Lawyer for Biden accuser Tara Reade drops her as a client
The attorney working with Tara Reade, the former Joe Biden Senate staffer who alleged he sexually assaulted her in the 1990s, said Friday he is no longer representing her, just two weeks after he first began working with her.

Douglas Wigdor said in a statement the decision to drop Reade came on Wednesday of this week, and that it wasn’t a reflection on the veracity of her claims. But he offered no specifics on why he and his firm are dropping her.

Wigdor said he and others at his firm still believe Reade’s allegation against Biden, that he digitally penetrated her and groped her in the basement of a Capitol Hill office building when she worked as a low-level staffer in his Senate office in the Spring of 1993. Biden has vehemently denied her claims, and multiple current and former Biden staffers have said they have no recollection of such an incident.

As her lawyer quits, Biden accuser Tara Reade’s credibility is challenged by lawyers whose clients she testified against as an expert witness

Several California defense attorneys said Friday that they would attempt to overturn criminal convictions that relied upon testimony from Tara Reade, the former Senate aide who accused Joe Biden of sexually assaulting her in 1993, because she may have provided false information under oath. During testimony in Monterey County court cases in which she was called as an expert on domestic violence, Reade said that she had received a bachelor's degree from Antioch University, had never taken the bar exam after graduating from law school and had been a legislative assistant in Biden’s office. Those claims have since been documented as false or been called into doubt in stories published since she made her accusation against Biden. Roland Soltesz and law partner William V. Pernik said they will seek to overturn the conviction of their client, who they have not yet been able to contact as she serves a life sentence in prison after being convicted of arson in a trial in which Reade testified as a witness. “I am going to subpoena every one of her academic records, so this thing is coming to court one way or another,” Soltesz said.

The review of the cases, which was first reported by the Monterey County Weekly, came as the attorney who had been representing Reade in her claim against Biden said Friday that his firm decided to no longer work with her as a client. Douglas Wigdor had represented several other plaintiffs during the #MeToo era, including victims who said they were harassed by Fox News host Bill O’Reilly and film producer Harvey Weinstein. “Our firm no longer represents Tara Reade,” Wigdor said in a statement Friday morning. He said that the decision was made Wednesday and that it “is by no means a reflection on whether then-Senator Biden sexually assaulted Ms. Reade.” Biden has vehemently denied the claims made by Reade, who worked for him for eight months as a staff assistant in his Senate office.

In the statement, Wigdor continued to defend Reade and did not offer an explanation for why his firm decided to stop representing her. Reade did not respond to a request for comment. Wigdor, who has donated to President Trump but said his own political affiliation did not impact the cases he pursued, declined to comment beyond the statement. His firm has been representing her pro bono for two weeks. “We also believe that to a large extent Ms. Reade has been subjected to a double standard in terms of the media coverage she has received,” he said. “Much of what has been written about Ms. Reade is not probative of whether then-Senator Biden sexually assaulted her, but rather is intended to victim-shame and attack her credibility on unrelated and irrelevant matters. We genuinely wish Ms. Reade well and hope that she, as a survivor, is treated fairly. We have and will continue to represent survivors regardless of their alleged predator’s status or politics.”

It was during Reade’s expert testimony that she made the comments that have now triggered an attempt to review past cases. While Reade told the court she had worked as a legislative assistant to Biden, she actually held the job of staff assistant, a more junior role, according to Senate records. And while her résumé, shared with the defense by the district attorney before she appeared in court, said she worked in Biden’s office from 1991 to 1994, records show she was there only eight months, from Dec. 2, 1992, until Aug. 6, 1993. A spokeswoman for Antioch University said that, contrary to Reade’s claim, she did not graduate from the school, as first reported by CNN. The spokeswoman also said that Reade never worked as an “online visiting professor,” as she claimed on the résumé shared as part of the court proceedings. In testimony that she gave in December 2018, she was asked if she was licensed to practice law in California, and she responded that she had not taken the bar exam. But Reade herself published a blog in 2012 documenting her third attempt to pass the California bar exam. The blog was titled “California Bar Exam: Three Times A Charm.” A spokesman from the Seattle University School of Law confirmed that Reade — whose legal name at the time was Alexandra T. McCabe — graduated with a JD degree in 2004. The university, citing federal privacy regulations, would not share more about her educational background. Current admission requirements indicate any law school students must have an undergraduate degree.

Reade said in December 2018 that she had testified more than 20 times, as an expert witness on domestic violence issues (although the next month, in a separate case, she testified the number was “at least 10”). She had earlier supplied The Post with a letter of recommendation written in 2010 by Elaine McCleaf, the deputy district attorney for Monterey County, who called her “a dedicated advocate for women’s rights in Monterey County for many years. She has donated her time to appear in court to educate juries on the dynamics of domestic violence on numerous occasions,” she wrote. “Many Superior Court Judges have determined that Alexandra is an expert in the field of domestic violence based on her education, training, and experience.” Pernik, the attorney now seeking an appellate review of Reade’s testimony, said she could find herself legally culpable for her statements. “She is just such a good liar and manipulator she convinced people,” Pernik said. “They kept bringing her in because she is really good with juries.”

Donald Trump’s reelection campaign is launching a $1 million digital ad blitz aimed at capitalizing on Joe Biden’s inflammatory remark that African American voters “ain’t black” if they’re considering voting for the president. The Trump campaign is planning to run a video montage highlighting Biden’s Friday morning comment on “The Breakfast Club,” a popular black radio program. It will also air an ad focusing on Biden’s support for the 1994 crime bill which, the spot says, resulted in mass incarceration and “destroyed millions of black lives.”

