Caught On Video: Apple Store Melee Ends In Stabbing After Customer Refuses To Wear A Mask
Police have released new video of last week’s violent attack inside of an Apple store.

Investigators said an employee was stabbed trying to enforce the store’s mask policy, CBS2’s Thalia Perez reported.

It’s the establishment’s rule: No mask, no entry. But when a security guard at the Apple store on West 14th street in the Meatpacking District asked a customer to mask up, the customer smacked him and left the store, police said.

Surveillance video shows the suspect quickly return and then punch a female employee in the face before he launches an attack with a knife on the first security guard he encounters.

Police said the incident happened on Friday just before 6:30 p.m. The victim was rushed to Bellevue Hospital with stab wounds to his arm, three wounds to his back, and a slash wound on his forehead.

LAT: O.C. woman who refused to wear a mask found guilty of trespassing:
Marianne Campbell Smith’s defiance of anti-mask rules didn’t end at a Costa Mesa supermarket.

In an unusual move, Orange County prosecutors took her to trial.

On Wednesday, a jury found Smith, who is married to a sixth-generation heir of the Irvine development family, guilty of misdemeanor trespassing and obstructing a business or its customers.

After the verdict was read, Judge John Zitny sentenced Smith to a $200 fine, 40 hours of community service and a year of informal probation. Smith, who wore a plastic face shield in the courtroom, was also ordered to stay away from the market’s Costa Mesa location for a year.

Smith and a second woman, Jennifer Marie Sterling, walked to the checkout line. Employees refused to serve Smith, so she left $5 near the register, the footage shows.

A video posted on social media showed police leading Sterling — who wore a skirt with “Trump” written across it — and Smith out of the store through a crowd of protesters.

Sterling, 56, of Laguna Beach, was also charged in the incident and pleaded no contest to an infraction as part of a plea deal. She was ordered to make a $50 donation to a COVID response fund for nurses, according to Orange County Superior Court records.

Price said Wednesday that prosecutors offered Smith a deal where she would do community service without having to plead guilty to any crime. She declined.

Unvaccinated Oregon workers who had covid-19 argued they don’t need a vaccine. A judge denied their request.
An Oregon federal judge has denied an emergency motion brought by seven unvaccinated workers who sought to block the state’s vaccine mandate or create an exemption for people like themselves who already had the virus and argue they do not need to be vaccinated.

U.S. District Judge Ann Aiken wrote in her opinion Tuesday that the U.S. Constitution offers no fundamental right for someone to refuse a vaccination, adding that the shots are in Oregon’s best interest to help slow the spread of the virus. In her 26-page opinion, Aiken said that people’s safety was more important than whatever individual challenges unvaccinated workers might face by not getting immunized.

“Whatever hardships Plaintiffs face in choosing between accepting vaccination or leaving their employment are substantially outweighed by the interests and needs of the State of Oregon and her people,” Aiken wrote.

Aiken is the second federal judge in the state this week to block an emergency motion from unvaccinated workers attempting to avoid the immunization requirement put in place by Oregon Gov. Kate Brown (D). It is the sixth time that a federal or state court judge in Oregon has denied an effort to stop the vaccine mandate.

Like her colleague U.S. District Judge Michael H. Simon, who ruled in a separate case Monday, Aiken decided that the seven unvaccinated workers failed to show that they would suffer irreparable harm from the mandate.

“The benefits inherent in requiring all healthcare personnel, school staff, and state executive employees to be vaccinated are clear and obvious, both in terms of protecting the newly vaccinated workers themselves and, of at least equal importance, in protecting the people around them,” she wrote.

The judge’s opinion comes as thousands of state workers must be fully vaccinated under the mandate. Though the requirement went into effect Monday for about 5,000 workers, the deadline for most of the roughly 43,000 executive branch employees has been pushed back to Nov. 30 after negotiations with public employee unions, the Oregonian reported.

They filed a lawsuit last month arguing for the state to carve out an exception for them, and people like them, who have some degree of natural immunity after they were infected with the virus. Attorney Rebekah Millard wrote in the plaintiffs’ motion that the state forcing previously infected workers to get vaccinated violated their “privacy, bodily autonomy, and personal liberty.” The group contended that the governor’s mandate forced workers like them “who have robust natural immunity, to choose between their health, their personal autonomy, and their careers.”

While the employees argued that getting vaccinated “would involve more risks than benefits” and they were “exceedingly unlikely” to spread the virus to others, a study from the Centers for Disease Control and Prevention last month found that unvaccinated people who recovered from covid are more than twice as likely to catch the coronavirus again compared to fully vaccinated people who were previously infected.


