North Carolina Elections Board Dissolves, Adding New Chaos in House Race

Dec. 28, 2018

The North Carolina state elections board dissolved on Friday under a court order, two weeks before its much-anticipated hearing to consider evidence of possible absentee ballot fraud in the disputed November election for the Ninth District’s seat in Congress.

The unwinding of the State Board of Elections and Ethics Enforcement was a consequence of a long-running battle over partisan power in North Carolina and separate from the election fraud investigation. Yet the dissolution heightened the possibility that the Ninth District seat would remain empty for weeks or even months, and it plunged the chaotic fight for the House seat into deeper turmoil.

“We have entered no man’s land,” said J. Michael Bitzer, a professor of politics and history at Catawba College in Salisbury, N.C. “It is symptomatic of the bigger partisan polarization that we are living in and experiencing hour by hour in this state.”

Hoyer says House will not seat a North Carolina Republican amid questions about integrity of election
Incoming House Majority Leader Steny H. Hoyer said Friday that Democrats next week will not seat a North Carolina Republican amid allegations of election fraud in the state’s 9th Congressional District.

“Given the now well-documented election fraud that took place in NC-09, Democrats would object to any attempt by [Mark] Harris to be seated on January 3,” Hoyer said in a statement to The Washington Post. “In this instance, the integrity of our democratic process outweighs concerns about the seat being vacant at the start of the new Congress.”

The statement came after North Carolina dissolved its elections board Friday without certifying the results of the election, leaving the fate of the seat in doubt days ahead of the start of the new Congress.

Dallas Woodhouse, executive director of the North Carolina Republican Party, told CNN on Friday that the elections board “failed in their duty” to certify Harris and suggested that the state GOP may take legal action.

CHARLOTTE, N.C. - After Republican 9th Congressional District candidate Mark Harris finished addressing Mecklenburg County Republicans at the Charlotte Mecklenburg Government Center Monday night, reporters, including Eyewitness News reporter Joe Bruno, tried to ask him questions.

Harris and a group of three or four other people used a fire exit to leave the Government Center as reporters attempted to ask questions. After Harris opened the door on the ground level, an alarm sounded.

An unidentified man tried to block reporters from using the fire escape to follow Harris. When questioned if he worked for the city, the man allowed reporters to pursue the politician.

Reporters continued to volley questions at Harris after he exited through the fire escape, but he sprinted across East 3rd Street and into the parking lot of the First Baptist Church of Charlotte, where he used to be a pastor.

North Carolina judge declines to certify 9th District congressional race as fraud investigation continues

A state judge in North Carolina has declined to certify election results in the 9th Congressional District, citing state election officials’ authority to delay certification while they continue to investigate allegations of election fraud.

In a court hearing in Raleigh on Tuesday, Wake County Superior Court Judge Paul Ridgeway ruled against Republican Mark Harris, who leads Democrat Dan McCready by 905 votes in unofficial results from the Nov. 6 election.

The State Board of Elections voted not to certify the results after accusations of election fraud surfaced in the 9th District, a rural swath of farm land and small towns that stretches from Charlotte to Fayetteville along the South Carolina border.

A lawyer for Harris argued that the state board has not presented evidence that the fraud was widespread enough to affect the outcome. Harris has said the investigation should continue but argued that he should be seated in the meantime.

Lawyers for the state board and for McCready argued that enough ballots are under review to call the margin into question. Marc Elias, a Washington-based election law attorney who represents Democratic political committees and candidates, argued for McCready that there is nothing in North Carolina law that requires the investigation to be completed by a certain date.

During a public hearing of the North Carolina Board of Elections, witness Lisa Britt testified that Dowless gave her a written note instructing her to invoke the Fifth Amendment when asked about her work for his alleged ballot-harvesting scheme.

“I can tell you I’ve never done anything wrong in the election, and McCrae Dowless has never told me to do anything wrong,” read the suggested testimony given to Britt, as posted by Huffington Post reporter Sam Levine. “But I am taking the 5th Amendment because I don’t have an attorney and I feel like you will try to trip me up.”

Levine also reports that Britt told the board that she believes that she did do something wrong under Dowless’ instructions, although she insists that candidate Mark Harris, whose campaign benefited from the scheme, was completely unaware of what was happening.

I've been following the hearing pretty closely these past few days. WOW! The evidence is damning for McCrea Dowless and, imo, Mark Harris.

John Harris' testimony contradicted his father's denials quite blatantly. At 9pm last night, Mark Harris finally submitted evidence that had been subpoenaed. Just an oversight, I'm sure. :roll:

Mark Harris stated that he had several strokes during his recent hospitalization. That should help his campaign, should he run again.
