The Indictment has fallen apart-I'd say "at the seams" - but it NEVER had any. There will be no trial. It's done, dusted & ready for a Motion To Dismiss on the law without contesting a single fact - not even plucking sounds can save it. I'll post a model MTD for public education.

This is really helpful. Leo, who doesn't really practice law and has never tried a case (that we know of), is going to teach all the real attorneys how to write a motion to dismiss. I bet the real attorneys totally appreciate that.

It must be pretty intoxicating, knowing that you can sit in your underpants and write brilliant, beautiful tweets, and thereby take control of important national events. He is a mover and a shaker, and I'm terribly humbled.

This is mostly wrong.

The questioner asked about taking an appeal while the trial court proceedings were continuing. A denial of a motion to dismiss is not a final order, so it normally isn't immediately appealable.

A trial court could grant leave to seek an immediate appeal. Most judges wouldn't grant that motion. But this one ... ?
