You want to put an old man to work? Go to the second day of Costello's cross examination. He is asked a series of questions as to which he denies the facts and then is impeached with an email he sent which demonstrates the facts were true. Repeatedly. It's quite amazing.
I completely agree. Costello got flustered too. There was one exchange where he couldn't figure out whether the correct lie was yes or no so he said both several times.

They probably could but their client insisted he could be a good surrogate for him. It didn't work out very well.

And in Trump's mind, Costello's failure to help his case should be grounds for dismissal of all charges! "So unfair! He didn't tell the truth. My truth. And they wouldn't let my great lawyers the right questions."

Plus, the fact that he, Donald Trump, was not allowed to testify in his own defense! How did that happen?! "This is the most unfair trial ever! And you know who stopped me from testifying? Sleepy Joe Biden and his corrupt – sooo corrupt – Attorney General!"

More seriously, I understand that defendants are not obliged to testify in their own defense (burden of proof and so on) do the jury should not draw adverse inferences from that, not from witnesses refusing to self-incriminate (don't think that happened in this trial). But surely the failure of Trump to testify and the lack of credible and convincing (not lying now or in the past) defense witnesses places a thumb on the scales of justice in the jury room? I know I'd be thinking "Those guys, liars and felons, are the best they have? Oh dear."

Oh, but Mr. Trump did testify, in a manner of speaking, because of his behavior in the courtroom. I cannot tell you how the jury has been influenced, but it has been influenced by his acting out in front of them. Which he has done on several occasions. I suspect that he has telegraphed his contempt and hostility toward the jurors, because that's who he is, that's what he does.

:yeahthat:

If I'm on that jury, his behavior in court, including the clones that trooped in every day last week, looking like corporate thugs, supporting the notion that the only thing he cared about was politics, would convince me of his intent to bully and deceive TO THIS DAY.

And then Costello, opening scorning prosecutor and judge, with his documented intent to work behind the scenes for fuckhead at the expense of his (supposed) client, looking like the biggest bully-thug of all--making it clear that TO THIS DAY he is working for fuckhead.

Costello doubled Cohen's credibility, IMO.

OTOH, I just watched an interview of Alan Parks, limo driver from the OJ murder case. His testimony was crisp and clear and supported by phone records and Kato as a witness. He had no skin in the game at all (spent 20 min of his life w OJ). And yet, according to him, the jury doubted to an unknown extent his entire testimony, because he said he thought there were two cars parked in the driveway, when there was only one. If a juror wants to hang his hat on Cohen, the media will say it was reasonable

Jurors are hard to figure. Our small firm worked on a jury trial with an extremely experienced and successful trial lawyer from Los Angeles, a giant of the bar, and also a courteous and decent man who was not inclined to boast. He did, however, briefly gloat about how thoroughly he had impeached one of the defendant's witnesses with inconsistent prior testimony. "RIP" was the way he put it.

It was a plaintiff's verdict, although not as big as we had hoped, and we had several good opportunities to interview jurors afterwards. We learned that the impeachment of this witness had made no impression on the jury whatsoever. So go figure.

Juries do funny things.

However, I hope this jury knows, deep down, that we are in a really dangerous place in American polly ticks. Sooper dangerous. We are in red alert real trouble, and this jury has the opportunity to make history. We'll see if they make history in a good way, or a bad way.

And then there was the federal jury several decades ago in a southern state, possibly Georgia or South Carolina, in the prosecution of the CEO of a ... healthcare or insurance company, who had committed fraud of legendary proportions over many years. Nearly a dozen former CFOs testified against him, and the paper evidence was extensive and unambiguous.

One or two of the witnesses had been involved in some extra-marital shenanigans, and defense counsel's summation was an unabashed fundamentalist fire and brimstone sermon about sin and sinners.

The CEO was acquitted on every count, and the jurors later explained that the marital issues were the only things that that had mattered to them.

Yabbut, I bet the CEO didn't act out like Mr. Trump did in his trial.

Anything can happen. I'm hoping for a little justice and reality.

This man has seriously damaged the country I love.

I want to see him sentenced to years in prison. AMMV (anyone's mileage).

Rest easy, Pappy. Six weeks before election day Trump's support will collapse and we will see states like Florida and North Carolina become Biden Country.
I pretty much always take anything you say for a fact, but I would be seriously surprised if Biden doesn't lose Florida by over 1 million votes. The voter registration numbers and myriad and very effective obstacles to voting for a large swath of traditional Democratic voters (put in place by the Florida legislature) will be almost impossible for Democrats to overcome. I would love to be wrong about this, but I doubt that will pan out.

IANAL, so I'll just drop this here for those who do understand -

Frank G. Runyeon
@frankrunyeon

New: DA & Trump's proposed jury charges landed on the paper docket. @Law360
scanned them in for you.

(No final jury charge on paper until the jury hears it)

Among the dueling proposals:

** Falsifying Business Records (first degree) **

Trump sought to tell jurors they needed to find "two separate intents" inside the intent to commit *another* crime.

In the hearing, that went over like a wet balloon.

Diving deeper into the proposed charges...

On the DA's theory that Trump faked records as part of a conspiracy to promote his election using "unlawful means" --> He asked that jurors to unanimously decide & name what it was.

Judge rejected that too.

** Federal Election Campaign Act **

Trump wanted to add FECA violation had to be "willful" (therefore criminal) to support the DA's theory of NY election law conspiracy (17-152). DA argued "unlawful means" doesn't mean criminal.

How did Merchan rule? 🤐

Wrong.

Wet balloons still fly. Just shake 'em a little bit. That's not the saying.

Maybe he wanted to hint at "wet fart in church", which is how I think the saying goes?

And the truth shall ever come uppermost,
And justice shall be done.

If you goog the phrase "went over like a wet balloon" the goog will give you results for "lead balloon" instead, because that's the actual saying. Wet balloons are only a thing if the water molecules are inside the balloon. In which case, it's called a water balloon (with some regional variations, of course). Children enjoy throwing water balloons at each other, they explode and get the other kid soaking wet.

I once saw an interview with F. Lee Bailey, long before he became involved with the OJ trial, in which he said that he would much rather defend an accused murderer than a car thief.

His reason: you can't argue that the car deserved to be stolen.
