All the “butter emails” folks need to be reminded that TFG was President for four years, had two Attorneys General who both declined to prosecute Hillary Clinton. They should just STFU. If Trump and his AGs really believed she’s a criminal they had ample time to investigate and prosecute. I think Sessions even said at one point there is no evidence she committed any crime. And that is why he’s not “locking her up “.

After
@OMAROSA
publicly defeated the Trump Campaign and substantial attorneys fees were awarded and the Campaign's NDA was held unenforceable, the Campaign has officially given up and is releasing everyone from the NDA. Kudos to AJ, Jessica and all who faught these NDAs.

A friend had the perfect come back for those Hillary comments, “Yeah, too bad you Republicans are too stupid to catch her.”

Worked every time.

At least last night, CNN was trying very hard not to use this word that the Rs have been slinging around.

It seems like this was authorized by a local judge and a particular FBI office without buy-in or notification of higher levels of government.
Why would Andrew Yang know anything at all about this?

Biden has been having a great week, while Trump has been having the week from hell - and it’s only Tuesday! I love it.

As this point, it would just be fitting that Trump either gets Covid, has a heart attack, or suffers a stroke. Hey… maybe all three considering the week he’s having!

He doesn't.

Yang does have a law degree, but even Ivy League schools don't teach the politics behind high-stakes criminal investigations.

Which is why Yang is being roasted for his combination of arrogance and ignorance.

So: perfect candidate material for the Republican Forward Party.

McConnell issues his first statement since Trump’s place was searched. He sounds upset by it.

I just found out that Peter Strozk confirmed that the DOJ, under Obama, issued multiple search warrants for Hillary Clinton materials during their investigation. The difference is she didn’t boo boo on Twitter snd attempt to fund raise from it. So that’s an even better comeback.

Enquiring minds want to know who TFG is going to have as his criminal lawyer.

Nathaniel Carr?
Herman Alcantar?
Refik Eler?

Perhaps this will be Orly's big comeback?!

Maybenaut wrote: Mon Aug 08, 2022 7:57 pmWe have magistrates in the military, but they just amended the UCMJ to allow an actual judge to sign off on a search authorization in certain cases. As I understand it, the concern was that they wanted to be able to bring it to a *real* judge. I didn't know if that was also a thing in the federal system.
"For completeness," Fed. R. Crim. P.* 41 specifies that a warrant application should go to a magistrate judge.

But federal courts routinely have ruled that Article III judges are also covered (and therefore also empowered) by Rule 41. Among the reasons is that "magistrate judges" did not exist until the 20th century; their 18th-century analogs were called commissioners.

So this EPSTEIN-OBAMA MAGISTRATE!!! chatter could be wrong. Especially considering DJTJ has direct access to someone with a copy of the warrant. Someone who is "curiously" not publishing it. (Like his tax records, school records, etc.)

However, the NY Post  reports its unnamed sources say Reinhart approved the warrant.

* The rules are drafted under the authority of SCOTUS, as granted to it by Congress. So it would be quite a stretch to suggest SCOTUS intended to deprive the federal bench of its authority to issue search warrants.

With the irony that only now is McCarthy concerned with proper document preservation policies.

The folks as MAL had to be asked to put a padlock on the room where the documents were stored. Just think of all the employees, contractors, and members who could have gotten their hands on the information contained in those documents. I do think this goes far higher than just regular presidential records, it definitely involves classified material. Peter Strozk mentioned on CNN that there is no such thing as just submitting a subpoena in these cases where the target documents are classified. It's always done as a search warrant. So, that was interesting. It explains why they didn't just try to issue a subpoena for these documents, that would tip off people even beyond the person who has the documents that there might be juicy goodness worth stealing from a certain location. But back to imagining how many, and what kind, of people wander the halls of MAL and could have come into contact with these documents. People who could sell them for a good price. Not that I think it's beyond Trump himself to do such a thing.

jemcanada2 wrote: Tue Aug 09, 2022 8:42 am I haz questions. Does the declassification of documents belong to the office, not the person, like executive privilege does? If tfg didn’t actually declassify the purloined documents, does the choice to declassify them now belong to Biden or tfg?

This seems to be the Trumpers’ argument. Trump could declassify the documents at any time so no biggie.
It belongs to the office. He can't declassify anything after he's no longer in office.

ETA: But lets say for the sake of argument he declassified them on his last day, and forgot to update the stamps  . He's still not allowed to put them all in boxes and put them on a plane to Florida when he left. The records are not his personal property.

Another sticky little problem if something is actually a real secret but he says "I declassified them". Since they're not classified, they should be available for a FOIA request. So if he says he declassified them I want to read them in WaPo next week.
