Reading the plaintiffs submission it's obvious that the parties could not agree on a common evaluation and the DOJ moved on. It seems to me that plaintiffs may have tried to play delaying tactics and wanted to have more talks with the DOJ over and over.

Yeah, and that gives Judge Dearie a hammer with which to bop Trump over the head, but sadly ...

Judge Dearie gave them until October 20 to jointly file a document. Trump refused to cooperate, so the DOJ filed its own version of the document without him. Now Trump says the DOJ version isn't accurate and he's going to comply by Monday. But the deadline was yesterday.

Trump is fucking with Judge Dearie. And Marcy Wheeler correctly points out, that's probably what Judge Cannon wants.

Dearie can now say, too late, we're not filing your (Trump’s) version of the document, if you want to continue playing games you can take your chances with my orders, hahaha. That's what I would do, which is one reason why I'm not Judge Dearie. There are others. :blackeye:

Judge Dearie did not take kindly to having a party ignore his deadlines and substitute its own. “[A]ny submission by Plaintiff to the contrary is now untimely…”

Dearie will accept the late homework up to, but not beyond, close of business today.

It’s a firm but gentle bop. It also suggests to me that Judge Dearie has a very limited reservoir of patience for this sort of crap.

At least one of the documents seized by the FBI describes Iran’s missile program, according to these people, who spoke on the condition of anonymity to describe an ongoing investigation. Other documents described highly sensitive intelligence work aimed at China, they said.

Unauthorized disclosures of specific information in the documents would pose multiple risks, experts say. People aiding U.S. intelligence efforts could be endangered, and collection methods could be compromised. In addition, other countries or U.S. adversaries could retaliate against the United States for actions it has taken in secret.

This begs the question - Are there more top secret documents stolen by Trump, hidden on other Trump properties? Of course, now that our enemies know that such valuable documents possibly exist in unsecured locations, how long will it be before our enemies steal them from Trump?

So impotus is accusing NARA, the FBI and others of manipulating documents. He better be able to proof it with evidence. Cause usually there are more than a single copy of a document, eg the sender to the WH holds one too. Can he point out in the scanned document set which alterations have occured? Can he indicate which documents the FBI inserted into the stash? We are not speaking about theose documents he claims the FBI made disappear, cause he has not yet delievered the last of them himself (one assumes).

None of these documents is a classified document. The Eleventh Circuit's stay order removed all of the classified documents from the Special Master review.

I’ve spent a few minutes attempting to correlate Judge Cannon’s 9/29 order messing up Judge Dearie’s case management plan with Judge Dearie’s more recent 10/7 order concerning filter material disputes, with no success at all. I’d need a large table, a pad of foolscap graph paper, colored pencils, erasers, and likely the better part of an hour to get a handle on the parties’ operative schedule.

However, it seems to me that even Judge Cannon's muddled up case management order requires Trump to explain the basis of his privilege designations in any document log.

Thus in DE125 (9/29/22) at 4, Judge Cannon ordered:
For any document that
Plaintiff designates as privileged and/or personal, Plaintiff shall include a statement adequately explaining the precise basis for the designation, including, as relevant to any possible assertions of executive privilege, a sufficient description of the rationale and scope of the assertion from which to evaluate the merits of the assertion.
In the same order at 5, Judge Cannon wrote:
The log shall set forth each party’s position as to each disputed designation, providing sufficient explanation from which to properly evaluate the parties’ positions. Upon receiving the parties’ list of disputes, the Special Master will issue report(s) and recommendations resolving such disputes.
In the DOJ's yesterday letter, although somewhat hampered by not being able to reveal potentially privileged content, the DOJ explained the basis for its positions, including issues of global application, e.g., executive privilege cannot be used against the executive itself; no invocation of executive privilege by a former president can overcome need for a document in a criminal investigation.

Trump's today letter makes no effort whatsoever to explain the basis for its privilege/personal document positions as to individual documents, and does not address the global issues. His lawyers do claim to have "stated generally its position" to the DOJ. They also say that further briefing is needed and claim that the DOJ agrees.

In an ordinary civil action, Trump would be perilously close to forfeiting his claims for these documents, as to which he had the burden of proof. But Judge Dearie will give him another chance, and he has no effective way to deal with disobedience, since his report is subject to review de novo by Judge Cannon.
