America First Legal Sues Attorney General Merrick Garland and the Biden Department of Justice for Failing to Require Hunter Biden to Register as a Foreign Agent While Joe Biden Was Vice President

Today, America First Legal (AFL) filed a lawsuit against Attorney General Merrick Garland and the U.S. Department of Justice (DOJ) for failing to require Hunter Biden to register under the Foreign Agent Registration Act (FARA) during the Obama Administration and subsequently failing to make a public statement regarding the matter.

In March, AFL obtained emails from litigation against the National Archives and Records Administration (NARA) confirming that Hunter directly represented Burisma in its dealings with the Obama White House. Hunter was both a board member of Burisma, a “foreign principal” under 22 U.S.C. § 611(b), and an attorney at the law firm representing it. Hunter Biden was arguably Burisma’s agent and subject to FARA registration because he was an officer of Burisma and appears to have represented Burisma’s interests to the Office of the Vice President.

An “agent of a foreign principal” under FARA includes “any person who acts as an agent, representative, employee, or servant, or any person who acts in any other capacity at the order, request, or under the direction or control, of a foreign principal or of a person any of whose activities are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in major part by a foreign principal.” Attorney General Garland failed to require proper registration or otherwise follow legal procedures concerning a FARA waiver for Hunter.

Following this damning revelation, AFL filed a formal complaint with the DOJ against Hunter Biden for failing to register under FARA. Federal law makes clear that no person shall act as an agent of a foreign principal unless he has filed with the Attorney General a true and complete registration statement and files applicable supplements – none of which occurred during the Obama administration.

This is just for publicity, and once everyone has forgotten about it, the court most likely will rule there is discretion, which means the court can't compel anything.

Victor Shokin was fired in March 2016. That means there was precuis little time for Biden to have made a statement that Shokin was Corrupt in 2016.

Secondly Shokins statement itself bearly mentions the Bidens. According to him he was fired ber trying to bring back the former President.

Third its bullshit. Shokin never went after Bursima.

However, there are two big problems with the narrative presented by Trump and Giuliani, according to activists in Ukraine and others.

For one thing, Ukrainian prosecutors and anti-corruption advocates who were pushing for an investigation into the dealings of Burisma and its owner, Mykola Zlochevskiy, said the probe had been dormant long before Biden leveled his demand.

"There was no pressure from anyone from the United States" to close the case against Zlochevskiy, Vitaliy Kasko, who was a deputy prosecutor-general under Shokin and is now first deputy prosecutor-general, told Bloomberg News in May. "It was shelved by Ukrainian prosecutors in 2014 and through 2015," he added.

Activists say the case had been sabotaged by Shokin himself. As an example, they say two months before Hunter Biden joined Burisma's board, British authorities had requested information from Shokin's office as part of an investigation into alleged money laundering by Zlochevskiy. Shokin ignored them.

Kaleniuk and AntAC published a detailed timeline of events surrounding the Burisma case, an outline of evidence suggesting that three consecutive chief prosecutors of Ukraine -- first Shokin’s predecessor, then Shokin, and then his successor -- worked to bury it.

"Ironically, Joe Biden asked Shokin to leave because the prosecutor failed [to pursue] the Burisma investigation, not because Shokin was tough and active with this case," Kaleniuk said.

Ukrainian prosecutors have described no evidence indicating that Biden sought to help his son by getting Shokin dismissed -- and have suggested that they have not discovered any such evidence.

But there is a long list of Western organizations, governments, and diplomats, as well as Ukrainian anti-corruption groups, that wanted to see Shokin fired.

They include the International Monetary Fund, the European Union, the U.S. government, foreign investors, and Ukrainian advocates of reform.

In a column published days after Shokin was fired in March 2016, Anders Aslund, a senior fellow at the Atlantic Council think tank in Washington, wrote that his dismissal came as no surprise.

"The amazing thing is not that he was sacked but that it has taken so long," Aslund said. "Petro Poroshenko appointed Shokin to the role in February 2015. From the outset, he stood out by causing great damage even to Ukraine's substandard legal system."

An annual report from Burisma shows that the company donated between $100,000 and $250,000 to the Atlantic Council in 2018-19, according to multiple media reports.

Hunter Biden did in fact learn the identity of two buyers, according to three people directly familiar with Hunter Biden's own account of his art career. And one of those buyers is indeed someone who got a favor from the Biden White House. The timing of their purchase, however, is unknown.

That buyer, Insider can reveal, is Elizabeth Hirsh Naftali, a Los Angeles real estate investor and philanthropist. Hirsh Naftali is influential in California Democratic circles and is a significant Democratic donor who has given $13,414 to the Biden campaign and $29,700 to the Democratic National Campaign Committee this year. In 2022, she hosted a fundraiser headlined by Vice President Kamala Harris.

Insider also obtained internal documents from Hunter Biden's gallery showing that a single buyer purchased $875,000 of his art. The documents do not indicate the buyer's identity, which is also unknown to Insider at this time.

