In addition to Jacob, the California bar counsel plans to call election officials from five states, including Benson and Stephen Richer, the county recorder of Maricopa County, Ariz. The bar authorities also plan to call at least two constitutional experts to cast doubt on the legitimacy of Eastman’s interpretation of the law and Constitution.

TBH, I'm genuinely surprised the California bar is going after Eastman's law license.

But the notice of charges states that Eastman could still be in trouble even if he could otherwise plausibly argue that his advice was provided in good faith. Eastman is charged with intentional misrepresentation under § 6106—for which a good-faith defense may be more straightforward. The bar, however, also argues that even if he is not found to have acted intentionally, he has still violated the statute by engaging in “grossly negligent conduct” when it comes to both his shoddy legal analysis and his “false and misleading” statements about election fraud. That said, when it comes to Eastman’s legal analysis, it could be hard for the bar to show that Eastman acted in good faith and that he was grossly negligent—unless the argument is that Eastman was so poor a lawyer that he couldn’t recognize the flaws in his argument.

Yeah; the judge excluded Joseph Fried and John Valentine during a pre-trial hearing, and wasn't inclined to reverse herself now.

Fried is an accountant who wrote a ebook doubting the 2020 election results; not relevant (and not an expert). Valentine was another "expert" who doubted the 2020 election results.

The judge is a UCLA law grad who had about 30 years of firm practice before joining the state-bar bench.

So Eastman is trying to get his garbage-in-garbage out "witnesses" allowed to testify after they were booted off pre-hearing.

Yabbut it supports his argument that he's so poor a lawyer that he couldn’t recognize the flaws in his argument. He can't accept a judge's ruling and he doesn't know what an expert is.