Melissa Sutton, the medical director of respiratory viral pathogens for the Oregon Health Authority, supported the CDC’s findings in sworn testimony. Sutton wrote to Aiken that immunity after infection is “not as durable or reliable as the protection” provided by the vaccines. She added that the durability of such immunity varies widely between individuals compared to protection from immunization.

Though Millard argued this week that Oregon did not acknowledge “a fundamental right to bodily integrity,” the state’s attorney, Christina Beatty-Walters, pointed to the U.S. Supreme Court decision that community vaccination does not violate the Constitution.

“They hinge their whole case here on the existence of a fundamental right, but there isn’t support for the existence of such a right. In fact, all of the case law goes the other way and supports the state in this case,” she said to the Register-Guard. “Many, many courts … have concluded that there’s no fundamental right to refuse a vaccination required by state or local officials.”

In her opinion, Aiken noted that most of the seven workers who brought the lawsuit against the state either have already received an exception to the mandate or are awaiting a decision on an exemption request. Two did not apply for an exemption and one had theirs denied, Aiken wrote.
Plaintiffs wanted the state to create a new type of exemption for those previously infected by COVID. Of the seven plaintiffs, 5 have requested other types of exemptions. One of the 5 had their request denied. The other 4 are waiting for their employer to make a decision on their request.

A federal judge on Monday denied a last-minute bid by 42 state employees, healthcare providers and school staff to temporarily halt the state’s vaccination mandate.

“In the middle of a global pandemic while infections and hospitalizations continue at high rates, Plaintiffs are not likely to succeed in showing that their individual interests in remaining unvaccinated outweigh the State’s interest in public health and welfare,” the judge wrote in a 55-page opinion.

The judge found the plaintiffs failed to show they will be irreparably harmed by the vaccine mandate and noted that some of those suing the state already have been granted religious or medical exemptions.

While he said some state employees may face firing for failure to be vaccinated, he added that “it’s still only money” and they can get their job back or their pay reinstated if they prevail in the case at a later point.

“Plaintiffs allege the temporary harm to their jobs, income, and benefits. They do not allege discrimination, psychological or emotional harm, or other extraordinary circumstances,” the judge wrote.

Attorney Stephen J. Joncus, representing the plaintiffs, argued that they have a constitutional right “not to be coerced into taking experimental medication,” citing the 14th Amendment and the Nuremberg Code. He argued that the Food and Drug Administration hasn’t formally approved the Pfizer-BioNTech vaccine, but approved only the brand name Comirnaty.

The judge, though, cited findings from the Centers for Disease Control in concluding that the Pfizer vaccine vials and Comirnaty vials are physically and biologically identical.

“Plaintiffs here do not contend that they are being forced to be part of the clinical trials for the Pfizer-BioNTech Vaccine or that they are being forcibly injected while being physically held against their will,” the judge wrote.


“Instead, they argue a very different context—a challenge to a vaccine mandate issued in a public health emergency that orders a particular subset of Oregon workers to take an FDA-authorized vaccine at the risk of losing their employment. This simply is nowhere near the same as Nazi doctors performing experiments on victims held against their will in concentration camps, as was the subject of a portion of the Nuremberg Trials.’’

Further, Simon noted, the vaccine mandate offers state employees choices: either get the vaccine, apply for a religious or medical exception or find a job elsewhere, including out of state.

“Plaintiffs have not shown that the international community collectively condemns this type of choice as the type of coercion that falls within the prohibition of the Nuremberg Code, particularly during a global pandemic and when the vaccine is FDA-authorized,” Simon wrote.

Despite the development of three safe and effective vaccines, nearly 25% of eligible residents in the state remain unvaccinated, Oregon Senior Assistant Attorney General Christina L. Beatty-Walters wrote in a filing to the court. About 10% of state employees have filed for religious or medical exemptions, according to the state’s lawyers.

“The Governor and Oregon Health Authority have concluded that employee vaccination requirements are necessary to help the State end the pandemic in Oregon,” Beatty-Walters wrote.

Joncus claimed during a hearing Friday that COVID-19 is “like a bad flu season” and that the statistics on COVID-19 deaths are exaggerated, without providing any basis for his contention.

“Is that evidence in the record?” Simon asked during the hearing. “Where do I find that?”

Joncus further argued that Brown should make the drug ivermectin available to treat COVID-19,
though the Centers for Disease Control hasn’t authorized or approved that drug. Ivermectin is commonly used to treat infections caused by parasitic worms or head lice and skin conditions.

Attorney Marc Abrams, representing the governor, urged the court to follow “solid science” and not Joncus’ advocacy groups.

“There’s a certain irony in suggesting that the relabeling of a chemically identical substance makes it experimental,” Abrams said, while arguing that ivermectin, a medication for ringworm, be used to treat the coronavirus when the FDA has posted advisories specifically saying the public should not use it for COVID.

