Nathan Wade had been scheduled to go on Meet the Press tomorrow. Several people I follow on Twitter thought that was a very stupid idea on his part. Wade has now canceled his appearance citing a family emergency.

So there was a hearing at the GA Senate last week about the Many Sins of DA Willis. Clips off Sen Jones quizzing Ashley Merchant into oblivion made the national news. Here he is w Ben Meiselas. I like him a lot. He makes about about the "confidence in the system" issue that, IMO, McAfee fumbled big time.

JUST IN: Trump and 7 co-defendants have asked Judge McAfee to issue a certificate of immediate review of his order denying disqualification of Fani Willis. The certificate, if issued, would allow the defendants to seek an immediate appeal of the order.

To appeal the order denying disqualification prior to trial, the defendants must obtain a certificate of immediate review within 10 days from the date of the order.

Even if Judge McAfee issues a certificate, the Georgia Court of Appeals could still decline to hear the case.

What does the trial court consider when deciding whether to issue a certificate of immediate review?

As I noted yesterday, the statute merely provides that the court should consider whether the order “is of such importance to the case that immediate review should be had.”

But Rule 30 of the Georgia Court of Appeals provides a list of factors for the appellate court to consider when deciding whether to grant an application for interlocutory appeal.

McAfee will likely be mindful of these factors when considering whether to grant a certificate.
