Trump valet arraigned over role in classified documents case
Walt Nauta faces six charges, including conspiracy to obstruct justice, corruptly concealing a record and making false statements

Edward Helmore
Thu 6 Jul 2023 16.16 BST

Waltine “Walt” Nauta, widely known for his role as Donald Trump’s personal valet, was arraigned on Thursday over his role in the federal classified documents case.

Nauta, 40, arrived in the former president’s orbit by way of a military assignment.

Trump’s “body man”, as he would become known, was raised as one of six siblings in the village of Agat, Guam, which has a population of about 4,515. His aunt Elly Nauta told the Washington Post in March that he was always a “good boy” and had enlisted in the Navy as a cook in 2001 “to see the world”.

After rising to the rank of culinary specialist, Nauta was assigned to presidential food service in 2012, which prepares meals for the president and first family, as well as catering dinners for visiting heads of state.

Nauta worked in a small White House passageway connecting the West Wing to a private dining room. After Trump was elected president, Nauta was assigned to Trump’s military valet. It fell to him to answer the presidential call button, often to serve Diet Cokes, sometimes Big Macs.

“Everyone realized Walt is the one who Trump knows and feels comfortable with. So let’s just give Trump what he wants, which is familiarity,” a former official told the Post.

But he was not regarded as a political operator, doing no more or less than what was required of him. When Trump’s term ended in January 2021, Nauta followed the ex-president to Florida.

“There was a need for someone who wasn’t too proud to get a new tie, pick up dry cleaning, follow him around on the golf course, staff his dinners, do things that a lot of people just aren’t dying to spend their whole life doing,” a Trump adviser told the Post.

But Nauta now faces six federal charges, including conspiracy to obstruct justice, corruptly concealing a document or record, and making false statements, over his alleged role in the classified documents case.

It sounds like the Magistrate Judge got tired of the games and just assigned him a local public defender to enter a plea.

Sounds about right to me, Somerset.

From her firm's website:
SASHA DADAN
As a Florida bar licensed attorney, Sasha began her legal career at the Office of the Public Defender in the 19th judicial Circuit. As an Assistant Public Defender she represented over 3,000 clients in felonies, misdemeanors, DUIs, and juvenile cases where she gained significant trial experience. She achieved favorable results for her clients that ended in the dismissal of many criminal cases, acquittals, and suppression of evidence. Her ability to write, research, and analyze case law was key in her ability to suppress evidence and win appeals. Taking depositions of essential witnesses, police officers, and experts proved promising in settlement of her cases leading to satisfied clients. While at the Public Defender’s Office she received over 100 hours of continued legal education training in criminal law and trial preparation. She is also licensed to practice in the Middle District and Southern District of Florida.

After leaving the Public Defender’s Office, she handled civil cases involving domestic violence injunctions, time-sharing and child support matters. She helped establish the first Injunction for Protection program on the Treasure Coast assisting survivors of domestic violence seeking an injunction in the courtroom. Her profound knowledge of domestic violence injunction cases has led to the issuance of many injunctions and her aggressive trial tactics has made her invaluable and sought after for legal representation.

At Dadan Law Firm, Sasha is compassionate about every case she handles, and takes the time to listen to your needs. Her drive and determination for justice produces results. She represents clients in family, criminal, and civil litigation matters.

Sasha is equally active in her community. She is a member of the Florida Association Women Lawyers of Martin County; St. Lucie County Association of Defense Lawyers, Martin County Bar Association, and former Chair of the Lady Lawyers Luncheon in Martin County.

In Trump case, Justice Dept. unseals previously blacked-out portions from search warrant application

ERIC TUCKER
Thu, July 6, 2023 at 1:10 AM GMT+2

WASHINGTON (AP) — The Justice Department on Wednesday disclosed some of the previously blacked-out portions of a warrant application it submitted last year to gain authorization to search former President Donald Trump's Florida property for classified documents.

Key portions of the document had already been made public, but media organizations including The Associated Press had pressed for further unsealing in light of a 38-count indictment last month charging Trump and his valet, Walt Nauta, with concealing classified records at Mar-a-Lago from investigators. A magistrate judge, Bruce Reinhart, declined to order the Justice Department to unseal the search warrant affidavit in its entirety but did require prosecutors to publicly file a less-redacted affidavit.

The newly revealed paragraphs lay out important evidence that prosecutors had gathered well before the search took place, recounting how surveillance footage from inside the property showed dozens of boxes being relocated by a Trump aide in the days before FBI and Justice Department investigators visited the home to collect records.

During that June 3, 2022 visit, law enforcement officials were handed an envelope of 38 classified documents and told that all records sought by a subpoena were being turned over and that a “diligent search” of the home had been done. But investigators had reason to believe that was not true based on the relocation of boxes that they had observed on video, and that additional records remained at the house.

The movement of boxes by Nauta was detailed in last month's indictment, but its inclusion in the search warrant affidavit helps explain why the Justice Department felt it had probable cause to search Trump's home on Aug. 8, 2022 and why investigators were concerned that documents were being intentionally withheld from them.

The affidavit recounts how someone identified only as “Witness 5” was seen on multiple days carrying either cardboard or bankers' boxes in and out of the anteroom at the house. The affidavit does not mention Nauta by name, but the dates of the actions — as well as of an FBI interview “during which the location of boxes was a significant subject of questioning" — line up with the dates cited in the indictment.

:yeahthat:

She's going to have a steep learning curve. Apart from the specialized knowledge required for white collar prosecutions and the even more specialized domain of the laws and rules for classified information, there's the basic problem of the difference between state and federal criminal procedure.

When the NYC indictment was released, I was struck by the steady parade of experienced former federal prosecutors opining on this and that, only to be politely ripped to shreds by fact-checking NY criminal lawyers. And of course, it works the other way too. Presumably she'll be used to being able to take discovery depositions (a feature of Florida state criminal procedure that I learned about several weeks ago see viewtopic.php?t=2148&start=100#p199593). Not available in federal court.

It's because he is (or at least, was) in the navy and has the rather unique first name of Waltine.

I believe he’s retired. As I understand it, he retired in 2021 as an E-8 at 20 or so years. He was advanced to E-8 in 2020. He’s entitled to around 50% (maybe slightly more) of the average monthly pay over the highest three years’ pay (usually the last three, but not necessarily).

Unless the Navy decides to recall him to active duty and court-martial him, he’ll be able to keep his retirement. A conviction in federal court won’t be enough, I don’t think.

I’m curious to know (but never will know) the extent to which any of that has played/will play into potential plea negotiations.

There it is: Trump’s lawyers are effectively stating they want the trial delayed under after the election. An election that is more than one year away.