Biden set off a firestorm Friday morning when he told the program’s co-host, Charlamagne tha God, that “if you have a problem figuring out whether you’re for me or Trump, then you ain’t black.” The former vice president later apologized during a call with black community leaders, saying that “perhaps I was much too cavalier. I know that the comments have come off like I was taking the African American vote for granted. But nothing could be further for the truth. I've never ever done that and I've earned it every time I've run,” he added.

The Trump reelection effort immediately moved to take advantage of Biden’s remark. The campaign hosted a press call with adviser Katrina Pierson and South Carolina Sen. Tim Scott, began selling a “#YouAintBlack” t-shirt, and launched a website highlighting Biden’s comments. Late Friday, the campaign started its advertising blitz. The “You ain’t black” montage is slated to run nationally, while the spot focused on the crime bill will air in swing states. The ads will appear on an array of platforms, including Instagram, Facebook, and Google.

The Trump campaign has been aggressively courting black voters for months. The president received just 8 percent of the black vote in 2016, though his advisers contend that even a small uptick in African American support could be enough to tilt the balance in swing states. The reelection effort has run ads in black community newspapers and signed leases to open up retail stores in African American neighborhoods.

Agree with Stern but it was at the end of the interview and he was making the point not about being black, but being stupid and voting for IMPOTUS. The GOP is so desperate they'll jump on anything to deflect. It's Memorial Day weekend, it's going nowhere. And on the Crime Bill, it was supported by the Congressional Black Caucus at the time (more on that later).

From a IANAL stance but, as I recall, he doing it pro-bono. And Reade's situation just got a whole lot more complicated. She gave 'expert' testimony supported by alleged false credentials ... expert testimony that juries relied upon, in-part, for returning guilty verdicts on defendants. Really messy.

That's perjury -- pretty much the worst offense you can commit upon the court while under oath.

California DA launches investigation into Tara Reade testimony
‘We are investigating whether Ms. McCabe gave false testimony under oath,’ said a Monterey County prosecutor.

The Monterey County District Attorney’s office has launched an investigation into whether Tara Reade lied on the witness stand while acting as an expert witness. Reade, under the name Alexandra McCabe, for years testified as an expert in domestic violence cases for the California D.A.’s office. Among the issues is whether she lied about her credentials to qualify as an expert. “We are investigating whether Ms. McCabe gave false testimony under oath,” Monterey County chief assistant district attorney Berkley Brannon told POLITICO Tuesday.

Brannon said the office does not yet know how many cases in which Reade testified as an expert. “We have no database or search engine to use to determine in how many cases she testified,” Brannon said. “However, that effort is ongoing.” Reade in March accused Joe Biden of sexual assaulting her in 1993 when she worked as an aide in his Senate office. Biden has denied the accusation. Recent news reports have raised questions about Reade’s testimony under oath, including whether she falsely claimed to have completed her bachelor’s degree, whether she gave false testimony about taking the bar exam and if she exaggerated her job duties in Biden’s office.

Last week, the school which she testified to having completed a bachelor’s degree, Antioch University in Seattle, confirmed to POLITICO that Reade only attended for three academic quarters and did not graduate. The university also denied an account from Reade that she had a special arrangement with a former chancellor to credit her with an undergraduate degree under a different name. Seattle University Law School confirmed that Reade, under the name Alexandra McCabe, did graduate from law school. But officials wouldn’t comment on whether she had a valid undergraduate degree, which is required under the law school’s current admission standards. Defense lawyers are calling on the Monterey prosecutor’s office to subpoena Reade’s academic records and also determine if other aspects of her credentials are credible. “It’s my opinion that the district attorney has an obligation to find out that information and turn it over to us,” said Roland Soltesz, a defense lawyer who questioned Reade in the attempted murder trial of Jennifer Vasquez and Victoria Ramirez. However, Soltesz said the defense would also launch its own investigation. “We’re going to try to subpoena records and use every avenue available to us.”

Brannon said he would not discuss the details of its investigation — including whether the office has issued subpoenas — until the probe had concluded. According to her testimony in two felony cases reviewed by POLITICO, including the Vasquez-Ramirez case, Reade stated she earned an undergraduate degree at Antioch University. She also testified on the witness stand in December 2018 that “I have not taken the bar exam.” That answer came in response to a question asking whether she was a licensed attorney in the state of California, according to an official court transcript of the proceeding. However, an archived 2012 account from her personal blog, which was taken down from the Internet, alludes to two prior attempts: “taking the California bar exam a third time...hoping I can charm it and pass!” Reade’s attorney, Douglas Wigdor, announced Friday he was no longer representing her. Reade could not immediately be reached for comment. Soltesz said if false, that testimony would have undermined her role as an expert witness.

“She testified under oath that she never took the bar exam. She’s got a personal blog out there saying she failed the bar twice. Maybe she made that up,” Soltesz said. “She didn’t want to tell the truth that she didn’t pass the bar because that would diminish her credibility as an expert.” Patrick McKenna, executive director of the Sixth District Appellate Program, a publicly funded law firm that handles appeals for indigent clients, told POLITICO last week his office was doing its own review of cases where Reade testified as an expert, determining whether defense attorneys could challenge their clients’ convictions. “The significance for me is she was qualified as an expert based partially on her educational background as well as her career,” McKenna said. “If those things were not true, then she may not have qualified as an expert or had the defense attorneys known about these things, they could have asked her about these things in court. It would go directly toward her credibility.”

I still don't understand why no defense lawyer picked up the phone to verify her credentials! Universities, before the #TrumpPlague, will tell you if a particular individual has been awarded a degree by the University. If I had called and Antioch didn't have a working number! or refused to disclose that information, I would have challenged her ability to testify. Lawyers do this routinely.
