When he first came into office and started doing executive orders all over the place, I was pretty sure that he was going to be really dangerous when he got into his second year in office and learned a lot more about all the powers the president now has.

Question: why does the administration think it needs an emergency declaration for slapping tariffs on Mexican goods? Perhaps to set the NAFTA treaty aside?

Considering this tariff threat, will Canada and Mexico want to renegociate NAFTA 2.0 to prevent future damages by Americans playing with tariff threats?

"They think they can build now and ask questions later, and that's not how it works," a water agency spokesperson said.

The viral crowdfunding effort to build a wall on the southern border aimed at deterring immigrants from crossing illegally was only recently completed, but on Monday the newly installed wall suffered a major setback — a large gate built into the barrier was ordered opened by officials.

The controversial half-mile wall constructed along the US–Mexico border near Sunland Park, New Mexico, was erected earlier this month after organizers raised more than $23 million on GoFundMe, the online crowdfunding site. But We Build the Wall organizers failed to obtain the required authorization to build the barrier on federal land, cutting off access to waterways and a public monument.

"This is normally done well in advance of a construction project," said Lori Kuczmanski, a spokesperson for the International Boundary and Water Commission, the agency that addresses waterway issues between the US and Mexico. "They think they can build now and ask questions later, and that's not how it works."

In response, IBWC officials on Monday afternoon propped open a large gate installed in the wall. The gate, constructed on roughly 33 feet of federal property, had blocked officials from accessing a levee and dam, and cut off public access to a historic monument known as Monument One, the first in a series of obelisks that mark the US–Mexico border from El Paso to Tijuana.

On Tuesday evening, after publication of this story, IBWC announced the gate would be locked at night "due to security concerns." The agency said in a statement that it "is continuing to work with We Build The Wall regarding its permit request."

Water agency officials, however, said We Build the Wall organizers went forward with construction of the fence without turning in the proper paperwork for the barrier.


"Their permit is still in the works," Kuczmanski said. "We're asking for documentation."

While Kolfage has touted the project as the "Cadillac of walls," BuzzFeed News recently observed dozens of people crossing the border into the US in search of Border Patrol agents to request asylum just a short distance from the wall. City officials and local residents, even those who supported a border wall, also told BuzzFeed News they were concerned the half-mile privately funded wall will only direct migrants to other parts of town, creating a new host of issues.
And:
The group selected the section of the New Mexico border to build the wall because it was "the number one most important mile to close," said Steve Bannon, the former strategist for President Trump and advisory board chair for the project.

But in a statement, US Customs and Border Protection said the "project is not connected to our efforts," and that it had already prioritized building border barriers in locations that "will most impact border security operations." The site where North Dakota–based construction company Fisher Industries built the crowdfunded wall on private land was "not prioritized under current funding," the agency said.

Judge blocks Trump from using billions in military funds for border wall
A federal judge on Friday issued a ruling blocking the Trump administration from tapping billions of dollars in military funds to construct a wall on the United States's southern border.

U.S. District Judge Haywood Gilliam issued the permanent injunction in a California federal court, after initially ruling last month to temporarily halt the administration’s use of military funds for the border wall.

President Trump declared a national emergency earlier this year in order to divert roughly $6 billion in Defense Department funds toward border wall construction. Friday's ruling blocks the administration from using $2.5 billion in military funds for a border wall.

Gilliam, an Obama appointee, also issued a ruling in a separate case stopping the Trump administration from moving forward with border wall construction in New Mexico and California while that legal challenge plays out.

Rep. Alexandria Ocasio-Cortez claims Border Patrol agents are forcing migrants to drink out of toilets and live under other extreme conditions — while the officers sit back and laugh.

“I see why CBP officers were being so physically &sexually threatening towards me,” the congresswoman tweeted Monday after leaving a US Customs and Border Protection facility in Texas.

“Officers were keeping women in cells w/ no water & had told them to drink out of the toilets,” she said. “This was them on their GOOD behavior in front of members of Congress.”

The New York lawmaker was visiting a number of migrant detention centers scattered along the southern border on Monday with other congressional Democrats following reports of terrible conditions and repeated sexual assaults.

“Now I’ve seen the inside of these facilities,” Ocasio-Cortez tweeted. “It’s not just the kids. It’s everyone. People drinking out of toilets, officers laughing in front of members Congress.”

She added, “I brought it up to their superiors. They said ‘officers are under stress & act out sometimes.’ No accountability.”

The Trump administration is seeking to fine some immigrants, who are in the United States illegally, hundreds of thousands of dollars for failing to take steps to leave after being ordered to do so, according to government documents obtained by NPR.

The Department of Homeland Security sent out a batch of notices across the country to targeted individuals ordering them to pay fines of up to nearly $500,000 for "failing to depart the U.S. as previously agreed," among other factors.

It's the latest hard-line effort by the administration as it clamps down on illegal immigration at the border and increases interior enforcement.

"It is the intention of ICE to order you pay a fine in the amount of $497,777," Lisa Hoechst, U.S. Immigration and Customs Enforcement officer, wrote to Edith Espinal Moreno in a letter dated June 25, 2019, obtained by NPR from lawyers for Moreno.

A divided three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco agreed with a lower court ruling that prevented the government from tapping Defense Department counterdrug money to build high-priority sections of wall in Arizona and New Mexico.

The decision is a setback for Mr. Trump's ambitious plans. He ended a 35-day government shutdown in February after Congress gave him far less than he wanted. He then declared a national emergency that the White House said would free billions of dollars from the Pentagon.

The case may still be considered, but the administration cannot build during the legal challenge.

The Supreme Court cleared the way Friday for the Trump administration to tap billions of dollars in Pentagon funds to build sections of a border wall with Mexico.

The court’s five conservative justices gave the administration the greenlight to begin work on four contracts it has awarded using Defense Department money. Funding for the projects had been frozen by lower courts while a lawsuit over the money proceeded. The court’s four liberal justices wouldn’t have allowed construction to start.

The lawsuit at the Supreme Court was brought by the American Civil Liberties Union on behalf of the Sierra Club and Southern Border Communities Coalition. The justices who lifted the freeze on the money did not give a lengthy explanation for their decision. But they said among the reasons they were doing so was that the government had made a “sufficient showing at this stage” that those bringing the lawsuit don’t have a right to challenge the decision to use the money.
SCOTUS' granting the government's application to stay the lower court's injunction:
The application for stay presented to JUSTICE KAGAN and by her referred to the Court is granted. Among the reasons is that the Government has made a sufficient showing at this stage that the plaintiffs have no cause of action to obtain review of the Acting Secretary’s compliance with Section 8005. The District Court’s June 28, 2019 order granting a permanent injunction is stayed pending disposition of the Government’s appeal in the United States Court of Appeals for the Ninth Circuit and disposition of the Government’s petition for a writ of certiorari, if such writ is timely sought. Should the petition for a writ of certiorari be denied, this stay shall terminate automatically. In the event the petition for a writ of certiorari is granted, the stay shall terminate when the Court enters its judgment.
I haven't read the briefing, but I infer the argument is the appropriations bill didn't create a remedial cause of action.
