Arizona Supreme Court delays release of election audit records
The Arizona Supreme Court said Tuesday that contractors hired by the Republican-led state Senate to conduct the Maricopa County 2020 election audit would not need to release records from their review by next week.
This is only a temporary delay, as Kathryn King, a justice on the state's high court, put a hold on a lower court ruling that ordered the documents released by Aug. 31 while the case is under consideration.
"It is ordered extending the stay to enable the Court to fully consider the issues raised in the petition for review. However, this order does not relieve the Petitioners from continuing to review and produce documents Petitioners have already agreed to produce," King wrote on Tuesday.

Senate liaison Randy Pullen said Cyber Ninjas did not submit a report & that the meeting today was focused on planning & "the process of getting the report completed and out the door."

The Maricopa County Board of Supervisors violated state law by not fully responding to subpoenas from the Arizona Senate related to the ongoing review of the 2020 election, Attorney General Mark Brnovich has concluded.
The finding means the supervisors have until Sept. 27 to comply or face the prospect of losing hundreds of millions of dollars of sales-tax revenue the state shares with the county.
The supervisors contended they broke no laws because the Senate had no ability to enforce its subpoena powers once the legislative session ended on June 30.
But the Attorney General investigation found that argument only speaks to a remedy to enforcing a subpoena and does not address the fact that ignoring a subpoena is illegal.
"That argument, which addresses only the possible remedy for violating a legislative subpoena, is irrelevant to whether (the board) is in violation of state law in the first place," Solicitor General Brunn "Beau" W. Roysden III wrote in the report.
State Sen. Sonny Borrelli, R-Lake Havasu City, used a power lawmakers created several years ago that triggers an investigation into possible violations of state law by cities, towns and counties. If found in violation, the local governments face the prospect of losing state-shared revenue.
In this case, Maricopa County gets a share of state sales tax that last year amounted to $715 million.

Does the AG have the final word or can this be taken up in court? It sounds like some idiot in the AZ Senate can ask for anything, no matter how ridiculous, knowing it can't be turned over, and then strip the county of funding for noncompliance.

So looks like they have options, though a negotiated settlement seems unlikely since I doubt the senate really wants the information in the first place.The Attorney General's report suggested there are ways to remedy the standoff without the prospect of losing tax revenue. For example, the supervisors could reach a negotiated settlement with the Senate, hand over the materials or take the matter to court.

Yes, the Senate can sue, can file any complaints they want and can file any objections they want. Remember, anyone can sue, draft a "complaint" and pay the filing fee. I’ll have to read it more carefully, but it seems to me that after the AG is involved, that office works directly with the state Treasurer to withhold funds, I’m not sure the legislature is actually involved at that point anymore other than receiving reports.
I could be wrong, it’s early and the language is confusing me.
