The Galveston County Daily News reports the emus escaped their new owner's backyard sometime Monday. Police recaptured the birds near an elementary school Tuesday morning.

I assume it falls under their ban on wild and exotic animals. On a related note, you cannot allow your poultry to run wild on sidewalks, streets, or public places. It doesn't mention Emus running wild.
