Possibly true but note that the 1973 OLC memo from the Nixon era that a sitting president cannot be indicted has been cited multiple times since then. The 2000 memo would allow the DoJ to act against Trump without having to create new policy. Then it would be up to a judge to decide the Constitutional questions that an indictment might generate. I don't think an indictment is a done deal but we know a sitting grand jury is active and hearing testimony.

Recall that the Watergate grand jury wanted to throw the book at Nixon but Special Prosecutor Leon Jaworski said he would not sign an indictment, most likely because of the OLC memo.

The former deputy counsel to President Donald Trump has been subpoenaed in the federal criminal probe of the January 6 attack on the US Capitol, two sources familiar with the matter tell CNN.

Patrick Philbin was subpoenaed for testimony and documents, according to one of the sources. Philbin worked in the White House counsel’s office under Pat Cipollone, who also was also subpoenaed for documents and testimony, according to sources.

Philbin did not immediately respond to a request for comment.
