Eli Honig was on CNN today and discussed Blanche (I think that was the one). Said he's worked with him when they were both federal prosecutors, as has Bragg. Said he was the real deal lawyer and not one of those TV klowns tfg usually drags out.

Oh and HAPPY ARRAIGNMENT EVE everyone!!!!

Former President Donald Trump’s expected court appearance in New York on Tuesday has led to a modest outburst of online threats featuring calls for violence but US officials say the chatter has been disorganized, sporadic and lacks the coherent planning that defined the lead-up to the January 6, 2021, attack on the US Capitol.

Any signs of a spike in violent rhetoric or evolving potential threats are filtered through federal channels at the Department of Homeland Security and FBI, which are in regular contact with the New York Police Department as it makes security preparations for Trump’s arraignment in a Manhattan courthouse, a senior US official familiar with the planning told CNN.

“We’re definitely not ruling anything out and staying vigilant,” the official told CNN. “But we don’t see any active specific, credible plotting.”

Still, current and former US national security and law enforcement officials interviewed by CNN are wary that far-right extremists are now more likely to use encrypted communications to plan their next move, rather than public message boards. These officials don’t want to make the mistake of underestimating the potential for political violence, as critics accused federal and state and local law enforcement of doing prior to January 6.

“The really sophisticated actors wouldn’t likely be talking in public forums anyway,” the senior official said.

Trump initially called for protests when he first posted about his potential arrest two weeks ago, but he hasn’t called specifically for supporters to come to New York on Tuesday since it was confirmed that he would be indicted.

The New York Young Republican Club is organizing a demonstration near the court on Tuesday. A previous protest by the group in the area was poorly attended. Rep. Marjorie Taylor Greene, a Georgia Republican, says she will attend the protest and is calling on her supporters to join.

I've seen this asked in a few other places, but how are they bypassing the statue of limitations on the hush money? Is it still within? Is it things that evolved from around the paying of the money?

I was curious, because IAVMNAL (I am very much not a lawyer).

I'm not a lawyer either, but as I understand it, if the (misdemeanor) crime of paying the hush money was in service of another (felony) crime, the statute of limitations is five years -- which would be up, but the statute of limitations was tolled (term of art, I'm sure one of the lawyers on the site could explain it better than I) for all (felony?) crimes in NY because of COVID. Because of all of the moving parts in this, we're not going to understand exactly what is going on until the indictments are unsealed.

IANAL either, but I have read that it's not just tolled because of COVID. In New York, I believe that any time not present in the state isn't counted toward the 5 year clock. Put another way, for every X number of days the defendent is out of state, X number of days are added to the end of the 5 year SOL.

So since tfg was mostly in either D.C. or Florida from January 2017-present, almost no time was applied toward the 5 year SOL, and that doesn't even include COVID.

I suspect that it's not just "34 class E felonies, the lowest level of felonies." I suspect that there is more. The E felonies are just the start. (Hey, I can dream, can't I?)

PROSECUTOR ARRIVES

Manhattan District Attorney Alvin Bragg arrived at court Tuesday morning in New York ahead of former President Donald Trump’s arraignment.

Bragg became Manhattan’s first Black district attorney in 2022, following his election the previous November. He inherited a yearslong grand jury investigation into hush money paid on Trump’s behalf during his 2016 presidential campaign.

After taking office, Bragg slowed his office’s move toward an indictment of Trump and said he had concerns about the strength of the case. That sparked a public protest by two prosecutors who were leading the investigation and resigned.

But Bragg convened a new grand jury this year after convicting Trump’s family company for tax fraud. He called that result a “strong demarcation line” for proceeding with other parts of the probe.

TRUMP ATTORNEY: ‘NO GUILTY PLEA’

Trump attorney Joe Tacopina said the former president’s appearance in court for Tuesday’s arraignment would be brief because the processing “does not take long.”

“It won’t be a long day in court,” he said on ABC’s “Good Morning America.”

“We know the basis of the indictment and the factual allegations in the indictment,” Tacopina said, adding Trump would maintain his innocence.

“One thing I can assure you as I sit here today, there’ll be no guilty plea in this case. That’s one thing I can guarantee you,” he said.

Tacopina appeared to predict the case would ultimately be dismissed.

“I don’t think this case is going to see a juror,” he said. “I think there’s a legal challenge that will be made and should be made successfully.”

SPECTATORS LINE UP

Spectators, many of them members of the news media, lined up overnight to get a seat inside the courtroom, or even just a glimpse of Trump, who wasn’t expected until Tuesday afternoon.

The building was surrounded by barricades, and people were undergoing layers of security checks. The reporters waiting in line were camped out under tents with lawn chairs, blankets and pizza boxes.

The nation’s 45th commander in chief was expected to be escorted from New York City’s Trump Tower — also surrounded by barricades — into a lower Manhattan courthouse by the Secret Service.

Police braced for protests from supporters of Trump, a Republican who is running for the White House again in 2024. He called the decision by a grand jury to indict him “political persecution and election interference at the highest level.”

Prosecutors investigated money paid to porn actor Stormy Daniels and ex-Playboy model Karen McDougal to keep the women from going public with claims that they had sex with him.

That may well be and would point to the Jan 6 arrests and convictions as having an impact.

RALLY FOR TRUMP
People began gathering Tuesday morning for a rally for Donald Trump in a park outside the courthouse where the former president is scheduled to be arraigned.

The rally with Republican Rep. Marjorie Taylor Greene was scheduled to start several hours ahead of Trump’s court appearance.

Some anti-Trump protesters also appeared, unfurling a large banner saying “Trump Lies All the Time.”

Trump supporters also are expected expected to gather at his Mar-a-Lago home in Florida on Tuesday night as he returns. ___
