The National Archives has told the House Oversight Committee that it has not yet recovered all of the records from Trump administration officials that should have been transferred under the Presidential Records Act.

The Archives will consult with the Department of Justice “on whether ‘to initiate an action for the recovery of records unlawfully removed,’ as established under the Federal Records Act,” acting archivist Debra Steidel Wall said in a letter sent on Friday to the committee’s chairwoman, Carolyn B. Maloney (D-N.Y.).

Steidel Wall added that the Archives has been unable to obtain federal records related to “non-official electronic messaging accounts that were not copied or forwarded into their official electronic messaging accounts.” Presidential advisers are required to forward such messages to their official accounts under the law, she noted.

The FBI team that seized documents from former President Donald Trump’s Florida resort improperly viewed communications between Trump and an attorney, violating attorney-client privilege for a third time, lawyers for Trump said in a new filing.

The filter process set up by the government to try to prevent FBI agents from viewing privileged materials has already failed twice, the government has acknowledged. On Sept. 26, government officials informed Trump lawyers of a third failure, the lawyers said in a new filing lodged in a federal court in southern Florida.

FBI agents viewed an email that they sent to the Privilege Review Team, a team that was supposed to filter out all potentially privileged materials before agents were able to view any.

The review team has characterized the email as non-privileged, but Trump disagrees.

“Plaintiff believes the email falls squarely into the category of attorney-client privileged,” Trump lawyers told U.S. District Judge Raymond Dearie, a Reagan appointee who is serving as a special master in the case.

With 11000 documents there can be a problem once in a while. The FBI members handled the problem correctly and professional by redirecting questionable documents back to the taint team. The side effect of this is that they did not make notes of what the specific document contained. Privilege has essentially been retained. Now if messy only had kept his lawyer letters all in a separate drawer and not comingled them with government documents or with his love letters and memorabilia...

Surely any person with such complex affairs would/should employ a personal secretary to handle those basic aspects of organizing paperwork? If Trump's documents are a manure pile, his lawyers can't reasonably complain if the FBI get shit under their fingernails.

I guess either Trump doesn't want competent staff or they're too clear-headed to agree to work for him.

    A recent report revealed a division within Trump's legal team amid the Mar-a-Lago investigation.
    One of his attorneys wants him to take a less aggressive approach with the DOJ.
A former federal prosecutor sneered at Donald Trump's lawyers attempting to rein in the former president as he battles Justice Department in federal court over the Mar-a-Lago raid.

During a Saturday interview on MSNBC's "The Katie Phang Show," Phang asked ex-US Attorney Barbara McQuade about a recent Washington Post report highlighting that Trump's lawyers are divided on handling the case.

"I say, Katie, to those lawyers who joined in good faith and think they're going to change Donald Trump: bless you, good luck — here we go again," McQuade said. "Donald Trump has one mode, it is all offense all the time."

In August, the FBI raided Trump's Florida estate and found classified documents, including some labeled as top secret, resulting in the DOJ launching an investigation. On Friday, the agency asked the court to speed up the appeal to appoint a special master to review the documents seized from Trump's home to continue their probe.

Trump attorney Christopher Kise, who received $3 million to represent the former president, wants Trump to have a new, less aggressive stance with the DOJ, The Washington Post reported, citing sources familiar with the matter. However, according to the report, other lawyers on the legal team have been critical of Kise's strategy and are open to a more combative approach.

McQuade suggested Kise's method might be fruitless.

"And anyone who thinks he is going to change him, you know, it's like the woman who marries the man and says 'I'm going to change him.' Like, no. People are who they are," McQuade told MSNBC." At this point in life, shame on him for not knowing who Donald Trump is."

I'm a little surprised that the 11th Circuit didn't put out a curt written order giving Trump’s attorneys a date by which to file their Opposition to the Motion to Expedite. Maybe they thought they could take the weekend off, little vacation in Fort Myers Beach, and back to work on Monday. How's that going? I dunno. :roll:

Slackers. I wanted them to set Tuesday noon, but now that's probably not realistic.

The 11th Circuit, as we have seen on several occasions, doesn't need to set a date for the government's reply; the government will file an excellent reply within 24 hours of the opposition, as one does when one has unlimited resources. And a tood. :mrgreen:

Kise’s method might be fruitless with respect to reining in the client, but those looking to take a more aggressive approach with the DOJ are likely to find out just how fruitless such a strategy will.

1. Trump should have gone along with the Motion to Expedite, he's going to lose sooner or later. :mrgreen:

2. The gubbermint will file a Reply in support of the Motion today, or at the latest, early tomorrow. The reply will be excellent.

3. The 11th Circuit will grant the Motion to Expedite. This is a cloudy and imprecise prediction, because I can't specify regarding whether the court will issue a lengthy or a single-sentence order, or whether it might include any sort of criticism of Judge Cannon. It could say, "Motion granted with dates as suggested by the government" or they could write a treatise about federal district court judges spiraling out of control and abusing their discretion and issuing seriously bizarre orders and running with scissors and godonlyknowswhatelse when they are assigned to a case where the plaintiff is the guy who appointed her.

4. After that I'm stumped. :think:

So let's talk about the June 2, affidavit signed by Christina Bobb.

Obviously, she is in deep 💩 over that, I don't think her weasle language is going to help her.

Can Trump weadle out? It was signed on his behalf, so presumably it was with his full knowledge and approval.

Is it one count of obstruction or 100 counts for each responsive document not turned over?

I presume a conspiracy charge of some sort will be tacked on to the "gang that couldn't lie straight"

On social media, I have run into someone who swears up and down that attachment C in this document is not a Grand Jury subpoena.

Just a wild guess: It’s signed by Jay Bratt of the DOJ. Could the social media folks think it has to be signed by a judge?

Corcoran did not reject the suppoena as fake. He arranged for the deposition of the requested materials to happen at MaL. The FBI received a small red binder, taped as for secret documents, that turned later out to be only a miniscule part of the missing papers.