In July 2022, eight months after Hunter Biden's first art opening, Joe Biden announced Hirsh Naftali's appointment to the Commission for the Preservation of America's Heritage Abroad. It is unclear whether Hirsh's purchase of Hunter Biden's artwork occurred before or after that appointment. Membership on the commission is an unpaid position that is often filled by campaign donors, family members, and political allies — the same crowd that often winds up with US ambassadorial appointments. Hirsh Naftali's fundraising activities mark her as the kind of well-connected donor who often wins such appointments, regardless of any relationship they might have with the president's family. But they do not address the possibility that Hunter Biden might have voiced his support for her appointment.

In a 10-page letter to House Oversight Committee Chair James Comer (R-Ky.) obtained by HuffPost, former Trump ally Lev Parnas outlined his own efforts to seek negative information about Biden and his son Hunter Biden from several Ukrainian sources in 2019.

It would appear the plea agreement is being revised.

"For completeness," although the judge was nominated by the former president, she was part of a compromise package, i.e., she's a Democrat.

There was talk that this administration was considering this judge for a circuit judgeship, but I bet her catching Hunter's case will scuttle that.

Today Robert Hunter Biden’s long-anticipated guilty plea on two misdemeanor counts of failure to file a tax return was derailed. You’ve seen the news by now, and if you haven’t, you’ve probably seen the social media reactions, many of which are nonsensical and uninformed.

The truth is, so far, elusive. There were reporters in the courtroom. But, judging from the news stories, and with the greatest respect to those reporters, it seems they didn’t completely understand what was happening.
The truth further eludes us because we lack the most important document — the written plea agreement between the U.S. Attorney’s Office. Always read the plea agreement to understand a plea.
From press reports, it appears that U.S. District Judge Maryellen Noreika asked questions about the scope of the deal. Specifically, she asked whether the government was agreeing not to prosecute Hunter Biden further just on these tax issues, or on any other issues it was investigating, including the Foreign Agent Registration Act. The government responded that the deal only precluded the government from prosecuting any other tax crimes related to these facts; Hunter Biden’s lawyers said that was wrong and if that was the case there was no deal. The judge told them to go talk and work it out. Apparently they did - and Hunter Biden agreed with the government that he was only protected from further tax prosecution on these facts, not from other prosecutions based on other investigations — but the judge asked the parties to submit briefs clarifying the scope of the non-prosecution promise and to come back, and did not accept the plea.

This is strange, and we can’t interpret the extent of the strangeness because we don’t have the written plea agreement.
So for things to go wrong here, one of the following had to happen:

The government didn’t define the scope of its promise of non-prosecution in the agreement. That would be a huge mistake and very unusual.

The government defined the scope of its non-prosecution promise in the plea agreement but the scope was vague or badly drafted. That’s unusual and also a mistake. They are normally extremely careful with this language. The fact that the judge saw fit to inquire about the scope of the deal makes this possibility plausible — if the plea agreement was as clear on this point as it should be, and the judge read it, the judge wouldn’t have to ask that question.

Hunter Biden’s lawyers didn’t read the plea agreement carefully or didn’t understand the non-prosecution promise. Hunter Biden has experienced attorneys and that would be a huge and embarrassing blunder.

If I could read the plea agreement I could tell you which of these scenarios happened. But they haven’t filed the agreement and haven’t made it public, so we’re left to speculate.

The judge’s refusal to accept the deal for now was appropriate. If there’s no meeting of the minds — if the parties don’t agree on the terms of the deal — the judge shouldn’t accept the plea. Also, once uncertainty has been expressed on the record, it’s not that strange for the judge to say “go put it in writing and come back” rather than accepting their statement “ok we straightened it out now.” Federal judges are notoriously careful about the guilty plea colloquy. I would probably do the same about such a high-profile case — if there was any hint that a party thought the written plea agreement was ambiguous, I would want it fixed.

What this does not seem to suggest, at least based on the information we have, is that the judge has accepted GOP arguments that Hunter Biden is getting a sweetheart deal, or that she’s part of a GOP conspiracy, or that she’s ultimately going to tank the deal.

We may have to wait until the parties file the clarification requested by the judge. One would hope they’d file the plea agreement — amended or not — by then. That will answer questions about this hiccup (and, I think, make it easier to evaluate the “sweetheart deal” arguments).

For now, the only thing I am confident in saying is that somebody done fucked up. But I’m not sure who.

This week, Hunter Biden's former business partner, Devon Archer, testified before the House Committee in a closed-door interview.

The interview focused on the 2010s, when Hunter Biden sat on the board of Burisma and his father was vice-president under president Barack Obama.

Mr Archer said Joe Biden was never directly involved in their financial dealings, though Hunter Biden would often put his famous father on speakerphone to impress clients and business associates.

Dan Goldman, who was representing Democrats inside the room, told reporters after the interview that Mr Archer testified that Hunter Biden sold the "illusion of access" to his father by taking credit for things his father did as vice-president that he had no part in.

Mr Archer's attorney, Matthew Schwartz, said his client did "exactly what we said he would — show up and answer the questions put to him honestly and completely".

"Mr Archer shared the truth with the committee, and we will leave to them and others to decide what to do with it," Mr Schwartz said in a statement.

I say whatever H. Biden did that was illegal, he should pay the price. Kids can be hard. I've got two, one turned out great, the other struggles. The day finally came when I had to cut him loose. I still love him, always will, but I'm not responsible for what he does.

Pretty sure not a single trumper would say the same about jr and Eric.
