Hunter Biden sues IRS over whistleblowers who criticized DOJ probe
The suit claims they shared his private tax information in media interviews.

Hunter Biden has filed a lawsuit in a Washington, D.C., federal court against the Internal Revenue Service over alleged "unlawful disclosures" made by a pair of whistleblowers who accused government prosecutors of mishandling their investigation into the president's son -- a claim the Justice Department has denied but nonetheless breathed fresh life into Hunter Biden's legal tribulations.

Attorneys for Biden, 53, accused Gary Shapley and Joseph Ziegler, both veteran IRS investigators, of waging a campaign to "to embarrass and inflict harm on Mr. Biden" by improperly sharing his private taxpayer information in media interviews.

"During these interviews, Mr. Shapley and Mr. Ziegler provide unsubstantiated and selectively chosen allegations of nefarious and potentially criminal behavior," wrote Hunter Biden's attorney, Abbe Lowell.

The IRS "failed to take reasonable steps to prevent its personnel from unlawfully disclosing" Hunter Biden's confidential taxpayer information in violation of the Privacy Act, Lowell argued.

Abbe Lowell is a take-no-prisoners attorney. Discovery will be fun for us, perhaps not so much fun for the IRS and Weiss at DoJ.

MTN associate Riggelman discusses background of Hunter Bidens lawsuit. Starts with long rant(?) about MSM using "the laptop" data without verifying chain of custody.

David Weiss, the federal prosecutor tapped to serve as special counsel investigating Hunter Biden, is slated to testify Tuesday before a House committee whose Republican members have questioned whether the Justice Department has gone easy on the president’s son.

It is highly unusual for the Justice Department to make a special counsel available for questioning by Congress before an investigation is complete. Weiss spokesman Wyn Hornbuckle signaled that the closed-door session with the House Judiciary Committee may be unsatisfying to Republicans, because Weiss does not plan to answer questions about “the specifics” of his investigation.

Yeah closed door because they knew they wouldn't get anything juicy and will cherry pick and use statements out of context in order to keep this nonsense going and spin their Biden crime family fantasy.

But they will be able to say things like 'If the public knew what I knew, they would know how guilty he was!', without any ability for reporters to fact check.

I had not heard about this truly vile attack on HB, or that Byrne was spreading the lies. These monsters are as vile as it gets. They are an infectious disease rotting out our country. I hope that HB gets a mint out of this scum.

Won't cure the country, but it will be satisfying.

In his criminal case in Delaware, Hunter Biden is seeking to subpoena Donald Trump, Bill Barr, Jeff Rosen and Richard Donoghue.

Odds the judge grants these are low, but still notable.

ETA: Subpoenas duces tecum. So very fun.
For his part, Mr. Trump has made a plethora of concerning public statements calling for an investigation or possible prosecution of Mr. Biden, both while in office and since leaving, that further suggest improper partisan, political demands were at play, either expressly or implicitly. See also 26 U.S.C. § 7217 (making it a felony for the President to request an IRS investigation of an individual). The former President has also incessantly called for law enforcement, the media, and the public to go after Mr. Biden. For example, he tweeted (@realDonaldTrump) or posted the following about Mr. Biden:

• D. Trump tweet on November 15, 2019: “Democrats must apologize to USA: Ukrainian Foreign Minister Vadym Prystaiko said that “United States Ambassador Gordon Sondland did NOT link financial military assistance to a request for Ukraine to open up an investigation into former V.P. Joe Biden & his son, Hunter Biden.....”

• D. Trump tweet on December 12, 2020: “Why didn’t Bill Barr reveal the truth to the public, before the Election, about Hunter Biden.”

• D. Trump tweet on December 12, 2020: “IF Biden gets in, nothing will happen to Hunter or Joe. Barr will do nothing, and the new group of partisan killers coming in will quickly kill it all. Same thing with Durham. We caught them cold, spying, treason & more (the hard part), but ‘Justice’ took too long. Will be DOA!”

• D. Trump tweet on December 17, 2020: “I have NOTHING to do with the potential prosecution of Hunter Biden, or the Biden family. It is just more Fake News. . . .”

