US District Judge Carl Nichols in Washington on Wednesday granted Dominion’s motion to dismiss the suit, saying Powell hadn’t alleged anything concrete to back up her claims. Nichols also noted that defamation suits “by design” are intended to silence people from making false, harmful statements.

Sidney Powell’s nonprofit raised $16 million as she spread election falsehoods

A nonprofit group run by pro-Trump lawyer Sidney Powell raised $16.4 million in the year following the 2020 election and spent less than half that money, according to the group’s tax filings.

Defending the Republic, whose mission is to use the courts to “protect election integrity” and individual freedoms, reported that it spent about $8 million in the 12-month period ending Nov. 30, 2021. That sum included more than $3.8 million for legal services and another $2 million for “other” services, including litigation support. It said those services were provided by “nonemployees” it did not name.

The new documents show that spreading election falsehoods is “incredibly lucrative,” said Brendan Fischer, deputy executive director of the watchdog organization Documented, which scrutinizes the activities of nonprofits and corporations and also obtained the tax filings. But the filings, the organization’s Form 990 and related attachments submitted to the Internal Revenue Service, reveal “almost nothing about where the nonprofit’s millions in reported legal expenses are flowing,” he said.

In a letter on Monday, over a dozen election experts told members of the DOJ that attorneys for Trump may have taken actions that "constitute federal crimes and be relevant to investigations into efforts to overturn the 2020 presidential election."

"Specifically, we are writing regarding the multi-state plan, directed and funded by attorneys for Donald Trump—including Sidney Powell, Lin Wood, and Jesse Binnall—to access voting systems and obtain and distribute copies of voting system software unlawfully," the letter said.

The group of experts included attorney Ron Fein of Free Speech For People.

The Atlanta Journal-Constitution noted that someone working for Powell was caught on surveillance video copying a trove of election data in Coffee County, Georgia, on Jan. 7, 2021.

She also promoted false conspiracy theories of widespread election fraud, including that voting machine software had flipped votes for Trump to Biden and had its origins in election-rigging efforts in Venezuela.

The Texas Commission for Lawyer Discipline filed a case against Powell last March in state district court in Dallas County, accusing her of professional misconduct. Bar regulators won an earlier round, with Judge Andrea Bouressa denying Powell’s motion to dismiss the case last summer.

But in a four-page order entered on Wednesday, Bouressa, a Republican appointee of Texas Governor Greg Abbott, found that the commission failed to meet its burden on several claims it had lodged against Powell because of apparent issues with how it presented evidence and simply failed to respond to Powell’s challenges to others.

The judge identified “numerous defects” with the commission’s court filings, noting that exhibits were mislabeled or not cited in its briefs. She wrote that she “alerted the parties to difficulty locating materials cited in the Commission’s brief, but the Commission responded that no corrective action was necessary.”

Bouressa wrote that because of these problems, she considered just two exhibits the commission had presented — copies of court documents from a post-election case that Powell filed in Georgia.

Bouressa agreed with Powell that the remaining evidence wasn’t enough for the commission to meet its burden in the case, and fully granted Powell’s motion for summary judgment. The commission could now appeal the ruling.

“The judge allowed the Bar full discovery, all the depositions it wanted; we produced over 55,000 pages of documents, emails, and a huge privilege log,” Powell wrote in a statement. “The judge applied well-settled law and held the Bar had no evidence as a matter of law that I committed any ethical violation.”

Sidney Powell’s efforts on behalf of Donald Trump didn’t fare well after the former president’s 2020 defeat, and a Reuters report suggests the attorney is still suffering related setbacks.

A federal appeals court on Friday upheld the bulk of sanctions imposed against Sidney Powell and other lawyers who sued to overturn President Joe Biden’s 2020 victory in Michigan. The 6th Circuit U.S. Court of Appeals found that the allegations of electoral fraud Powell and others had pushed were baseless, frivolous or even refuted by their own filings.

In case anyone needs a refresher, let’s revisit our earlier coverage and review how we arrived at this point.

It’s no secret that in the wake of Trump’s loss, conspiracy-minded lawyers filed misguided lawsuits, hoping to help the former president. It’s also no secret that those cases failed spectacularly.

What’s less appreciated is the fact that the demise of those cases was not the final word on the subject. In Michigan, for example, Democratic Gov. Gretchen Whitmer’s administration and the city of Detroit sought penalties against several attorneys — including prominent Trump allies Powell and L. Lin Wood — who filed an outlandish anti-election case. In 2021, a federal judge agreed and sanctioned the conspiratorial lawyers.

U.S. District Judge Linda Parker concluded, “[D]espite the haze of confusion, commotion and chaos counsel intentionally attempted to create by filing this lawsuit, one thing is perfectly clear: Plaintiffs’ attorneys have scorned their oath, flouted the rules and attempted to undermine the integrity of the judiciary along the way. As such, the court is duty-bound to grant the motions for sanctions.”

Not surprisingly, that ruling was appealed, but late last week, the 6th Circuit agreed that conspiratorial allegations were baseless, and while the sanctions were partially rolled back, they remained largely intact.
