitting (in other words, "litigating the same damn thing again"). The present case involves both the s...

Kenneth Crawford Jr., a sovcit from the Third Circuit who helped people file fraudulent tax returns, will spend roughly 78 months in federal prison bemoaning the unfairness of it all. Crawford’s brief strains credulity and appears to endorse “sovereign citizen” arguments. [...] Appellant Br. 1–2 (“I...

Re: Rightwing Judges Behaving Badly
To me, the truly amazing thing is that the judge actually managed to f*** up so badly that she lost her absolute immunity. A quick summary of the two forms of federal-court immunity from civil suit that apply in this case: Judges get "absolute immunity". A judge cannot normally be sued for...

Re: Sovcit nutz
As with many sovcit cases, this one is deeply disturbing and yet still oddly funny. A child's father allegedly strangled his child. The child was placed in foster care. The child's mother then showed up at the foster family's house, along with a "lawyer" who presented sovcit-style document...

Don't forget that the USFL's $1 got tripled to $3. Victory!
I was told the story that an NFL attorney had presented a $5 bill to a USFL attorney. According to Wikipedia, this is false; there was actually a check for $3.76 (the seventy-six cents was interest).