The plaintiffs’ arguments that the vaccines are dangerous or experimental, the state’s lawyers said, are not supported by the top medical and public health authorities in the nation.

“Increasing vaccinations means fewer hospitalizations, and fewer deaths,” Beatty-Walters said in court. “These vaccines actually do save lives. They prevent suffering, not just, for the vaccinated, but for everyone the vaccinated people come into contact with.”

Simon’s ruling doesn’t end the lawsuit over the mandate. It only allows the state’s enforcement of the vaccine mandates to continue as the case proceeds.

I was watching the local news tonight. Another Pittsburgh cop died yesterday from Covid, unvaxxed. They are supposed to be vaxxed, but, you know, freedumb. The officer being interviewed said they couldn't be forced to get the vaccine. Then he said something I have not heard before. Why should they get the shot? They haven't been given any bonuses for going into the homes of the sick in the last year and a half. :brickwallsmall:

Has anyone else heard this from police or other public officials who interact with the public?

There are a LOT of police and fire depts and ambulance services who are paying bonuses to their employees out of the federal covid funds. Even our backwards ass depts are doing it, and the county just voted the other day to pay bonuses to every County employee. If P'burgh isn't doing it, that's on the City because the money is available.

There are a LOT of police and fire depts and ambulance services who are paying bonuses to their employees out of the federal covid funds. Even our backwards ass depts are doing it, and the county just voted the other day to pay bonuses to every County employee. If P'burgh isn't doing it, that's on the City because the money is available.

The Pittsburgh police department doesn't have a vax mandate, but the Allegheny Sheriff's Dept does. Those with the Sheriff's Dept must be vaxed by December 1.

Sheriff Bill Mullen is quite serious about firing unvaxed officers. He points out that unvaxed officers risk not just their lives, but the lives of those they serve.
Across Allegheny County, public employees are fighting vaccine mandates but none as hard as those in law enforcement, which has suffered some of the highest losses from the disease.

The unions representing the county police and the corrections officers have gone to court to block the county’s order that all employees be vaccinated or be fired.

Sheriff Bill Mullen has decided for his deputies to either get vaccinated or be terminated.

“It’s a difficult decision but I believe strongly it’s the right decision in light of the fact that so many police officers throughout the country have died. There has to be something we can do to stop it,” he said.

Come Dec. 1, all county employees must show proof of vaccination or face firing. But late last week, the unions representing the county police and the corrections officers at the jail filed for injunctions, calling the vaccines experimental and unproven with unknown side effects and saying any mandatory order must be negotiated.

“The association argues the county is required to rescind the COVID-19 vaccination mandate unless and until it satisfies its collective bargaining obligation
…and cease and desist from engaging in such unlawful actions,” reads the lawsuit.

The Allegheny County Deputy Sheriff’s Association filed its own unfair labor practice last week, but Mullen says he’ll be holding firm.

“I know it’s a very difficult decision to fire somebody but we’re talking about people’s lives and maybe spreading it,” said Mullen.

Mullen says all of those unvaccinated employees deal directly with at-risk populations and the rest of the general public, posing a danger to themselves and others. He says firing those who will not get vaccinated is no idle threat.

Mullen: “Unfortunately, yes.”

Thanks. I know that stuff had been going on, but I wasn't following closely. I seem to have soured over most news lately. I saw part of that again and saw that they were talking about the Fraternal Order of Police, which is city, I think.

I filled out my ballot today and voted for Sheriff Mullen (not that there was an alternative). I've had no argument with him.

Florida’s top public health official was asked to leave a state Senator’s office this week after refusing to don a mask in her office.

Sen. Tina Polsky, who was diagnosed with stage 1 breast cancer in August, asked state Surgeon General Joseph Ladapo and his two legislative aides to leave her office after Ladapo refused to comply with her request to put on a mask.

“I told him I had a serious medical condition,” said Polsky, who will begin radiation therapy treatment for cancer next week.

Polsky said that Ladapo had requested to meet with her in Tallahassee this week; he was making the rounds visiting several Senators who will be asked in the upcoming Session to confirm him.

“So our first court case happened and the judge who was appointed by Obama was already against it from the start. He tried to bully our lawyer but he kept his composure and pled his case. At the end our lawyer amended it and the judge freaked and said he can’t and he gives that permission and our lawyer said no sorry you’re wrong which he was. The judge said what do you want to do throw the kitchen sink at this!? You want to sue Pfizer while your at it!? The funny thing was our lawyer said yes sir actually we added Pfizer and the FDA to the amendment. Haaaa! We’re suing Pfizer and FDA now. Pfizer for lying about aborted fetuses that a whistleblower revealed which has religious exemption issues and FDA for having a so called approved vaccine but still using EUA vaccines. EUA is only authorized as long as there’s no approved treatment. It’s gonna get interesting.
