ASAIK you don't have to request discovery materials; it's the duty of the plaintif to provide them. After that it gets more complicated.

Re your question about how La Habba's behavior and the smack downs will affect the jury: Received wisdom from my trail lawyers has it that the jury will not like what La Habba is doing, and will side with the judge. Of course, who knows what happens on Earth 2?

Any emails that the plaintiffs were going to rely on would have to be provided, plus whatever the defense requests that is reasonable to provide.

Based on my take from a most recent MTN comment, Carrolls lawyer has submitted another T nastygram into evidence,

At the same time she said that they will not call their remaining two witnesses to testify. So there will be no chance that Habba can crossexamine in front of the golden boy, he cannot supplement extra nasty comments.

Alina Habba Spotted At Trump Victory Party After Delaying Defamation Trial Over Illness

Donald Trump’s attorney, Alina Habba, was spotted rubbing elbows with Republicans in New Hampshire on Tuesday, just the day after asking for a delay in the ex-president’s defamation trial because she was feeling under the weather.

On Monday, one of the nine jurors considering writer E. Jean Carroll’s second defamation suit against Trump was excused for being ill.

Though Judge Lewis Kaplan and Carroll’s lawyers agreed to continue the trial with eight jurors, Trump’s legal team requested a delay, saying Habba had been exposed to COVID and had a fever. She was not wearing a mask during the hearing.

The next day, however, Habba was sighted celebrating Trump’s win in the New Hampshire primary by NBC News’ Garrett Haake.

Haake’s report appeared to be confirmed by a tweet from former Trump aide Dylan Quattrucci, who shared a photo with Habba taken at the victory party.

“Just arrived at President Trump’s NH primary victory party and ran into the wonderful Alina Habba,” he posted to X, formerly Twitter. “Alina is President Trump’s rockstar attorney & a huge inspiration of mine!”

While it looked like Habba may have been playing hooky, NBC legal analyst Lisa Rubin said the lawyer could have been being honest about feeling unwell.

“I am not insinuating Habba lied. At all. I take her at her word,” Rubin wrote on X on Tuesday. “She said she had been exposed and was feeling feverish over the weekend; she also represented on Monday that she tested negative that morning.”

Rubin added, “What I am suggesting, however is that *someone else* who has been a regular courtroom presence has COVID, without which there would be little reason for a three-day delay.”

The trial is set to resume on Thursday.

Defamation trial has resumed

The civil defamation trial of former President Donald Trump resumed Thursday morning for the first action since last week.

E. Jean Carroll, a former magazine columnist, alleged Trump raped her in a Bergdorf Goodman department store in the mid-1990s and then defamed her when he denied her claim. She is seeking more than $10 million in damages.

In a separate trial last year, a civil jury found Trump sexually assaulted Carroll and defamed her in 2022 statements, and the judge previously ruled that verdict would carry over to this defamation trial.

Myers is a fixture in New York media, having begun her career at Rolling Stone in the 1980s, followed by positions at Interview, where she worked for Andy Warhol, Seventeen and InStyle, according to a 2017 New York Times profile.

She became the editor-in-chief of Elle in 2000, and ran the magazine until 2017.

Former Elle editor Robbie Myers praised E. Jean Carroll as an employee, calling her an accomplished and popular “truth teller” who was essential to the magazine’s brand.

Myers, the editor-in-chief for Elle for 17 years, said she gave Carroll a raise during her tenure.

Myers also testified she met Donald Trump in 2012 or 2013 when she appeared on “The Celebrity Apprentice” reality TV show.

Trump "was kind and friendly" and showed her around his offices during downtime while they were shooting.

Under questioning from Carroll’s attorney, Myers said she was a registered Democrat and never voted for Trump. Trump's lawyer asked Myers if she'll vote for Trump in the upcoming election. She declined to answer saying she didn't think she had to share what she planned to do.
