So Larry Brock is declaring that the J6 types in jail like himself are 'political prisoners of war'.

I mean, look, IANAL and I've only occasionally been accused of being the sharpest tool in the shed, but if Brock is asserting in any way that he's a 'prisoner of war', isn't he effectively admitting that he attempted to wage war on the United States? It seems to me that I remember reading about a crime that fits the definition of an American waging war on the United States. I wonder where that was and what that crime is.... :confuzzled: :shrug:

HEADS UP: Sentencing is beginning now in high-level Capitol riot case of Andrew Taake

He was accused of brandishing metal whip against police… and of assaulting police with chemical spray and causing injuries

Judge Carl Nichols has just read an excerpt from a police officer’s victim impact statement. Officer said he/she was “immediately blinded” by the chem spray… and that it felt “like living death”.. and officer struck head on scaffolding after being sprayed

Taake sits at defense table in orange jail jumpsuit scribbling notes as defense attorney argues over sentencing guidelines. He’ll address court later.

Feds are seeking 78 months prison.

So…. There’s been a curve ball. Defense attorney is noticeably frustrated with judge.

Stand by.

Judge Carl Nichols has just postponed this sentencing.

For a month. Nichols is questioning why prosecutors aren’t seeking a further enhancement to the possible prison term for Taake. For causing “bodily harm” to officers. Could result in sizably longer prison sentence

Defense attorney is visibly dissatisfied. He tried to argue that Taake wants to be sentenced TODAY & says the delay will give the prosecutors an opportunity to “breach” the plea deal with Taake. Taake shook his head & was noticeably frustrated when judge ordered postponement

Judge began hearing by asking Justice Dept prosecutor why she hadn’t requested a “3-point” enchantment in sentencing guidelines range for the bodily harm suffered by police.

Prosecutor indicated some of the police officer info wasn’t available during plea negotiations

Judge Nichols: “It’s clear as day to me” that the sentencing enchantment could apply in this case

Defense argued repeatedly (even after judge denied defense’s motion) to plow ahead with sentencing today. Defense is concerned the plea deal is about to implode.

Prosecutor told judge she’s not keen on reopening plea talks .. and that next step could be a trial


Defense: “Mr Taake has been in jail 33 months. He came here today ready to be sentenced”

But it’s not happening … Taake returns to jail.

Sentencing rescheduled for May 23 at 10am

Attorneys are asked to file arguments on the sentencing enhancement issue in the meantime

Defense attorney takes swig of his half-filled bottle of root beer. And watches Taake get escorted by Court security out of courtroom
