That would be good news for Gonzales. Well, relatively speaking. He won't be the AG laughing stock anymore, but who knows how many of his relatives, or even himself, could end up deported.
I'm considering a not so fun thread about cabinet appointments if trump should win again. The possibilities are scarier than any movie I can think of.

Fair point: she has a strategy to enrich and empower herself.Frater I*I wrote: ↑Sat Jan 20, 2024 11:26 amI disagree...the "strategy" here is that she auditioning to be Attorney General for when Zee Orange Furher retakes the throne...
But no strategy on how to minimize the damages that are going to be awarded.

I think they are going with getting TFG the sympathy vote, that his lawyer is so incompetent that it shouldn't be held against him, ergo, no damages. A juruy pardon, so to speak.
I keep hearing these huge damage figures and think, watch out, this is how you lose. Juries be crazee, that's why cases settle.

I do not see a settlement in this case. Both sides have dug in and Ms. Carroll already proved sexual assault and damages in the first case. Of course you never know with juries but my guess would be $10 million in compensatory damages and at least that much in punitive damages. IANAL of course.Fiascoist wrote: ↑Sat Jan 20, 2024 2:53 pm I think they are going with getting TFG the sympathy vote, that his lawyer is so incompetent that it shouldn't be held against him, ergo, no damages. I thought this was not in front of a Jury and that it was up to the Judge to determine damages.

When the jury decides on an amount, can the judge order that tgf pay it personally? His PACs have paid most of his legal bills so far. I would be surprised if he doesn't pay the judgement from the PAC. He regards that money as his, anyway.

I take that in this district the local rules allow letters vs. motions? Interesting how the local rules in federal courts vary so much from district to district.

Why? Because his continued defamation of Carroll, even as the trial is ongoing, is entirely relevant to the jury’s consideration of punitive damages. 2/

I'd be willing to bet that if Trump takes the stand on Monday, he will slander Carroll within 5 minutes of "testimony."

He is controlling this trial, not her. He might as well be a ventriloquist. If he wants to take the stand, she couldn't stop him, even if she wanted to, which she doesn't.MN-Skeptic wrote: ↑Sun Jan 21, 2024 1:34 pm If Habba has an ounce of intelligence, she will keep Trump off the stand.
She does what she is told. That is probably one of the reasons he hired her and hasn't fired her yet.
But, you're right. His "testimony" will be a long stream of additional slander, whining about being persecuted and bragging about how great he is. He will completely ignore the fact that, in this stage of the trial, the facts of the case are not in dispute and he will go on and on about how he never knew her, she isn't/wasn't his type and how she enjoyed being raped.

It is a civil trial; the plaintiff can call the defendant to testify.MN-Skeptic wrote: ↑Sun Jan 21, 2024 1:34 pm If Habba has an ounce of intelligence, she will keep Trump off the stand.

It would appear, however, the plaintiff presently isn't planning on calling the defendant to testify during the plaintiff's case-in-chief. The defendant isn't listed on the plaintiff's witness list. But the defendant is listed as a possible witness on the defendant's list.
Even so, there's still a possibility the plaintiff could call the defendant as a rebuttal witness after the defendant's case (if there is one). (This, however, is extremely unlikely.)

If defendant puts himself on the witness stand to be interogated by his own lawyer, does the plaintiff not get to cross-examination?
E. Jean Carroll v. Donald J. Trump and United States of America (poll added!)
The plaintiff may cross-examine any of the defendant's witnesses, including the defendant (if he testifies).
Which is why people are predicting he will not testify.

And, even if Habba or one of the other lawyers tried to coach him by saying "don't say this" or "don't say that", he would completely ignore them.keith wrote: ↑Sun Jan 21, 2024 8:09 pmI didn't think Trump would ever put up with a rehearsal for his testimony.Ben-Prime wrote: ↑Sun Jan 21, 2024 6:15 pmOff TopicIt might be as legendary as the Roman Moronie criminal trial.

If he does take the stand, he will attempt to give a campaign rally speech. He will continue to defame the plaintiffs and insult the judge. He will insist that he never met Ms. Carroll but she somehow enjoyed having sex with him in Bergdorf's, even though he was never there.
I just hope the judge has the guts to gavel him into silence. I'm sure he will attempt to talk over the judge and the gavel as the judge tries to silence him.

I am waiting for a judge to threaten him with contempt of court and the Secret Service having to watch a cell door in the court building.

It was a busy weekend. Excuse me if this has been posted already. Roberta Kaplan filed a letter in reply to Habba's letter requesting a mistrial.
