He's suing in his official capacity as... a former president. Hmm.

President Trump brings this suit solely in his official capacity as a former President

under the PRA, associated regulations, the Executive Order, the Declaratory
Judgment Act, and the Constitution of the United States.
It's possible this isn't why the committee was formed...
27. After the 2020 election, the Democrats in Congress created the
Committee pursuant to House Resolution 503 in a misguided attempt to intimidate
and harass President Trump and his supporters
under the guise of investigating the
events of January 6, 2021.
I'm not going to rehash the legal arguments. I read the complaint and also the relevant statutes they reference though, and in my IANAL mind it doesn't look like he has a leg to stand on. The statute reads pretty clear to me that if he claims privilege, then Biden doesn't uphold it, that's it. The records get released. :shrug:

1. This lawsuit was filed by Jesse Binnall, a sort of later-day Klayman.

2. It asks for two, related injunctions (a permanent one and a preliminary one to allow for an opportunity to review the records). So the immediate future appears to be a series of motions, applications to stay, etc.

Whether the repeached Florida Man can find one judge (read: five SCOTUS justices) willing to indulge him remains to be seen.

2. It's a safe position. Even if they personally felt that Bannon should be held in contempt, they knew there were more than enough Democratic votes so they could look good to the base without risking the issue passing.

I know some are thinking they need to stand their conscience (if they actually agreed with contempt) but, in all fairness, this is politics. This type of game is not new.
