Laity lodged a revised formal complaint with the state’s Division of Election Law Enforcement regarding the New York State Board of Elections’s (NYSBOE) “misstating the criteria for being elected as President of the United States.”
The original December 30, 2023 complaint contained a clerical error which Laity corrected in this morning’s submission.
In his complaint, Laity referred to The Post & Email’s December 12 article, adding, “THIS INFORMATION IS BEING SIMULTANEOUSLY PROVIDED TO THE ATTORNEY GENERAL OF NY STATE AND THE DISTRICT ATTORNEY OF ALBANY AND ERIE COUNTIES, NY, ET AL.”
Some anonymous rando's and Rondeau's pestering flak catchers are newsworthy!Last month at least two other parties contacted New York State officials about the continued misrepresentation, with one sending a pointed email to the NYSBOE and the other, this writer, leaving a voice message with the office of Gov. Kathy Hochul.
Who, like everyone else, will give Laity's missives the attention they deserve ... in the roundfile.In the email containing the completed forms, Laity copied his congressman, Rep. Brian Higgins (D-NY26), who is not seeking re-election in November.

If one looks, for example, at New Hampshire’s Secretary of State website, that site correctly uses the term of art “Natural Born Citizen” while NY State continues to misstate the criteria as “Born a Citizen”. The NY State Board of Elections was told about this in 2008.

The NYSBOE’s recalcitrance in refusing to correct this flagrant error by continuing to misstate it 16 years later, leads me to conclude that they are deliberately doing so in gross derogation of NY State Election Law.

(Jan. 27, 2024) — On Friday, New York State citizen and registered voter Robert C. Laity received a response from the New York Attorney General’s Division of Criminal Justice, Public Integrity Bureau to his complaint that the New York State Board of Elections (NYSBOE) has been inaccurately expressing a criterion for presidential eligibility over 15 years or more. Since at least 2008, the U.S. Constitution’s Article II, Section 1, clause 5 requirement that the president be a “natural born Citizen” is inaccurately stated as “born a citizen” on the NYSBOE’s website. After contacting the Board on numerous occasions over the years, on January 2 Laity filed the complaint with the New York State Division of Election Law Enforcement, copying in the attorney general’s office and this writer.
Friday’s letter from Attorney General Letitia James’s office to Laity states that the Public Integrity Bureau’s “Constituent Services” division has “added the information to our files.”
“It is through complaints such as yours that we learn of patterns of fraud and illegality,” the letter continues.

The New York Board of Elections was formed by executive order in 1974, some 50 years ago. In 50 years of their publications on candidate qualifications, was there ever a published change for presidential qualifications from “natural born Citizen” to “born a Citizen”, or has it always been “born a Citizen” for said 50 years?

Great question Jon. I see that the NYBOE has made some website changes for 2024. It appears however that as of 1:45 am, EST, January 28, 2024 the website has NOT been revised to reflect the criteria for being elected President as being a “Natural Born Citizen”.
