Donald Trump is seeking to have the court dimiss a lawsuit against him by eight Capitol Hill cops who accused him of sparking the January 6th MAGA riot.

The former president addressed his supporters at a rally outside of the White House on the morning of the riot. Many of them later marched on the Capitol and forced their way inside the building. The House of Representatives impeached Trump for his role but the Senate acquitted him.

But Trump argues he isn't 'vicariously liable' for the actions of people who heard him speak at a 'Stop the Steal' rally before the riot, Bloomberg News reported.

'Speakers at political rallies do not owe a duty of care to members of Congress or Capitol Police Officers not at the rally,' Trump's lawyer Jesse Binnall said in the Dec. 24 filing in federal court in Washington.

Trump continues to falsely claim he won the 2020 presidential election instead of Joe Biden. The lawsuit from the officers, who were at the Capitol on the day of the riot, is one of many he is facing for his role.

(CNN)A federal judge is allowing a major January 6 conspiracy case against four Proud Boys leaders to move forward, rejecting their bid to throw out the charges.

Judge Timothy Kelly, in a 43-page opinion issued Tuesday, sided with the Justice Department on several key legal questions, giving momentum to prosecutors as they prepare for the first wave of US Capitol riot-related trials beginning in February.
Lawsuits allege extremist groups financially liable for Capitol riot

Kelly greenlit prosecutors' use of a felony obstruction charge, among several other charges, against Proud Boys leaders Ethan Nordean, Joseph Biggs, Charles Donohoe and Zachary Rehl. (They have all pleaded not guilty.) The judge also rejected the defendants' claims that the riot could have been a protected First Amendment demonstration.

"No matter Defendants political motivations or any political message they wished to express, this alleged conduct is simply not protected by the First Amendment," Kelly wrote.

February 2021 is clearly a typo since the end of the paragraph makes it clear that the revelation about the pyramid's worthlessness led him to the Jan 6 rally. You can't be led in Feb '21 to something that happened the month before, unless you own a TARDIS.

WASHINGTON—The U.S. criminal investigation into the Jan. 6 Capitol riot is entering a more contentious phase as it nears the one-year mark, with initial trials set to test the government’s strategy of using provisions first laid out in a 2002 financial-industry law to prosecute some accused of leading the mob.

Around 700 people who stormed the building while Congress met to certify President Biden’s win have been arrested this year, including more than 200 who face charges of assaulting officers or engaging in other violent conduct. About 150 of the rioters have pleaded guilty, many to misdemeanor crimes including entering a restricted federal building.

In the riot’s wake, prosecutors searched for tools to elevate some of the cases beyond the misdemeanor charges often applied for unruly but far less momentous Capitol protests. They turned to a provision in the 2002 Sarbanes-Oxley Act, enacted after the accounting-fraud scandal and collapse of Enron, which imposes a potential 20-year sentence on those convicted of obstructing an “official proceeding.” The measure expanded what counts as obstruction and closed loopholes used by people involved in the Enron fraud.

I hope it works. I don't know if it is the laws that prosecutors are using or if the prosecutors are incompetent, but the number of misdemeanor charges and the relatively light sentences being handed out is beginning to depress me.

Some of these people need to go away for a long, long (20+ years) time.

Basically, it seems that many of the defendants are being charged with or being allowed to plead guilty to malicious mischief. Individually, in many cases, their actions may not have been serious (breaking windows and entering offices) but their intent was nothing less than a coup d'etat.

DC federal court chief judge has ordered all jury trials suspended until Jan 24. Due to “recent explosion” of COVID-19 in DC. This could eventually domino and force delays in Capitol breach case trials.

I expect jailed defendants to renew their efforts for release

Oh, that letter is so good.

It is peppered with questions aimed at Hannity. The committee doesn't examine witnesses via letters, and the committee knows it; it is an attack being waged through the media (social and otherwise).

And it is a class troll: Hannity can not respond ("he's silent because he's scared!") or respond ("taking fire because we're over the target!"), and neither reaction is a good look for him. And the committee knows all this.

Too also, it selectively quoted some tweets, to show both Hannity and the rest of us that it has the receipts.

And namechecks Meadows, just so everyone knows who was driving the bus.
