JUST IN: Judge Nichols, the only federal judge in DC to reject obstruction charges against Jan. 6 defendants, has dismissed another charge, this time against Jake Lang, one of the first people charged and detained for assaulting officers that day.

Guess Judge Nichols determined that was typical touristy behavior.

Perhaps there's a problem with the charging documents? Something along those lines, but otherwise, I don't get the dismissal of obstruction charges when that's the reason they were there. :brickwallsmall:

Jan. 6 defendant Mike Adams has been designated a "fugitive" according to new court filings. His case has been dormant for nearly a year.

I could be wrong (I often am), but I thought this particular judge didn't think the certification of electors was an "official proceeding" because there was no exercise of discretion involved. Or something like that. So it wasn't so much that their behavior wasn't obstructionist as it was there was nothing to obstruct.

Nichols similarly had ruled (in the case against Garret Miller) there no obstruction because the statute "requires that the defendant have taken some action with respect to a document, record, or other object in order to corruptly obstruct, impede or influence an official proceeding."

In other words, according to Nichols, mere tourism isn't obstruction.

Lang, of course, still faces two felonies and a bunch of misdemeanors.

JUST IN: DOJ indicates that Capitol Police Officer Eugene Goodman is expected to testify at the trial of Jan. 6 defendants Kevin and Hunter Seefried. Kevin Seefried was famously pictured carrying a Confederate flag through the Capitol.

SCOOP: A D.C. chiropractor who stormed the U.S. Capitol has been arrested for his role in the Jan. 6 attack.

The FBI was at his office this evening, just blocks from the U.S. Capitol.

Michigan GOP gubernatorial candidate Ryan D. Kelley was arrested today for his conduct at the Capitol on #Jan6

I filmed Kelley on the stairs waving on the crowd behind them before they pushed through police lines & breached the Capitol.
