I’m glad he’s getting it too. But the elements of the insanity defense are that (a) he had a severe mental disease or defect; and (b) as a result he either didn’t know what he was doing, or knew what he was doing but didn’t know it was wrong. The burden is on the defense to show these things by clear and convincing evidence.

I doubt deranged by Fox/OAN would qualify as a severe mental disease or defect. But it sounds like he might be able to make out the first element of the defense if what he says about “mind meds” is true.

He’s going to have a hard time with the second element, though. It’s pretty clear he knew what he was doing. And the cops know how to get a guy to say he knew it was wrong, and I’d be shocked if they haven’t obtained enough information from him to undercut any insanity plea.

And even if an insanity plea is successful, that doesn’t mean he gets to walk away. He’d be committed for an indeterminate period of time until he’s no longer a danger to himself or others (an expert in a case I had told me that the minimum period of commitment is usually around five years, and it’s often longer because the commitment exacerbates rather than ameliorates the mental health problems.

Too also: the exam could be to see if he's competent to stand trial.

In some jurisdictions, knowing the person in the black robe is the judge would be enough to show competence. In others, there needs to be evidence a defendant would be able to assist counsel in a defense; being a full-on nutter might not meet that standard.

E.g., if you know your lawyer is your lawyer, but insist on a black-helicopters defense, some jurisdictions would find you incompetent because you can't "assist" in your own defense.

Floyd Ray Roseberry was ordered detained on federal charges Friday, a day after he claimed to have a bomb in his truck parked at the Library of Congress. He’s being held without bail pending a medical evaluation.

A court filing said a relative had warned North Carolina law enforcement Wednesday that Roseberry recently expressed antigovernment views and planned to go to Washington or Virginia to conduct acts of violence.

Buildings including the Supreme Court, the Cannon House Office Building and the offices of the Republican National Committee were evacuated during the threat.



Later Friday, a court filing revealed that a relative of Roseberry’s had warned North Carolina law enforcement authorities on Wednesday — a day before the bomb threat — that Roseberry recently expressed antigovernment views and planned to travel to Washington or Virginia to conduct acts of violence.

Oh man, that's really suspicious. Sounds like a Soros/Clinton false flag to me. The whole thing was planned to give cover for a company of FBI agents to search the joint, with nobody the wiser.
