Novak Djokovic’s Australian visa has again been cancelled just days before the start of the Australian Open.
On Friday, the Australian immigration minister, Alex Hawke, exercised a personal power to cancel Djokovic’s visa, likely to result in the world No 1’s deportation and putting him out of contention for the grand slam tournament barring an against-the-odds court victory.
The decision means that Djokovic could be effectively barred from re-entering Australia for three years unless he can show in future bids that compelling circumstances exist, such as compassionate or Australian national interest grounds.
Djokovic was not taken back into immigration detention, but will attend an interview with immigration officials on Saturday, after which he can choose to leave Australia or appeal the decision.
In a statement Hawke said he cancelled the visa “on health and good order grounds, [and] on the basis that it was in the public interest to do so”.
Guardian Australia understands the good order ground relates to the potential impact of Djokovic’s example to encourage other non-vaccinated people to arrive in Australia.
Hawke brushed off the Australian government’s loss in court on Monday, indicating Djokovic had his visa restored only on “procedural fairness grounds”.
Hawke said he had “carefully considered information provided” by Djokovic, his department, and the Australian Border Force.
Djokovic faced a nervous wait, with questions about his travel in the fortnight before arriving in Australia and attendance at events after his positive Covid diagnosis of 16 December. Der Spiegel also claimed anomalies suggested the positive result could have been negative or dated 26 December.
On Wednesday, Djokovic conceded his agent made an “administrative mistake” when declaring he had not travelled in the two weeks before his flight to Australia and acknowledged an “error of judgment” by not isolating after he tested positive for Covid.

I read somewhere yesterday that he said he had taken an antibody test in late December and that he had antibodies.
He had COVID in 2020, btw. I don't personally believe he had it this past December as he says he did.

Tennis star Novak Djokovic will be detained again by Australian authorities Saturday before his case to stay in country is heard before the Federal Court.
The decision was made during an emergency hearing before Judge Anthony Kelly in the Federal Circuit and Family Court on Friday, following Australian Immigration Minister Alex Hawke’s decision to cancel Djokovic’s visa for a second time.
The tennis star will be interviewed by the Australian Border Force at 8 a.m. Saturday local time (4 p.m. ET Friday) at an undisclosed location “agreed between the parties” in the case.
At that point, Djokovic will be officially detained by two border force officials and escorted to his lawyers’ office while his case is heard in the Federal court.
The location where Djokovic will be met by border officials will remain secret in order to keep the tennis star safe and prevent “a media circus.”
“We have a genuine concern about security and a potential media circus,” Djokovic’s barrister Nick Wood told the court when imploring Judge Kelly to allow Djokovic to be handed over to border officials in private.
Novak Djokovic v Minister for Immigration, as the case file is known, was officially transferred from the Federal Circuit Court to the Federal Court of Australia late Friday night local time.
Justice David O’Callaghan will now oversee the case, with an initial hearing scheduled at 10:15 a.m. Saturday local time (6:15 p.m. ET Friday).
Wood told the court that the Immigration Minister had used his personal power to cancel the 34-year-old’s visa based on grounds he would “excite anti-vax sentiment” should he remain in Australia, describing it as a “radically different approach” in the government’s argument.
“The underlying new rationale is not a direct risk to others, it’s that Mr Djokovic being in Australia, in Melbourne in particular, by being here will excite anti-vax sentiment. That’s the point. A radically different approach,” Wood said.

What began as a power struggle between a defiantly unvaccinated tennis star and a prime minister seeking a distraction from his own pre-election missteps has turned into something far weightier: a public stand for pandemic rules and the collective good.
And the sinner of the moment is Novak Djokovic.
Australia — a proud “sporting nation” where the year’s first tennis Grand Slam begins on Monday — hemmed and hawed about Mr. Djokovic for more than a week. Australians didn’t much like how their government had summarily canceled Mr. Djokovic’s visa at the airport. After all their lockdown obedience and vaccine drives, they were also unhappy about the celebrity athlete’s effort to glide into the country while skirting a Covid vaccination mandate.
“As Meryl Streep might say, it’s complicated,” said Peter FitzSimons, an author and former professional rugby player.
But then came a stretch of extraordinary revelations that all but erased any popular ambivalence. Mr. Djokovic admitted that he had not isolated himself last month while he apparently suspected, and later confirmed, a Covid infection. And he blamed his agent for a false statement on an immigration document that warned of harsh penalties for any errors.
With that, Australia’s leaders decided they had seen enough. On Friday, the country’s immigration minister canceled Mr. Djokovic’s visa for a second time, putting his bid to win a record 21st Grand Slam title in grave doubt. If Mr. Djokovic, the top-ranked men’s tennis player, does not successfully challenge the decision in court, he will be detained and deported before competing.

“You need to ask Novak Djokovic when he opened his inbox and checked the email. All I can say is that he has a valid document and that it was delivered to his inbox on that day, late in the evening. As for what he did after that, I cannot comment — that is a question for him,” Gojkovic said during a Friday government news briefing in Belgrade.
According to court filings, Djokovic took an official and approved PCR test on Dec. 16 — the results of which were generated after 8 p.m. on the same day, as outlined by the timestamp on the test certificate.
However, Djokovic claimed in a Jan. 12 statement that he did not receive notification of the positive PCR test result until the next day — after attending a tennis event, where he was photographed, without a mask, meeting with children.
A spokesperson for the Serbian prime minister echoed Gojkovic’s remarks, telling CNN after the news conference there is “no way in the world that he didn’t get the notification — no way in the world it could have been late by a day.”

“Proceedings will be fixed for a hearing Sunday 16th January 2022 at 9.30 a.m. Australian Eastern Standard Time (Saturday 5.30 p.m. ET),” Justice David O'Callaghan, who is now presiding over the case, said in open court Saturday.
The court will consider Saturday whether the case should be heard in front of one or three Federal Court judges.
Djokovic is expected to spend Saturday night in pre-immigration detention as his court case is ongoing.

YouTube took action against conservative commentator Dan Bongino’s channel Friday, suspending it for violating the platform’s COVID-19 misinformation policy and demonetizing it for at least 30 days.
The weeklong posting suspension stems from a video where Bongino said that masks are “useless” in stopping the spread of the disease.
YouTube’s COVID-19 policy specifically prohibits content denying the effectiveness of wearing masks, which the vast majority of the scientific community agrees reduces the risk of infection.
The video was Bongino’s first “strike” under the policy, resulting in a one-week suspension from posting.
