Kenneth L. Joel appears to be a Senior Deputy Attorney General.My opinion is that the AG's office wants to signify, this time, that it is taking this matter more seriously than last time. They may very well be intending to renew the sanctions motion, and underscoring the waste of resources this lunatic has caused due to the free rein she has been given.This would be a time to emphasize that it is time to take the rattle from the baby.

I still wonder if this appearance might have been triggered in whole or in part by Orly's attempt to add Garn and Shelby as defendants. Since it is doubtful that they've been properly served (does Orly ever serve anyone properly?) it may be premature to conclude that Mr. Joel will represent only the Elections Board.I dunno.*******To review the bidding, here's original bet:

To review the bidding, here's original bet:

Over/under that we'll see the appearance of new counsel for defendants now that Garn and Shelby have been named as defendants?

If we're reviewing bidding, here's my initial guess:

I'm going to go out on a limb, and guess that we'll see an additional Deputy AG, possibly a supervisory-level DAG, enter an appearance and attend the hearing, but that Shelby and Garn will remain assigned to the case.

[highlight]Second request for a general election challenge hearing against Candidate Obama[/highlight]


Dear Mr. King,


[highlight]I was granted pro hac vice to represent plaintiffs in legal challenge against Secretary of State of Indiana[/highlight] Connie Lawson and the Elections Commission.


[highlight]On behalf of my clients[/highlight]I am requesting the following:


1. a certified transcript of the primary challenge hearing and a full Agency File of the primary election challenge to candidate Obama





2 [highlight]all of the primary election challengers[/highlight] Karl Swihart, Bob Kern, Frank Weyl, Edward Kesler, Valeria Ripley and Orly Taitz [highlight]are renewing their challenge against Candidate Obama for general election and incorporate by reference their arguments and exhibits contained in their Second Amended Complaint which is attached herein.[/highlight]





3. Due to an overwhelming evidence of identity fraud, use of a name not legally his and use of forged and fraudulently obtained identification papers by Mr. Obama and enormous threat to the national security involved in his continued presence in the White House, Plaintiffs are requesting a hearing on their General Elections challenge to be held as soon as possible. As Judge Reid scheduled a hearing on September 26 at 1:30 pm, [highlight]Plaintiffs would like to schedule a General election challenge hearing for the same day in the morning at 9 or 10 am, so they can report to judge Reid immediately the disposition of the hearing on their general election challenge.[/highlight]





4. In light of the evidence of forgery, Plaintiffs would like to know whether the Elections Commission and the Secretary of State of Indiana Connie Lawson would stipulate to [highlight]subpoena of the original SS-5 application of the Connecticut Social Security number[/highlight] 042-68-4425, :lol: which Mr Obama is using, but which was never assigned to him according to the E-verify and the SSNVS, [highlight]subpoena of the original application to the Selective Service[/highlight] and original birth certificate in light of flagrant forgery in his alleged copies of the aforementioned documents. These stipulations are sought as part of the General Elections challenge and as a condition to placement of Candidate Obama’s name on the ballot in light of the Prima Facia evidence of forgery in Mr. Obama’s primary identification papers.





5. In case Elections Commission and Secretary of State refuse to hold a General Elections challenge hearing or if the hearing is held, but challenge is denied, Plaintiffs are seeking a certified copy of the Agency records of both Primary and General Election challenges [highlight]to be forwarded to the presiding Judge Sherry K. Reid ASAP.[/highlight]


If I do not hear from you in the next 3 days in response to this second request, I will assume that the Elections commission is refusing to hold a hearing on the General election challenge to candidate Obama and copy of this letter will be forwarded to judge Reid as an agency record for the General elections challenge against Candidate Obama.

As for requesting a hearing it tells me:

Before the Indiana Election Commission or a county election board may consider a challenge to a candidate,[highlight]a registered voter of the election district that the candidate seeks to represent must file a sworn statement with the Election Division or the county election board.[/highlight] The sworn statement must question the eligibility of the candidate to seek the office and set forth the facts known to the voter concerning this question. (IC 3-8-1-2) The CAN-1 form may be used for a candidate challenge. A CAN-1 is included under the Candidate Forms tab of this Guide

And about the removal of a candidate it has the following to say, but not that is for state and other local positions, federal not mentioned, implying that there is actually no possibility for removal from ballot:

A different law applies concerning the removal of a candidate for a statewide or state legislative office from the general election ballot. A registered voter of the relevant election district may challenge the qualifications of a candidate to remove the candidate from the ballot. The [highlight]challenge must: (1) be filed with the Election Division not later than 74 days before the general election[/highlight]; (2) be a sworn statement questioning the qualifications of the candidate; and (3) set forth the facts known by the challenger concerning this question

and also, too:

[highlight]In any event, at noon, 60 days before the election, any challenge that is pending before the Commission or the Court of Appeals is dismissed and the name of the challenged candidate may not be removed from the general election ballot,[/highlight]and another individual may not be named to replace the challenged candidate on the ballot, and all votes cast for the challenged candidate must be counted and reported under the name of the challenged candidate. (IC 3-8-8)

That makes me go hmmmm - Nov 6 less 60 days makes something around Sept 7, and today my calendar proposes September 21. =))

I'm trying real hard to understand this idea of stipulating to a subpoena to be served on a nonparty.Let's say I sue Foggy for unauthorized use of a copyrighted avatar I've never used at the Fogbow. In fact, Foggy's never seen the friggin' avatar (which, BTW, may or may not exist).So anyway, Foggy and I agree to stipulate to a subpoena directed to the Coca-Cola Company. This means they'll have to give us the secret formula for Coke, right?Or am I missing something. Does one of us have to get pro hac vice first?

The DDS comes between the pro hac vice and the polar bear I believe. Right before the ad hoc.

A) Most likely because they're late.B) They could just accept them and borrow Judge Reid's "DENIED" stamp. C) I doubt the police are going to have any effect on whether the EC accepts or files anything.D) Orly probably told them to call the police and the idiots complied.