• D. Trump Truth Social posts on June 20, 2023:

o “Wow! The corrupt Biden DOJ just cleared up hundreds of years of criminal liability by giving Hunter Biden a mere ‘traffic ticket.’ Our system is BROKEN!”
o “A ‘SWEETHEART’ DEAL FOR HUNTER (AND JOE), AS THEY CONTINUE THEIR QUEST TO ‘GET’ TRUMP, JOE’S POLITICAL OPPONENT. WE ARE NOW A THIRD WORLD COUNTRY!”
o “The Hunter/Joe Biden settlement is a massive COVERUP & FULL SCALE ELECTION INTERFERENCE ‘SCAM’ THE LIKES OF WHICH HAS NEVER BEEN SEEN IN OUR COUNTRY BEFORE. A ‘TRAFFIC TICKET,’ & JOE IS ALL CLEANED UP & READY TO GO INTO THE 2024 PRESIDENTIAL ELECTION. . . .”

• D. Trump Truth Social post on July 11, 2023: “Weiss is a COWARD, a smaller version of Bill Barr, who never had the courage to do what everyone knows should have been done. He gave out a traffic ticket instead of a death sentence. Because of the two Democrat Senators in Delaware, they got to choose and/or approve him. Maybe the judge presiding will have the courage and intellect to break up this cesspool of crime. The collusion and corruption is beyond description. TWO TIERS OF JUSTICE!

:snippity:

Consequently, Mr. Biden now moves this Court to issue four subpoenas directing Messrs. Trump, Barr, Donoghue, and Rosen (individually, the “Subpoena Recipient” and, collectively, the “Subpoena Recipients”) to produce the following documents and materials in their possession pursuant to Rule 17(c) for the time period January 20, 2017 to the present (the “Relevant Time Period”):

1. All documents and records (personal or official platforms) reflecting communications from the Relevant Time Period to, from, between, or among the Subpoena Recipient relating to or discussing any formal or informal investigation or prosecution of Hunter Biden, including, but not limited to, any decision, referral, or request to investigate or not investigate or charge or not charge Hunter Biden.

2. All documents and records (personal or official platforms) reflecting communications from the Relevant Time Period to, from, between, or among the Subpoena Recipient and any Executive Branch official, political appointee, Department of Justice official, government agency, government official or staff person, cabinet member, or attorney for President Trump (personal or other) discussing or concerning Hunter Biden.

3. All personal records (including diaries, journals, memoirs, memoranda, or notes) from the Relevant Time Period discussing or concerning Hunter Biden, including, but not limited to, reference to any formal or informal decision, discussion, or request to investigate or prosecute Hunter Biden.

4. Any documents and records produced by the Subpoena Recipient to the House Select Committee to Investigate the January 6th Attack on the United States Capitol that reference or discuss Hunter Biden.

The House Judiciary Committee has subpoenaed an assistant US attorney on the Hunter Biden criminal case, according to a copy of the subpoena reviewed by CNN.

House Judiciary Chairman Jim Jordan initially requested testimony from Assistant US Attorney Lesley Wolf in June along with a number of Justice Department officials involved in the Hunter Biden criminal investigation. The Department of Justice has made six high-level officials, including special counsel David Weiss, available to testify, but has not allowed the panel to interview Wolf.

In the subpoena letter, Jordan called the DOJ’s reasons for withholding Wolf’s testimony “unpersuasive.” DOJ declined to comment to CNN on the subpoena.

Whistleblowers with the Internal Revenue Service have told Congress they believe that Wolf deviated from protocol on several occasions throughout the case and stymied their efforts to obtain subpoenas and search warrants, allegations that Republicans have seized on.

Because in a closed deposition, they can ask all kinds of churlish questions they don't know the answer to but can get under the skin and get the witness to say something they can spin into a scandal.

In a public hearing, if they ask a question they don't know the answer to, they are liable to get an answer they don't want to hear. And that doesn't leave them with too many questions that would be incriminating.
Has everybody heard about the bird?
