The letter @JoyceWhiteVance cites was sent to Merchan yesterday after Judge Hellerstein's order but before Trump filed a notice of appeal of that order. It's still true that there is no pending removal notice, as Hellerstein denied Trump leave to file a second, belated notice. 1/

But Hellerstein's order conflates summary remand, which is appealable as of right, with the denial of leave, which is not. And that sloppiness might be just the opening Team Trump needs to be able to keep the removal effort going, at least for now. FIN.

EXCLUSIVE: America First Legal (AFL) is suing New York State Supreme Court Judge Juan Merchan for refusing to turn over his financial disclosures amid questions about his daughter’s work at a Democratic firm, Fox News Digital has learned.

AFL sued Merchan, who presided over former President Donald Trump’s six-week-long trial in New York v. Trump, stemming from the yearslong investigation out of Manhattan District Attorney Alvin Bragg’s office. They also sued the New York State Unified Court System’s Ethics Commission.

So it seems Marchan will issue his sentencing scheduling ruling Friday. Which happens to correspond to another proceeding in the world of Trump crimes.

Trump is expected to to appear Friday in a Manhattan courtroom in a separate case where he is appealing a $5 million judgment for sexually assaulting and defaming columnist E. Jean Carroll in the mid-1990s. His appearance for the oral arguments is voluntary, not compulsory.

Judge delays Trump sentencing in hush money case until November

A New York judge has delayed former President Donald Trump's sentencing on felony criminal charges until Nov. 26.

Judge Juan Merchan handed down the ruling Friday after Trump's attorneys had asked him to postpone the Sept. 18 sentencing until after the election in order to allow them to be in position to appeal a pending ruling involving presidential immunity.

That ruling is expected by Sept. 16 - just two days before what would have been the first ever sentencing of a former president on criminal charges. Trump was convicted in May on 34 counts of falsifying business records related to a hush money payment to adult film star Stormy Daniels near the end of the 2016 presidential campaign.

“A single business day is an unreasonably short period of time” for such an appeal, Trump attorneys Todd Blanche and Emil Bove argued in an Aug. 14 filing. “There is no basis for continuing to rush,” they contended.

Prosecutors from Manhattan District Attorney Alvin Bragg's office said they would "defer to the Court on whether an adjournment is warranted to allow for orderly appellate litigation" of any Trump appeal, but "would be prepared to appear for sentencing on any future date the Court sets."

I haven’t properly read all the filings/rulings but seem to remember that tfg’s defence to previous accusations has been that as President he was not a “federal officer”, yet his request for this case to be removed to federal court is based upon the opposite.
