You want to put an old man to work? Go to the second day of Costello's cross examination. He is asked a series of questions as to which he denies the facts and then is impeached with an email he sent which demonstrates the facts were true. Repeatedly. It's quite amazing.

More seriously, I understand that defendants are not obliged to testify in their own defense (burden of proof and so on) do the jury should not draw adverse inferences from that, not from witnesses refusing to self-incriminate (don't think that happened in this trial). But surely the failure of Trump to testify and the lack of credible and convincing (not lying now or in the past) defense witnesses places a thumb on the scales of justice in the jury room? I know I'd be thinking "Those guys, liars and felons, are the best they have? Oh dear."

Oh, but Mr. Trump did testify, in a manner of speaking, because of his behavior in the courtroom. I cannot tell you how the jury has been influenced, but it has been influenced by his acting out in front of them. Which he has done on several occasions. I suspect that he has telegraphed his contempt and hostility toward the jurors, because that's who he is, that's what he does.

If I'm on that jury, his behavior in court, including the clones that trooped in every day last week, looking like corporate thugs, supporting the notion that the only thing he cared about was politics, would convince me of his intent to bully and deceive TO THIS DAY.
And then Costello, opening scorning prosecutor and judge, with his documented intent to work behind the scenes for fuckhead at the expense of his (supposed) client, looking like the biggest bully-thug of all--making it clear that TO THIS DAY he is working for fuckhead.
Costello doubled Cohen's credibility, IMO.
OTOH, I just watched an interview of Alan Parks, limo driver from the OJ murder case. His testimony was crisp and clear and supported by phone records and Kato as a witness. He had no skin in the game at all (spent 20 min of his life w OJ). And yet, according to him, the jury doubted to an unknown extent his entire testimony, because he said he thought there were two cars parked in the driveway, when there was only one. If a juror wants to hang his hat on Cohen, the media will say it was reasonable

Jurors are hard to figure. Our small firm worked on a jury trial with an extremely experienced and successful trial lawyer from Los Angeles, a giant of the bar, and also a courteous and decent man who was not inclined to boast. He did, however, briefly gloat about how thoroughly he had impeached one of the defendant's witnesses with inconsistent prior testimony. "RIP" was the way he put it.
It was a plaintiff's verdict, although not as big as we had hoped, and we had several good opportunities to interview jurors afterwards. We learned that the impeachment of this witness had made no impression on the jury whatsoever. So go figure.

I pretty much always take anything you say for a fact, but I would be seriously surprised if Biden doesn't lose Florida by over 1 million votes. The voter registration numbers and myriad and very effective obstacles to voting for a large swath of traditional Democratic voters (put in place by the Florida legislature) will be almost impossible for Democrats to overcome.
