As always, it is relatively easy to ask SCOTUS for review. So filing is possible.

But highly unlikely SCOTUS would grant review, let alone relief.

And remember: Every filing is an opportunity to grift off those who mistake action for achievement.

This _really_ doesn't mean much of anything.

Mostly the court said Trump has to seek first relief in the superior court, and can appeal to the supreme court only if and after the superior court denies relief.

It's true that on p. 4 of the order the supreme court cast some shade on Trump's theory, but that discussion wouldn't be binding if the case came back on appeal from the superior court.

Now, I don't have any reason to think that the superior court will grant Trump's request to put an end to the investigation by Willis, nor do I think that the supreme court would do so on a proper appeal from an order of the superior court.

However, it's not quite the level of smackdown that's being claimed. It's more along the lines of "Sir, stop pounding on that button. The elevator doesn't stop on this floor. You need to go to the lobby."

OTOH, it is amazing to me that Trump's experienced Georgia criminal lawyers made such a clown shoe mistake as to file in the supreme court first. I can only surmise that they were being bullied into doing so by Trump's circle of MAGA lawyers.

I mean, sure, ETTD, but this is silly.

Attorneys for the former chair of Georgia's Republican Party argue their client shouldn't be prosecuted for the actions he took to support Donald Trump in the weeks after the 2020 election.

Lawyers Craig Gillen, Holly Pierson and Anthony Lake sent a 13-page letter to Fulton County District Attorney Fani Willis on Tuesday that argued David Shafer's actions were constitutionally protected and the state lacks the proper jurisdiction to pursue charges.

Shafer, who oversaw the Dec. 14, 2020 meeting where 16 Georgia Republicans cast Electoral College ballots claiming Trump won the election, is a person of interest in the election investigation being handled by Atlanta prosecutors.

Willis is expected to announce indictments in August, and at least half of Georgia's Trump electors have taken immunity deals, according to court documents.

The district attorney's office declined to comment on the letter.

The meeting of the Republican Presidential elector nominees on December14, 2020 was a “peaceable assembly” to preserve the “redress” requested in his petition, as advised by legal counsel who had prepared the petition. And, under the Constitution and the ECA, the December 14, 2020 meeting and execution of contingent electoral ballots was also a “petition” to the government, specifically Congress, which is the only governmental authority empowered to adjudicate and count electoral ballots from any State.

The Fulton county district attorney investigating Donald Trump’s efforts to overturn the 2020 election results in the state of Georgia has developed evidence to charge a sprawling racketeering indictment next month, according to two people briefed on the matter.

The racketeering statute in Georgia requires prosecutors to show the existence of an “enterprise” – and a pattern of racketeering activity that is predicated on at least two “qualifying” crimes.

In the Trump investigation, the Fulton county district attorney, Fani Willis, has evidence to pursue a racketeering indictment predicated on statutes related to influencing witnesses and computer trespass, the people said.

Willis had previously said she was weighing racketeering charges in her criminal investigation, but the new details about the direction and scope of the case come as prosecutors are expected to seek indictments starting in the first two weeks of August.

The racketeering statute in Georgia is more expansive than its federal counterpart, notably because any attempts to solicit or coerce the qualifying crimes can be included as predicate acts of racketeering activity, even when those crimes cannot be indicted separately.

The specific evidence was not clear, though the charge regarding influencing witnesses could include Trump’s conversations with Georgia’s secretary of state, Brad Raffensperger, in which he asked Raffensperger to “find” 11,780 votes, the people said – and thereby implicate Trump.

For the computer trespass charge, where prosecutors would have to show that defendants used a computer or network without authority to interfere with a program or data, that would include the breach of voting machines in Coffee county, the two people said.

The breach of voting machines involved a group of Trump operatives – paid by the then Trump lawyer Sidney Powell – accessing the voting machines at the county’s election office and copying sensitive voting system data.

The copied data from the Dominion Voting Systems machines, which are used statewide in Georgia, was then uploaded to a password-protected site from where election deniers could download the materials as part of a misguided effort to prove the 2020 election had been rigged.

Though Coffee county is outside the usual jurisdiction of the Fulton county district attorney’s office, the racketeering statute would allow prosecutors to also charge what the Trump operatives did there by showing it was all aimed towards the goal of corruptly keeping Trump in office.

Fulton County judges recused from Trump's attempt to quash 2020 election probe grand jury

FULTON COUNTY, Ga. - Former President Donald Trump's legal attempts to quash a Fulton County grand jury's investigation into whether he and his allies should be criminally charged for allegedly illegally meddling in the 2020 election will be heard by a Georgia judge from outside the county.

Thursday, Fulton County Superior Court Judge Ural Glanville ruled that all actives judges of the Fulton County Superior Court bench should be recused from the civil lawsuit Trump's lawyers filed District Attorney Fani Willis and Judge Robert McBurney.

The case will now be heard by a judge in Georgia's Seventh Judicial Administrative District, which covers an area including Bartow, Gordon, Cobb, Murray, Whitfield, Douglas, Catoosa, Chattooga, Dade, Walker, Paulding, Floyd, Haralson, and Polk counties. The district's administrative judge is D. Scott Smith of the Cherokee Judicial Circuit. While one of the district's judges may hear the case, they could have the hearing at the Fulton County Superior Court.

This ruling comes in the same month McBurney swore in two grand juries on Tuesday - one of which is expected to hear evidence in the Georgia election case.

Trump had asked the Georgia Supreme Court to weigh in on his lawsuit, arguing that attempts to quash the report and disqualify District Attorney Fani Willis have been ignored by McBurney.

However, the Supreme Court unanimously ruled Monday that the former president had not been able to prove a reason for them to quash the investigation, writing that Trump "makes no showing that he has been prevented fair access to the ordinary channels."

Regarding Trump’s attempt to block the prosecutors, the justices said his legal filing lacked "the facts or the law necessary to mandate Willis’s disqualification by this Court at this time on this record."

A judge in Georgia has now set a hearing date for a motion by former President Donald Trump's lawyers to disqualify Fulton County District Attorney Fani Willis from the potential case over criminal interference in the 2020 election.

According to the Atlanta Journal-Constitution, Senior Superior Court Judge Stephen Schuster will hear the motion on August 10. He also directed both sides to submit their legal briefs by no later than August 8.

This comes as a possible indictment from the grand jury that could be handed down any day. Earlier this year, Willis said there would likely be a decision on an indictment in August.

I think that everyone being investigated should be able to demand that the investigations should not be allowed to progress - because if the investigator is looking for evidence then they are obviously biased!
